Minutes of the April 21, 2015 Regular Meeting Proceedings HOPKINS CITY COUNCIL REGULAR MEETING PROCEEDINGS APRIL 21, 2015 CALL TO ORDER Pursuant to due call and notice thereof a regular meeting of the Hopkins City Council was held on Tuesday, April 21, 2015 at 7:07 p.m. in the Council Chambers at City Hall, 1010 First Street South, Hopkins. Mayor Maxwell called the meeting to order with Council Members Halverson, Cummings, Gadd and Kuznia attending. Staff present included City Manager Mornson, Community Development Coordinator Beekman, City Clerk Domeier, Planning and Development Director Elverum, Assistant City Manager Genellie, Finance Director Harkess,City Attorney Kozar and Public Works Director Stadler. ADOPT AGENDA City Manager Mornson commented that the Hopkins Center for the Arts Annual Report has been deferred until the May 19th agenda. MotionSecond by Gadd. by Cummings. Motion to Adopt Agenda with modification presented. Ayes: Halverson, Cummings, Maxwell, Gadd, Kuznia Nays: None. Motion carried. PRESENTATIONS III. 1. First Quarter 2015 Financial and Investment Report Finance Director Harkess presented an overview of the 2015 First Quarter Financial and Investment Report. Ms. Harkess reviewed the grants received in the amount of $243,227 for first quarter, General Fund revenues & expenditures, Special Revenue Fund revenues & expenditures, Enterprise Fund revenues & expenditures, cash, investments and interest earnings. Ms. Harkess discussed the upcoming schedule that includes the 2015 Bond sale, Audit Report, ERP/CIP budgets for 2016-2020 and the 2016 budget. Mayor Maxwell asked about the bond rating call process. Ms. Harkess explained that the results th of the call take approximately one week and that the bond sale closing is scheduled for May 5. Council Member Kuznia asked about the union contracts. Assistant City Manager Genellie commented that the Police Officers and Sergeants union have not settled. CONSENT AGENDA Mayor Maxwell asked about Consent Agenda item #7. Assistant City Manager Genellie th explained that the Public Hearing would be scheduled for May 19 and that the Council would have an opportunity to review the application and ask questions of the CenturyLink representative at the Public Hearing. Council Member Cummings asked about the franchise obligations. Mr. Genellie commented that the Cable Commission Attorney has not made a legal recommendation yet but more information would be available before the City Council needs to make a decision. HOPKINS CITY COUNCIL REGULAR MEETING PROCEEDINGS APRIL 21, 2015 Mayor Maxwell asked about Consent Agenda item #11. Finance Director Harkess explained that the revised finance billing collection policy would feature a fixed due date with a 3-day grace period. The policy would be in effect with the May billing and residents will be notified on the billing statement, Hopkins Connections, Hopkins Highlights and City website. Council Member Gadd commented on Consent Agenda item #8 stating that the Overpass Skate Park agreement would include the same rates and hours as the 2012 agreement. MotionSecond by Cummings. by Gadd. Motion carried. V. PUBLIC HEARING 1. Consider Resolution 2015-029 Setting Fees for Special Club Liquor Licenses; (CR 2015-029) City Clerk Domeier gave an overview of the fees and membership numbers for Special Club Liquor Licenses. All the clubs have been informed and city staff has received no feedback since there was no increase for the license holders. Ms. Domeier commented that each year the clubs would need to attest to membership numbers in writing. The resolution would bring the city in compliance with the State of Minnesota. Council Member Cummings asked about the yearly renewal. Ms. Domeier commented that the clubs would need to attest to membership numbers each year as part of the renewal process. Mayor Maxwell opened the public hearing at 7:36 pm. No residents came forward to address the Council. Motion to Approve Resolution 2015-029 a Resolution setting fees for Special Club Liquor Licenses. Ayes: Halverson, Cummings, Maxwell, Gadd, Kuznia Nays: None. Motion carried. NEW