Demolition of 525 and 501 Mainstreet and 15 — 6t" Avenue North
Proposed Action
Staff recommends adoption of the following motion: Move to accept a bid for the
demolition of 525 and 501 Mainstreet and 15 — 6t" Avenue North from Veit; and accept
bids from WSB Engineering for demolition oversight, reporting, and soil sampling; and
authorize staff to execute any agreements related to the demolition work.
Overview
The City owns 501 Mainstreet, 525 Mainstreet, and 15 — 6t" Avenue North. 501
Mainstreet is a former gas station that has an active leak file with the MPCA that
requires additional soil sampling on the site. 525 Mainstreet is a former car repair and
sales lot that was also previously a gas station. 15 — 6t" Avenue North is a single family
residence. All three properties are vacant and part of a larger redevelopment effort that
would encompass other properties within the same block.
As part of maintaining these parcels of land, Staff recommends demolition and
clearance of the properties that will remove three blighted buildings and close the active
leak file with the MPCA.
Staff obtained a bid from WSB Engineering to act as the City's representative during
demolition and provide oversight and soil testing services, as well as all required
reporting to the MPCA to close the active leak file. The City has worked with WSB
Engineering to provide similar services for the Shady Oak Road project and Cottageville
Park. WSB Engineering submitted a bid for each property.

The cost is in line with what the City has paid in the past for similar services.
The City asked three demolition contractors to submit bids for the demolition of all three
properties. Two contractors responded; Veit and Dale's Contracting. The scope of
services includes coordinating with WSB for soil testing and MPCA reporting, obtaining
all required permits, erosion control, disconnecting sewer and water, abatement and
removal of all asbestos materials, demolition of the three buildings, removal of

foundations and slabs, backfilling the properties, removal of all parking lots, retaining
walls, and driveways, bringing in top soil and seeding the properties.
The scope of services does not include removal of any trees. There are a number of
trees along the property line at 15 — 6t" Avenue North. These will remain on the property
after demolition is complete.
Veit was the low bidder with an estimate of $64,900 to remove all three structures.
Dale's Contracting submitted a bid for $119,025. Veit is a reputable company with a
great deal of experience doing demolitions of this type.
The Public Works Director has reviewed the bids and is comfortable with the scope of
services proposed. Staff is recommending moving forward with WSB Engineering and
Veit to complete the work for a total cost of $79,200. The project would be paid for out
of the Economic Development Fund.
Primary Issues to Consider
501 Mainstreet — Leak File 19153
All known underground tanks have been removed from 501 Mainstreet and required
documentation has been submitted to the MPCA; however a leak file will remain open
until soil testing is done underneath the dispenser islands, which will not be able to
occur until demolition begins. We anticipate that the soil testing will show that no leaks
have occurred under the dispenser islands and that the leak file will then be able to be
closed; however, if petroleum is found in the soil by WSB during their testing additional
remediation will be required to close the site.
525 Mainstreet — Hydraulic Lift
All known underground tanks have been removed from 525 Mainstreet and the property
does not have an open leak file with the MPCA; however, a hydraulic lift is inside the
building that was used for car repairs. Hydraulic lifts are common locations for
petroleum leaks and soil testing will be done at the time of its removal to check for any
contamination. If contamination is found additional soil removal and remediation may be
required by the MPCA.
Block 64 — TIF District
The City may wish to create a TIF district for the redevelopment of this block at some
time in the future. In that case, the three properties to be demolished would be included
in the district. According to Stacie Kvilvang at Ehlers the properties will be able to be
included in a future TIF district, even if demolished, provided the City has completed a
blight inspection and the HRA has passed a resolution stating that they are blighted and
that they would be included in any TIF district that would be created. The City has done
both of these things so there should be no issue with moving forward with demolition.

