Assessments that have been paid by certified checks, money orders, cash or credit cards since publication and mailing of the assessment statements have been notated on Exhibit A. The following items have been removed from Exhibit A prior to the adoption of the roll: PID #25-117-22 310017, 1236 Wagon Wheel Rd — 2 Delinquent Citations The citations were for failure to obtain rental license. The property sold on 8/28/2014 to an occupying owner per eCRV. PID #24-117-22 23 0034, 246 16t1i Ave N — 4 Delinquent Citations The citations are for multiple code violations. In lieu of assessing the citations at this time, an agreement has been signed by the property owner to abate the nuisance, and assess the costs of the abatement and administrative fee to his property at a later date. The following appeals have been received: PID #23-117-22 14 0034, 330 19t" Ave N — Delinquent Utility Bill The appeal requests a revision of the assessment. The property owner states financial hardship as the reason for the revision. Financial and medical documentation has been provided. Note that the appeal states that the delinquent utility bill has been paid. As of this writing, payment has not been received. Staff recommends denying the appeal. PID #23-117-22 410052, 137 19t" Ave N — Delinquent Citation The appeal requests a revision of the assessment. The property owner misunderstood the time period of the annual rental licensing process because this was her first time renting her property. Staff recommends imposing the $100.00 service charge and dismissing the citation fee of $500.00. The owner has complied and has an active rental license on the property. The proposed special assessments as described in Exhibit A are for delinquent utility bills, citations, and invoices. Notices of this hearing have been published, and both notices and assessment statements have been mailed to all affected property owners. Copies of the delinquent invoices and citations were also included with the assessment statements. Assessments that have been paid by certified checks, money orders, cash or credit cards since publication and mailing of the assessment statements have been notated on Exhibit A. • Appeal process If residents have not waived their rights to appeal, they are given the opportunity to approach Council during the public hearing. Standard appeal forms have been available at City Hall and are available at the public hearing. All owners wishing to appeal their assessment must complete an appeal form and present it to the Council prior to the close of the hearing. All appeal forms presented to Council during the public hearing must be completed and signed by the property owner. Should appeals be presented to Council during the public hearing, Council may wish to continue the hearing to the October 21, 2014 Council meeting to allow the staff time to examine the appeals and make a recommendation. This would still meet the statutory requirement of allowing the 30 -day interest free period for payments prior to certification on November 30, 2014. • Owner appeals/staff recommendations To date, our office has not received any appeals. An owner may appeal an assessment to district court pursuant to Minnesota Statutes Section 429.081 by serving notice of the appeal upon the Mayor or City Clerk of the City of Hopkins within thirty (30) days after the adoption of the assessment and by filing such notice with the district court within ten (10) days after service upon the Mayor and City Clerk. Under provisions of Minnesota Statutes Section 435.193 to 435.195 and Hopkins Ordinances 703.01 to 703.05 the City may, in its discretion, defer the payment of this special assessment for any homestead property owned by a person 65 years of age or older or retired by virtue of a permanent and total disability for whom it would be a hardship to make the payments. When a deferment of the special assessment has been granted and is terminated for any reason provided in that law and Ordinance, all amounts accumulated plus applicable interest become due. The property owner shall have the right to prepay the entire assessment. CITY OF HOPKINS HENNEPIN COUNTY, MINNESOTA RESOLUTION NO. 2014-059 ADOPTION OF THE ASSESSMENT ROLL 2014 MISCELLANEOUS SPECIAL ASSESSMENTS WHEREAS, pursuant to proper notice duly given as required by law, the City Council has met and heard and passed upon all objections to the proposed assessment for delinquent utility bills, citations, and delinquent invoices, all as more fully set forth and described in Exhibit A as attached to this resolution, and has amended such proposed assessment as it deems just, NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF HOPKINS, MINNESOTA: 1. Such proposed assessment, a copy of which is attached hereto and made a part hereof, is hereby accepted and shall constitute the special assessment against the lands named therein, and each tract of land therein included is hereby found to be benefited by the proposed improvement in the amount of the assessment levied against it. 2. Such assessments shall be payable in equal, annual installments extending over the periods of years set forth in Exhibit A, the first of the installments to be payable on or after the first Monday in January of 2015. Any deferred installments shall bear interest at the rate set forth in said Exhibit A from the date of the adoption of this assessment resolution. To the first installment shall be added interest on the entire assessment from October 7, 2014, until December 31, 2015. To each subsequent installment when due shall be added interest for one year on all unpaid installments. 3. The owner of any property so assessed may, at any time prior to certification of the assessment to the county auditor, pay the whole or a partial payment of any amount of the assessment but not less than the lesser of $100.00 or 25% of the assessment on such property, with interest accrued to the date of payment, to the city treasurer, except that no interest shall be charged if the entire assessment is paid within 30 days from the adoption of this resolution; and he may, at any time thereafter, pay to the city treasurer the entire amount of the assessment remaining unpaid, with interest accrued to December 31 of the year in which such payment is made. Such payment must be made prior to November 15 or interest will be charged through December 31 of the next succeeding year. 4. It is hereby declared to be the intention of the Council to reimburse itself in the future for the portion of the cost of this improvement paid for from municipal funds by levying additional assessments, on notice and hearing as provided for the assessments herein made, upon any properties abutting on the improvement but not made, upon any properties abutting on the improvement but not herein assessed for the improvement, when changed conditions relating to such properties make such assessment feasible. 5. To the extent that this improvement benefits nonabutting properties which may be served by the improvement when one or more later extensions or improvements are made, but which are not herein assessed, therefore, it is hereby declared to be the intention of the Council, as authorized by Minnesota Statutes Section 420.051, to reimburse the City by adding any portion of the cost so paid to the assessments levied for any of such later extension or improvements. 6. The clerk shall forthwith transmit a certified duplicate of this assessment to the County Auditor to be extended on the property tax lists of the County, and such assessments shall be collected and paid over in the same manner as other municipal taxes.
