80-2878 CITY OF HOPKINS 111 Hennepin County, Minnesota RESOLUTION NO. 80-2878 A RESOLUTION ORDERING PREPARATION OF ENGINEER'S REPORT ON IMPROVEMENTS WHEREAS a petition has been reveived requesting the extension of watermain at the Hopkins Nursing Home and the assessment of benefitting property for all or a portion of the cost of the improvement pursuant to M.S.A. , Secs. 429.011 to Secs. 429.111, as amended. NOW, THEREFORE BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF HOPKINS, MINNESOTA, that the proposed improvement be referred to John Strojan, City Engineer, for study and he is instructed to report with all convenient speed advising the Council in a preliminary way as to whether the proposed improvements are feasible and as to whether they should be made as proposed or in connection with some other improvement, and the estimated cost of the improvements as recommended. VESELY, City Attorney NOTICE OF TERMINATION OF SANITARY LAND FILL OF THE CITY OF HOPKINS, MINJESOTA NOTICE IS HEREBY GIVEN , that the City of Hopkins , a Municipal Corporation located in Hennepin County, which City has owned and operated a Sanitary Land Fill upon the premises more fully hereinafter described, which Sanitary Land Fill has been, from and after April 20, 1971 , duly licensed by the County of Hennepin and approved by the Minnesota Pollution Control Agency, all under number SW58. That said Sanitary Land Fill , herein described, has from and after June, 1980, been discontinued and will no longer be used for such purpose. That the legal description of the premises involved in , and used as said Sanitary Land Fill , is as follows: That part of the Northwest quarter of the Southwest quarter of Section 25, Township 117, Range 22, com- mencing at the Northwest corner of Outlot B , Westbrook Patio Homes ; thence Westerly along the South line of Seventh Street, South to its intersection with the Southeasterly right-of-way line of the Chicago, Milwaukee , St. Paul and Pacific railway; thence Southwesterly along the said Southeasterly right-of-way line of said rail - way to its intersection with the West line of Section 25, Township 117, Range 22; thence Southerly along said West line of said Section 25 to the Southwest corner of the Northwest quarter of the Southwest quarter there- of; thence Easterly along the South line of said North- west quarter of the Southwest quarter of Section 25, to the Southwest corner of Outlot A, Westbrook Patio Homes ; thence North along the West line of said plat of West- brook Patio Homes to the point of beginning. That the general type and location of the deposited solid waste and other pertinent characteristics of said Sanitary Land Fill facility upon said premises, consisted of a type I Sanitary Land Fill , on which GARBAGE , as defined in Subsection 8, and REFUSE , as defined in Subsection 15 , of Section 1 , of Ordinance number Two, of and for Hennepin County, entitled "Solid and Hazardous Waste Disposal Ordinance" , which ordinance was adopted on July 27, 1976, pursuant to M.S.A. 375.51 and 473.811 . That hereto attached and hereby made a part hereof, is a plat of said completed Sanitary Land Fill facility of the premises herein above described and containing the required information set forth in said ordinance. That this NOTICE is prepared and recorded as required by said Hennepin County Ordinance Number Two, herein above mentioned, and by the Minnesota Pollution Control Agency, its Regulation Number SW12 (9) . Basically the original plan as presented called for a phased improvement program over the next three years. How- ever, the majority of the Commissions consideration to date has been spent reviewing Phase I. Under this phase of the program the greatest concern has been over the proposed expansion of the warehouse structure directly east of Monroe. Basically this would involve the expansion of the southerly 620 ft. of this warehouse to within 15 ft. of the Super Valu property line off Monroe. This portion of the expansion is directly across from Harley Hopkins School. The northerly portion of the existing warehouse across from the existing single family homes on Monroe would be expanded to with- in 40 ft. of the Super Valu property line. The southerly portion of the new addition would be approximately 31 ft. in height with the portion across from the residential area being 26 ft. high. The main concerns over the proposed warehouse expansion have seemed to center around height and setback. If the property on which the ex- pansion is proposed to be built were rezoned from residential to industrial the setback requirement would be 40 ft. Because the school site is pre- sently zoned residential and has the potential for being developed with housing at some time in the future, some members of the Commission felt that the 40 ft. setback should also be required across from this property. With the same argument it was also felt that the 26 ft. height should be the entire length of the proposed expansion rather than just the northerly portion. Another concern was over the ability of Super Valu to expand eastwood for parking if the property west of Monroe was rezoned. The Hopkins Zoning Ordinance states that in an industrial district off-street parking may be extended by the width of three contiguous lots or 150 whichever is greater onto property which is zoned for residential use provided the land is under the same ownership. Jim Hawks, the City Planner stated this eastward ex- pansion could be prevented if the ordinance was amended so that this part S of the ordinance could only be invoked once (Super Valu has used this part of the ordinance once already) . The only other major concern of a portion of the Commission and some residents was over vehicular circulating in, out, and around the Super Valu facility as a result of their proposed improvements. On this point the Super Valu representative argued that signs could be placed around the facility to prevent any negative traffic impacts from being created. Throughout the planning process the Super Valu representatives met with local residents to resolve differences. For the most part a majority of the differences were resolved and on July 8th, the Planning & Zoning Commission gave concept approval to Super Valu. However, at the August meeting, basically because of the concerns expressed above, the Commission 411 denied a rezoning application by Super Valu. TO MINNEHAHA CREEK Dear Mr. Strojan: likPursuant to the Planning Commission Meeting on September 9, 1980, I would like to clarify the time schedule and design procedures we would be following for the final phase of construction on CSAH 18. Hennepin County has just started working on the final plans for the second phase of construction and will be submitting them to the City for approval in the fall of 1981. A winter contract letting is planned which will facilitate construction starting in the spring of 1982. Thus, during the summer of 1982, construction can proceed on both Phase 1 and Phase 2 as discussed at the meeting. The plans that are being prepared now are for the final contract on CSAFI 18 in the City of Hopkins. They would include all the necessary seed, sod, landscaping, and noise abatement measures that will be necessary to complete CSAR 18 and open up the missing link. Hennepin County will be meeting with the appropriate citizen groups in the area of the Hobby Acres - Knollwood Developments to get input from the citizens on the need for noise abatement walls and their overall placement. It is our expectation that we will be able to meet with these groups in the spring of 1981, prior to the completion of the final plans.
