77-2613 At a duly authorized meeting of the City Council of Hopkins Minnesota, the following resolution was moved and adopted: 110 RESOLUTION NO. —77-2613 WHEREAS, Layout No. 16A , Project No. 6706 showing the proposed improvement of County State Aid Highway No. 18 within the limits of the City has been prepared and presented to the City. Craig: Re: County Project 6706 CSAH 18 from 2nd St. No. to Minnehaha Creek Attached is one print copy of Layout No. 16A dated April 29, 1977 of Hennepin County Project 670F, CSAH 18 from 2nd St. No. to Minnehaha Creek. Until recently, a full cloverleaf interchange had been proposed at the junction 111, of CSAH 18 and T.H. 7. This concept was based on the premise that T.H. 7 would be upgraded to freeway standards and would accommodate traffic demands of sufficient magnitude to warrant a full cloverleaf. We have been informed by Mn/DOT that the upgrading of T.H. 7 to freeway standards is no longer being considered. Consequently, T.H. 7 will not be able to accommo- date the traffic volumes anticipated under the freeway concept. The interchange design was re-evaluated, and it was determined that, because of the limited capacity of T.H. 7, a full cloverleaf will not be warranted. The design shown on Layout 16A will provide a level of service "C" . Hennepin County and Mn/DOT staffs have approved this layout. We are requesting your review and City Council approval of the Layout and their authorization to proceed with right of way acquisition based on this layout. The description of the land to be included in the offer should be revised to describe the land outlined in red on the plot plan attached hereto; it being understood that the total acreage included in the offer will not in any way be reduced. 2. The undersigned should receive assurances from the City of Hopkins, Minnesota, in form and substance reasonably acceptable to the undersigned, that when and if the land outlined in green on the attached plot plan is developed for residential purposes, at least 280 dwelling units may be constructed thereon under the,then existing laws of the City of Hopkins, Minnesota. 3. Creviers First Addition also known as SW corner of 14th Avenue & 5th Street South. Request: Conditional Use Permit approval for "mining" and "land reclamation". STAFF FINDINGS AND COMMENTS: 1. Mining is defined under Section 427.04-70 as "the extraction and removal of materials from the land in the amount of more than 400 cubic yards". As requested by Mr. Barber, he desires to remove the substandard soil from an area approximately 250' x 125' or 31,250 sq. ft. 400 cubic yards would equal a layer of earth 4" deep. 2. Substandard soil in an industrial district is assumed to be soil with a poor bearing quality for a structure and in the case of peat might be as deep as 30 to 40 feet. Evidence should be submitted relative to soil conditions and a statement as to what is intended to be accomplished. 3. In addition to mining, Mr. Barber intends to fill the void created with granular material which under the ordinance is Land Reclamation. Section 427.04-56 "Depositing of 400 cu. yds. or more of earth material so as to elevate the grade". 4. In addition to the above consideration - most of Mr. Barber's land is within the Flood Plain District which requires that a certain storage capacity for surface water is to be accomodated if a permit to adjust grades is approved. 5. The flood plain line as drawn on the zoning map was located from the best topography data available to the city, thus, it would appear that the first step Mr. Barber should take is to furnish precise topographic data for his land which in turn can be used to varify the flood plain line. Having this information and assuming some of the land is within the flood plain district, a development plan should be made in conformance with Section 427.41. Having said plan with a structure needing a particular foundation shape - the right to mine and fill to fulfill a plan is a part of the Conditional Use Permit. 6. However, to approve a mining operation which does not relate to a plan would be approving a black dirt operation and a landfill. 7. Creviers First Addition - Hopkins Dear Mr. Barber: • The Board of Managers of the Nine Mile Creek Watershed District has reviewed the plan and grading and land alteration permit application dated August 15, 1977, as submitted to the District for the above referenced project. The Managers find that the proposed project is in general conform- 411 ance with the policies set forth by the Watershed District and, therefore, approve of the grading and land alteration permits subject to the following conditions: • 1. The District will require that all backfilled material • be placed and graded in such a manner as to not change the existing topography of these lots. It is essential that the area below the 896 elevation remain at/or be placed back the same, as existing conditions for purposes of 100-year flood storage. 2. The District will require that the proposed hay bales, as . shown on the plan, be installed prior to the commencement of land alteration. These bales must remain in place and . be properly maintained until all altered areas on the site • have been restored. • 3. COMMENTS AND FINDINGS: 1. The property is zoned I-1 and an office is a permitted use. The reason for the request is that Modern Merchandising intends to remodel its computer center and is in need of a location close by for the existing operation. 2. The reality of the request relates primarily to the application of the Building Code which can not be varied by City action. However, if the Planning Commission and Council approves the 90 day Conditional Use Permit it is possible for the trailer to locate on the site during the construction period. 3. The applicant has not furnished the City with data as to size, power source, location, method of heat, number of employees to occupy, trailer appearance. S
