2-1-1977 CC A regular meeting of the Council of the City of Hopkins, Minnesota, was held on Tuesday, February 1, 1977, at 7:30 p.m. , in the Council Chambers in the City Hall. 1111 Present were Mayor Miller, Councilmen McDonald, Milbert, Pokorny, and Slaton, also City Manager Cotton, Assistant Engineer Anderson, Operations Director Beecher, Building Inspector Kohnen, City Planner Hawks, and City Attorney Vesely. Absent: City Engineer Strojan. Reel 210 Dr. Slaton moved, and Mr. Milbert seconded the motion, that the two items Side 1 under the CONSENT CALENDAR, be approved: 97- 1. Minutes of the January 18, 1977, Council meeting and Minutes of the Special Meeting of Monday, January 24, 1977. 2. Additional 1977 misc. license applications. ( See list attached) A poll of the vote was as follows: Mr. McDonald, yea; Mr. Milbert, yea; Dr. Slaton, yea; Mr. Pokorny, yea; and Mayor Miller, yea. Motion carried unanimously. * * * * * * * * * * * * * * * Action: Mr. Pokorny moved, and Mr. McDonald seconded the motion, that the expenditures -120 dated February 1, 1977, under Warrant No. 496, in the amount of $84,949.47, be approved and authorized for payment. HEARING: Continuation of Public Hearing on Zoning Ordinance from the meeting of January 18, 1977. Action: Dr. Slaton moved, and Mr. Pokorny seconded the motion, that we change the 120- Nursing Home description as outlined in the third paragraph of Mr. Hawks's memo. (see attached) After considerable discussion re this motion with regards to the proper wording; Action: Dr . Slaton and Mr. Pokorny agreed to withdraw their motion and second. Action: Mr. McDonald moved, and Dr. Slaton seconded the motion, to approve the rewording of Paragraph No. 1, in Mr. Hawks' memo to change the wording of wholesaling to the word "sales". (see memo attached) A poll of the vote was as follows: Mr. McDonald, yea; Mr. Milbert, yea; Dr. Slaton, yea; Mr. Pokorny, yea; and Mayor Miller, yea. Motion carried unanimously. Action: Mr. McDonald moved, and Mr. Milbert seconded the motion, to approve Paragraph No.2, iiii of Mr. Hawks' memo and include this item re Nurseries, landscape and garden supply sales, etc., as an addition in the "I-District" Conditional Use section 269.39. Action: Mr. McDonald moved, and Dr. Slaton seconded the motion, that Ordinance No. 77-427, -554 (269)"AN ORDINANCE AMENDING HOPKINS ORDINANCE NO. 269, WHICH ORDINANCE IS KNOWN AS AN ORDINANCE RELATING TO AND ESTABLISHING A COMPREHENSIVE ZONING PLAN AND REVISED ZONING MAP FOR THE CITY OF HOPKINS AND WHICH ORDINANCE IS CITED AND RE- FERRED TO AS THE 'HOPKINS ZONING ORDINANCE'", be accepted for the second reading thereof and according to law same to be ordered published. Mr. Milbert moved, and Dr. Slaton, seconded the motion, that the City 659-714 Attorney be instructed to draw the proper resolution to acquire the following property: Lots 10, 11 and 12 and Lots 23, 24 and 25, Block 5, West Minneapolis, for the purpose of constructing a Downtown City Park, as recommended by the Park Board, the Community Development Citizen's Advisory Commission and the Zoning and Planning Commission. Miller, Mayor i February 1, 1977 • • MEMO To: Council From: Jim Hawks Now that the Zoning Ordinance appears to be a certainty, a number of individuals are reviewing it in detail and bringing up some situations worthy of consideration. 1. Retail sales and service in the I-District is not listed as a permitted function. Considering that lumber goods, rental, restaurants and other permitted uses always combine retail and discount sales, it is suggested that the word "wholesaling" in the first paragraph, page 31 be changed to "sales". 2. Nurseries, landscape and garden supply sales when all or a portion is outside subject to conditions specified in 269.36 (2) (f) should be considered as an addition in the "I-District" Conditional Use section 41/1 269.39. 3. Nursing Homes, board and care homes which are certified for skilled and intermediate boarding of patient care by the State of Minnesota. Ordinance as now written permits such homes in the R-3, R-4 and R-5 Districts provided the site has 600 sq. ft. for each person to be accomodated (72 per acre) . The old ordinance permits nursing homes in the R-3 District in two story buildings with a density of 800 sq. ft. per person. Also in the R-4 District without a height limit at a density of 300 sq. ft. per person (144 per acre) . R-6 District same as R-5. B-1 District with a density of 600 sq. ft. per person. The question has been raised as to why the increased-density is not in the new ordinance and suggested that it be 600 sq. ft. for 3 story, 500 sq. ft. for 4 and 5 story and 350 sq. ft. for 6 story. Also that nursing homes be permitted in commercial districts. The projected intent of the Planning Commission was to reduce density and this was one method and in keeping with the 2 - 2 story homes we now have. However, the suggested densities of 600 sq. ft. for the R-3 District, 500 sq. ft. for the R-4 and R-5 Districts and 400 for the B-1 District with the height permitted being according to the system now in the ordinance would be in keeping with accepted nursing home operations and closer to the old ordinance provisions but still a reduced density. I don't believe nursing homes would be a compatible use in the B-2, B-3 or B-4 business districts.