As requested, outlined below is a scope of work and cost to perform demolition oversight and
soil sampling services at the commercial property located at 525 Mainstreet in Hopkins, MN (the
Site). The purpose of the work is to provide oversight and documentation for the removal and
disposal of the regulated waste and demolition activities in addition to collecting documentation
soil samples during the removal of an underground hydraulic hoist at the Site. The following
tasks are anticipated to be performed as part of the demolition oversight services:
Task 1 — Demolition Oversight - $3,200
Project Coordination and Documentation
WSB will coordinate with contractors to ensure all demolition activities including hazardous
material removal and disposal are performed in accordance with local, state, and federal
guidelines. WSB will also coordinate with contractors to obtain documentation for final
reporting purposes and will maintain communication with the City regarding the demolition
schedule.
Assumptions: This task assumes the abatement and demolition contractor will secure all
required permits.
On -Site Demolition Oversight and Inspection
WSB will provide oversight during all demolition activities to assess for unknown environmental
conditions. WSB will conduct a walkthrough prior to demolition to ensure all regulated
materials are removed and properly disposed of at a permitted landfill facility. WSB will also
conduct a final walkthrough to ensure the Site is properly graded, seeded, and is free of
demolition debris.

Task 2: Soil Sampling - $2,600
Soil and Analytical Sampling
WSB will collect one soil sample beneath the underground hydraulic hoist and four sidewall
samples to document the presence or absence of environmental contaminants. The soil samples
will be conducted during demolition activities and be performed in accordance with MPCA
guidance document 3-01, Excavation of Petroleum Contaminated Sampling and Tank Removal
Sampling. Each soil sample will be field screened using a photoionization meter detector (PID)
with a 10.6 eV lamp, surveyed using a handheld GPS unit, and analyzed for the following
parameters:
• Diesel range organics (DRO) using the Wisconsin Method
• Gasoline Range organic (GRO) using the Wisconsin Method
• Volatile Organic Compounds (VOCs) using EPA Method 8260
• Polycyclic Aromatic Hydrocarbons (PAHs) using EPA Method 8270
• RCRA Metals (using various EPA Methods
Assumptions: This task assumes the collection and analysis of 5 total soil samples analyzed for
the above listed parameters at a standard turnaround (10 day). This task assumes the demolition
contractor will provide the equipment for hydraulic hoist removal and subsurface soil collection.
This task assumes the hoist area will be backfilled by the contractor with clean material after
removal and soil sample collection.

in a separate scope and cost to the City.
Total Cost and Schedule
WSB proposes to perform the above demolition oversight services for a lump sum fee of $5,800.
If additional environmental services are required than outlined above, WSB will perform the
services on a time and materials basis upon authorization from the City. The work can be
performed as early as the week of May 26, 2014. If you wish to authorize this work, please sign