BUSINESS VI. 1. First Reading: Ordinance Amending Section 1100 Business and Trade Regulations of the Hopkins City Code; (CR 2015-040) City Clerk Domeier gave an overview of the amendments to the City Code. Ms. Domeier explained that city staff has been reviewing the code and found some uses out-of-date. Ms. Domeier reviewed the proposed licensing amendments. The Police Department has found no issue with discontinuing the licenses. Mayor Maxwell asked about license fees. Ms. Domeier explained that certain businesses could have reduced license fees unless there were other uses that need to be licensed. MotionSecond by Cummings. by Kuznia. Motion to Adopt for first reading Ordinance 2015-1090 Amending Section 1100 Business and Trade Regulation of the Hopkins City Code. Ayes: Halverson, Cummings, Maxwell, Gadd, Kuznia Nays: None. Motion carried. VI. 2. Sidewalk Café Permit Program; (CR 2015-053) Community Development Coordinator Beekman gave an overview of the Sidewalk Café Permit Program. Ms. Beekman explained the goals and policy of the program. The policy would outline the size, placement, hours of operation and maintenance of the Sidewalk Café, insurance requirements and the licensing process. Staff has reached out to area businesses regarding the program. Council Member Cummings asked about the licensing fee and feedback from area businesses. Ms. Beekman explained that the $350 fee was established to cover costs and that the primary concern was the loss of some on-street parking. Ms. Beekman explained that the th program would begin in 2015 from approximately May 1 to October 19. Council Member Gadd asked about the width of the Sidewalk Café. Ms. Beekman explained that regulations require they are no wider than 8 feet. Council Member Halverson asked if the licensing fee includes the parking permit. Ms. Beekman reviewed the components included in the licensing fee. Council HOPKINS CITY COUNCIL REGULAR MEETING PROCEEDINGS APRIL 21, 2015 Member Kuznia asked about the walkways. Ms. Beekman commented that the location of the walkways depends on where the café is located. Mayor Maxwell asked about the length of the permit. Ms. Beekman commented that the Sidewalk Café would be allowed to stay up the entire length of the permit unless it would be necessary to access the right-of-way. Council Member Cummings asked about the approval timeframe for the application. Ms. Beekman anticipates the processing time to be approximately 10 days. Representatives of LTD Brewery and Pub 819 came forward to address the Council. They commented that the Sidewalk Café would increase visibility to the businesses and attract more people to the downtown area. Mayor Maxwell asked about permit process. City Attorney Kozar explained that the program is a license agreement and businesses could make application after approval of the program. Council Member Kuznia commented that the Sidewalk Café Program is an exciting program for Downtown Hopkins. Council Member Gadd commented that it is important that businesses invest in the community. Mayor Maxwell asked about preventing footings from being pounded into the new streets. Public Works Director Stadler commented that could be a provision added into the permitting process. MotionSecond by Gadd. by Kuznia. Motion to Approve Resolution 2015-039 approving the creation of the Sidewalk Café permit program and Resolution 2015-038 Setting Fee for Sidewalk Café Permits. ANNOUNCEMENTS  Free Brush Pick Up: April 20 – April 30.  Free Yard Waste Pick Up: April 27– May 7.  2015 Spring Bulk Drop Off Event for Residential Refuse Customers at Public Works Building on Friday, May 1, 3 to 7 p.m. and Saturday, May 2, 9 a.m. to 4 p.m.  Blake Road Corridor Collaborative Workshop at Blake Middle School, Monday, May 4, 6 to 8 p.m.  Kick Off to Summer Safety Event – Hopkins Fire Station, Saturday, May 9, 10 a.m. to 1 p.m.  Cottageville Park event on Thursday, April 23 at 11 am.  Open Book Meeting on Tuesday, May 5, 5-7 pm.  Hopkins Library will be closed for renovations from May 10-June 2.  City Attorney Kim Kozar will be taking a leave of absence for one year.
