ZONING ORDINANCE AMENDMENT — RETAIL IN INDUSTRIAL DISTRICTS
Proposed Action
Staff recaininends the fQllowing motion: Move to adopt Resolution 15-41, a�proving
Ordinance 15-1094, amending the zoning ordinance re a��he amount of retail in industrial
d�stricts for first readin .
At the Zaning and Planning meeting Mr. McNeil moved and Ms. Wallace-Jackson seconded a
motion to adopt Resolutian RZ15-9, recommending appraval of Qrdina�iee 15-1094, amending
the zoning ord'znance regarding the amount af retail in industrial districts. The mation was
appraved unanimously.
Overview
The zoning ordinance aIlows up to 10 percent of an industrial building to be a retail use as a
permitted use and up to 25 percent with a conditional use per�nit. A building with a single use
with a square footage of 400,(?00 could have 40,Ofl0 squar� feet af retail as a permitted use. If
an industrial building is a multi-tenant building, e�ch tenant can have 10 percent of their use as
retail. What the �roposed arnendment wilI do is allow a tenan� to have a�arger retail �zse but
still lixni� the averall retail use for the entire buiIding.

The proposed ordinance would allow flexibility far the �roperty owner of having rnore than 10
percent of their square footage of retail for one or more tenants rn a multi-tenant building.
What was tne discussion at the Zoning and Planning meeting?
Ms. Anderson reviewed the praposed ordir�ance amendments. No one appeared at the public
hearing.
Alternatives
1. Approve the proposed amendments to the zonrng ordinance. By approving the anaendments
to the zoning ordinance, the zoning amendment wi11 be amended.
2. Deny the proposed arnendrnents to the zaning ordinance. By denying of the amendments to
the zoning ordinance, the zoning ordinance will not be amended. If the City Gouncil
cansiders this alternative, findings will have to be identified that support this alternative.
3. Continue for further information. If the City Council inc�icates that further rnformation is
needed, the item should be continued.

RESOLUTION MAKING FINDINGS OF FACT AND APPROVING
A ZONING AMENDMENT TC) THE INDUSTRIAL DISTRICTS
WHEREAS, an application far Zoning Amendment ZN15-b has been made by Hopkins
Mainstreet I1, LLC;
WHEREA�, the procedural history of the application is as follows:
1. That an application for a zoning ordinance amendment was rnade by Hop�kins
1'Vlainstreet II, LLC, on March 27, 2015;
2. That the Hopkins Zoning and Plar�ing Commission published notice, held a
public hearing on the applicatian and reviewed such application on April 28,
2015: all persons present were given an opportunity to be heard; and,
3. That the written cornrnents and analysis of City staff were consic3ered.
NOW, THEREFORE, BE IT RESQLVED that the application for Zaning Amendment ZN 15-6
is hereby approved based on the following Findings of Fact:
l. That the Zonin� and Planning Comrnission reviewed the proposed
ordinance.
2. That it was detennined that an amendment for �he arrxount of retail in the
industr�al zoning district was appropriate.
3. That the proposed arnendment will not increase the arnount of retail in the
industrial district.

THE COUNCIL OF THE CITY O�" HOPKINS DOES HEREBY ORDAIN AS
FOLLOWS:
That the Hopkins Zoning Ordinance No. 540.05 is the same and is hereby amended by adding
the following underlined language, which reads as follows:
