04-07-2015 City Council Meeting HOPKINS CITY COUNCIL REGULAR MEETING PROCEEDINGS APRIL 7, 2015 CALL TO ORDER Pursuant to due call and notice thereof a regular meeting of the Hopkins City Council was held on Monday, April 7, 2015 at 7:05 p.m. in the Council Chambers at City Hall, 1010 First Street South, Hopkins. Mayor Maxwell called the meeting to order with Council Members Halverson, Cummings, Gadd and Kuznia attending. Staff present included City Manager Mornson, City Planner Anderson, Planning and Development Director Elverum, City Clerk Domeier, Assistant City Manager Genellie, Finance Director Harkess, City Attorney Landsman, Police Chief Reynolds, Public Works Director Stadler and City Engineer Stanley. ADOPT AGENDA There were no proposed changes to the Agenda. Motion by Cummings. Second by Kuznia. Motion to Adopt Agenda. Ayes: Halverson, Cummings, Maxwell, Gadd, Kuznia Nays: None. Motion carried. OATH OF OFFICE Chief Reynolds introduced Officer Whitney Paulson. City Clerk Domeier issued the Oath of Office and Officer Paulson's mother pinned on her badge. Mayor Maxwell welcomed Officer Paulson to the City of Hopkins. PRESENTATIONS 4.a. Proclamation Recognizing the Hopkins High School Girl's State Basketball Championship Mayor Maxwell read the Proclamation recognizing Hopkins High School Girls Basketball Coach Cosgriff's accomplishments and declaring April 11, 2015 as Brian Cosgriff Day in the City of Hopkins. Mayor Maxwell read the Proclamation recognizing April 7, 2015 as Hopkins Girl's State Basketball Championship Day in the City of Hopkins. 4.b. 2015 Mainstreet Improvement Project Update City Engineer Stanley gave an update on the 2015 Mainstreet Improvement Project. Mr. Stanley reviewed the construction staging, traffic detouring, temporary street closures and pedestrian rerouting during the construction process. Mr. Stanley reviewed the public outreach information including project newsletter, website, email updates, construction notices, Twitter, detour maps and on-site contact information. Council Member Halverson asked about pedestrian access to businesses. Mr. Stanley commented that temporary routes would be made available through the construction zone. Mr. Stanley commented that staff has been working with Metro Transit and some bus stops will be redirected. CONSENT AGENDA Motion by Gadd. Second by Kuznia. Motion to Approve the Consent Agenda. a. Approve Resolution 2015-036 Declaring Intent to Sell Bonds to Reimburse City Costs —Cottageville Park Improvement Project; (CR2015-049) Ayes: Halverson, Cummings, Maxwell, Gadd, Kuznia Nays: None. Motion carried. PUBLIC HEARING 6.a. Property Tax Abatement Related to Public Infrastructure Improvements; (CR2015- 046) Finance Director Harkess gave an overview of the Property Tax Abatement bonds. Stacy Kvilvang, Ehlers Financial Advisor, gave an overview of the proposed parcels and tax abatement process. The tax abatement bonds will be issued for the Cottageville Park and Municipal Parking Lot improvements. Mayor Maxwell asked how the parcels are selected and value determined. Ms. Kvilvang explained how the parcels are calculated and selected. Mayor Maxwell opened the public hearing at 7:34 pm. No residents came forward to address the Council. Motion by Cummings. Second by Halverson. Motion to close the Public Hearing. The public hearing was closed at 7:34 p.m. Ayes: Halverson, Cummings, Maxwell, Gadd, Kuznia Nays: None. Motion carried. HOPKINS CITY COUNCIL REGULAR MEETING PROCEEDINGS APRIL 7, 2015 Motion by Halverson. Second by Kuznia. Motion to Approve Resolution 2015-035 approving property tax abatement related to public infrastructure improvements in the City of Hopkins. Ayes: Halverson, Cummings, Maxwell, Gadd, Kuznia Nays: None. Motion carried. NEW BUSINESS 7.a. First Reading: Zoning Ordinance Amendment - Mixed-Use; (CR2015-051) City Planner Anderson gave an overview of the changes to the mixed-use zoning district ordinance regarding Floor Area Ratio (FAR) and setbacks. The Zoning & Planning Commission unanimously approved the amendment and the City Attorney has reviewed the ordinance amendment. Mayor Maxwell asked about the setbacks. Ms. Anderson explained the rear-yard set back. Motion by Cummings. Second by Gadd. Motion to Approve Resolution 15-37, approving Ordinance 15-1091, amending the zoning ordinance regarding setback and Floor Area Ratio (FAR) in the Mixed Use zoning district for first reading. Ayes: Halverson, Cummings, Maxwell, Gadd, Kuznia Nays: None. Motion carried. 