TERMS AND CONDITIONS
Payments: Owner/Con tractor shall make partial payments to Veit & Company, Inc. ("Veit") as the work progresses at the end of each monthly pay period unless
otherwise stated herein. Within 30 days after receipt of the invoice, Owner/Contractor shall pay to Veit such invoice amount. Interest will be charged at the maximum
rate permitted by law for past due amounts.
Cancellation: The Owner/Contractor shall make restitution to Veit for all costs of work performed including material, services and equipment provided should this
contract be canceled for any reason beyond the direct control of Veit. Cancellation for convenience of the Owner/Contractor, directives ofgovernnicntal agencies, non -
issuance of required permitting based upon the proposed program of work, or other reasons beyond the direct control of Veit shall be reimbursable at actual cost phis
audited overhead and ten percent (10%) profit.
Insurance: Veit shall provide at its own expense and maintain during the term of the contract insurance from insurers satisfactory to Contractor/Owner to cover Veit's
activities in connection with this project Such insurance shall provide coverage of the nature and in the amounts listed below:
a. For claims covered by Workers' Compensation and Employer's Liability, the amount of statutory limits for any state in which operations are to be perfionned.
b. Insurance upon each motor vehicle used by Veit in connection with the work providing public liability coverage as to such vehicle of vehicles of not less than
$1,000,000 for one injury and $1,000,000 for Al injuries in one accident, and property damage coverage of not less than $1,000,000 applying to any one loss.
C. A comprehensive general liability policy providing bodily injury coverage, including death for not less Than $1,000,000 coverage as to each occurrence and
$1,000,000 aggregate.
Notwithstanding any other provision of this Proposal to the contrary, should any policy required by the Proposal be canceled or otherwise terminated before the
completion of the work hereunder, Veit shall exert all reasonable efforts to procure and provide certificates of such insurance to Owner/Contractor upon written request.
In the event that Veit is unable to obtain the required insurance coverage on a reasonable basis, then either Veit or Owner/Contractor shall have the right to terminate
this Contract without penalty.
Indemnification- Veit agrees to indemnify and hold harmless Owner/Contractor, its directors, eniploycei, agents and officers, from and against only those claims,
causes of action, liabilities, costs of expenses, including reasonable attorney's fees, attributable to bodily injury, death or property damage which Owner/Contractor may
incur or which may be asserted against Owner/Contractor and which arise directly out of Veit's solely negligent acts in the performance of this contract. In no event
shall Veit's liability under this indemnification provision exceed, either for a single incident or in the aggregate, the amounts specified in this proposal.
Asbestos Abatement: Veit represents that the services to be Performed by Veit shall be substantially in accordance with asbestos abatement industry standards. Veit
makes no warranties or representation regarding, nor accepts any responsibility for; contaminated dust, debris, fungi and to other unwanted materials or substances that
may settle, proliferate, grow, amplify or re -grow subsequent to the performances of Veit's services, Veit expressly states that Veit's services hereunder shall not he in
any manner deemed to prevent the future discovery, disturbing or distribution of asbestos -containing building materials, not included in this Work, nor any microbial
contamination, and Veit expressly disclaims any responsibility or liability arising out of any microbial contamination that may grow or amplify or asbestos
contamination that may occur subsequent to the performance of Veit':s services. Veit further disclaims any liability or responsibility for any indoor air pollution which
may exist at the time of the performance of Veit's services hereunder or which may subsequently exist as a result of the future collection, distribution, growth, or
amplification of microbial contamination, distribution and/or damage of asbestos -containing building materials or otherwise. Owner/Client recognizes that the presence
of hazardous materials, mold or pollution on or beneath the surface of a site or within the atmosphere contained within any structures on the site may create risks and
liabilities. Veit has neither created nor contributed to this pollution. Consequently, Owner/(Tient recognizes this contract will accordingly limit Veit's liability.
Subcontractors: Veit may enter into agreements with subcontractors for performance of services within the scope of the work hereunder; provided, however, that Veit
shall notify Owner/Contractor of the identity of each subcontractor and the nature of the work to be: performed by that subcontractor, and provided further that Veit shall
remain responsible for performance of the work in compliance with plans and specifications.
Contractual Relationship: Veit is air independent contractor and not an agent, servant or representative of Owner/Contractor. Veit's activities while oil the premises
shall be as negotiated and set forth in this contract and tinder no circumstances shall Veit assume any operations responsibility. It is the express intent of the parties that
Owner/Contractor shall remain the sole operator of the premises,
Plans & Specifications: Unless otherwise noted in the body of this document, Owner/Contractor is solely responsible for preparation of plans and specifications
relating to the work to be performed hereunder, and Veit makes no representations or warranties regarding those documents. Changed conditions will be negotiated as a
change order prior to performance of the work.
Limited Warranty and Limits of 1,hability
a. Warranty: Veit's sole and exclusive warranty with respect to all work and labor specified herein is that it shall perform the work in accordance with plans and
specifications, NO IMPLIED WARRANTY OF MERCHANTABILITY OR FITNESS FOR PARTICULAR PURPOSE SHALL APPLY.
b. Exclusive Remedy All work is guaranteed far one year frons completion thereof ("the warranty period"), If within the warranty period Veit receives prompt
written notice form Owner/Contractor that work was defective, Veit, at its discretion, shall repair or replace defective work or refund all or a portion of the contract
price thereof The foregoing shall be the Owner's/Contractor's exclusive remedy for defective work.
c. Limitation of Liability: IT IS HEREBY SPECIFICALLY AGREED BY AND BETWEEN VEIT AND OWNER/CONTRACTOR THAT IN NO EVENT
SHALL VEIT'S LIABILITYTO OWNER/CONTRACTOR EXCEED EITHER:
(1) THE AMOUNTSPECIFIED UNDER SUBPARAGRAPH INSURANCE FOR A WORKER-SCOMPENSATION CLAIM, OR
(2) AS TO ALL OTHER LIABILITY, INCLUDING LIABILITIES ARISING OUT OF THE USE OF OPERATION OF MOTOR VEHICLES, LIABILITIES