7. b. First Reading: An Interim Ordinance Temporarily Prohibiting Medical Cannabis Manufacturing and Distribution Facilities; (CR2015-042) City Planner Anderson gave an overview of the interim ordinance prohibiting medical cannabis manufacturing and distribution facilities for one year. The Zoning & Planning Commission will be reviewing the ordinance at a future meeting. Mayor Maxwell asked if the City Attorney has reviewed the ordinance. City Attorney Landsman stated that the one-year moratorium would allow staff time to study the manufacturing and distribution of medical cannabis and determine whether the zoning ordinance needs to be amended for this use. Motion by Gadd. Second by Cummings. Motion to adopt Ordinance 15-1092, an interim ordinance temporarily prohibiting medical cannabis manufacturing and distribution facilities, for first reading. Ayes: Halverson, Cummings, Maxwell, Gadd,Kuznia Nays: None. Motion carried. HOPKINS CITY COUNCIL REGULAR MEETING PROCEEDINGS APRIL 7, 2015 7.c. Accept Bids and Award of Contract 2015 Municipal Parking Lot Improvements; (CR 2015-044) City Engineer Stanley gave an overview of the bids and project area. The bids were opened on March 24th and came in under engineer's estimate. The low bidder was S.M. Hentges and Sons, Inc. The contractor has a good reputation and was awarded the contract for the 2015 Mainstreet Improvements, which will assist with project coordination. Council Member Cummings asked about the impact of the parking lots improvements on scheduled events. Mr. Stanley explained that the contract requires that construction be completed one week prior to the opening of the Farmer's Market. Mayor Maxwell asked about the construction schedule. Mr. Stanley explained that staff will be meeting with contractor to review the schedule and staff will keep the Council updated. Mayor Maxwell asked about temporary tent set up in parking lots and potential damage to asphalt. Staff will investigate infrastructure installation for tent set up. Council Member Cummings asked about the engraved pavers at the Clock Tower Plaza. Mr. Stanley explained that all the engraved pavers would be replaced. Mayor Maxwell asked about possibility of salvaging the old engraved bricks. Staff will investigate salvaging the bricks. Council Member Halverson asked about the parking lots not scheduled for improvements. Mr. Stanley commented that staff continues to monitor the municipal parking lots for necessary repairs. Motion by Kuznia. Second by Gadd. Motion to adopt Resolution 2015-033 accepting bid; and Resolution 2015-034 awarding the contract, 2015 Municipal Parking Lot Improvements, City Project 2014-17. Ayes: Halverson, Cummings, Maxwell, Gadd,Kuznia Nays: None. Motion carried. 7.d. Approve Agreement with Flagship Recreation for the purchase and installation of play equipment at Cottageville Park; (CR2015-050) Public Works Director Stadler gave an overview of the Cottageville Park play equipment, playground surfacing, selection of Flagship Recreation, public outreach, costs and funding. The City Attorney has reviewed and suggested changes to the agreement. Council Member Gadd asked for clarification on the costs for the equipment. Mr. Stadler commented that the cost in the agreement is $312,710. Mayor Maxwell asked about warranties. Mr. Stadler commented that the warranty is ten years on the equipment and one year on the workmanship. Council Member Cummings asked about timing of the installation and upkeep. Mr. Stadler estimated that the play equipment installation would be completed in September and that Public Works would be responsible for maintenance of the area in addition to certain tasks being outsourced. Council Member Kuznia thanked the staff for all their efforts in regards to the park improvements. HOPKINS CITY COUNCIL REGULAR MEETING PROCEEDINGS APRIL 7, 2015 Motion by Gadd. Second by Cummings. Motion to approve an agreement with Flagship Recreation for the purchase and installation of play equipment at Cottageville Park and authorize the City Manager to execute the agreement in the amount of$312,710. The City Attorney commented that due to the changes to the agreement, the motion should be subject to review and approval by the City Attorney and Public Works Director. Motion by Gadd. Second by Cumming. Motion to approve an agreement with Flagship Recreation for the purchase and installation of play equipment at Cottageville Park and authorize the City Manager to execute the agreement in the amount of$312,710 subject to review and approval by the City Attorney and Public Works Director. First Reading: Ordinance Amending Section 725— Illicit Discharge and Connections; (CR2015-045) City Engineer Stanley gave an overview of the Illicit Discharge Ordinance amendment. The proposed amendments would satisfy required updates, create conformity with State statutes and define a process for violation of the ordinance. Motion by Kuznia. Second by Cummings. Motion to Adopt for first reading Ordinance 2015-1093, amending City Code Section 725 —Illicit Discharge and Connections. Ayes: Halverson, Cummings, Maxwell, Gadd, Kuznia Nays: None. Motion carried. ANNOUNCEMENTS •City Manager Mornson introduced new City Attorney, Mr. Scott Landsman. •Step To It Challenge: Registration started April 1. Challenge will be held May 3-30. •Southwest LRT Hopkins, Minnetonka Design Open House at City Hall: Tuesday, April 14 — 5:30 to 7:30 p.m. •Blake Road Corridor Collaborative event at Blake Middle School Library: Workshop II Development Opportunities —The Block Exercise, Monday, April 20 — 6 to 8 p.m. •City Manager Mornson commented that area non-profit organizations have expressed interest in fundraising for a future community building in Cottageville Park. •City Manager Mornson thanked Community Development Director Beekman and Public Works Director Stadler for securing CDBG funding for the Cottageville Park improvements.
