12-28-1977 Special meeting of the Council of the City of Hopkins, Minnesota, on the subject of the Southwest Hopkins Industrial District Tax Increment Program, held on Wednesday, December 28, 1977, at 7:30 p.m., in the Council Chambers in the City Hall. Present were Mayor Pro Tem Milbert, Councilmen McDonald, Slaton and Lohmann, also City Manager Craig, City Clerk Richardson, City Engineer Strojan, Community Development Officer Kerrigan and City Attorney Vesely. Reel 130 At this time in the meeting the Council adjourned temporarily while the Side 1 Commissioners of the Hopkins Housing & Redevelopment Authority discussed the subject matter. * * * * * * * * * * * Mr. McDonald: Mr. Mayor, may I ask a question? Is there an Agenda for this meeting? Mayor Milbert: I do not see one - At the moment Mr. McDonald I do not see an Agenda. Mt. MCDonald: I don't find an Agenda at my place nor have I received one. Mayor Milbert: The information placed before us was placed here when we arrived in the roan, which was about 7:30. Mr. Craig: This is a single item only and is placed here for your consideration. • Mr. McDonald: And there is no Agenda? Mr. Craig: No sir, there is no Agenda. Mr. McDonald: Mr. Mayor, may I ask that notice of this meeting was duly given to the citizens of Hopkins? Mayor Milbert: A question to the Manager - to my knowledge it was published. Mr. Craig: Yes it was published in the paper and furthermore was carried on the front page of the SUN last week, and was announced at the last Council mooting publicly. Mr. McDonald: Mr. Mayor, may I ask how much of the information we found waiting for us here tonight at 7:30 was published in the Hopkins SUN or any other notice of general circulation? Mayor Milbert: I'll have to ask the City Manager, Mr. Craig? Mr. Craig: Title only, that is the reason for the mooting tonight is the scheduling of • a Public Hearing and notice of the Public Hearing was sent to the residents of that area. Mr. McDonald: Mr. Mayor - Mayor Milbert: Yes, Mr. McDonald - Mr. McDonald: I want to say it once again for the record that I have been told that there is no Agenda for this meeting for tonight and the substance of the meeting and the subject to be discussed and the purpose of the meeting and possible outcome of the mooting was not given general notice to the citizens of Hopkins. I would like to offer a motion, the people of the Council have before them a copy of 3 pages and captioned "City of Hopkins, Resolu- tion No. 77-2647. I would like to make a motion based upon this typed copy. My motion is that - the Resolution to be numbered 77-2647, reading as follows: be adopted by the City Council of the City of Hopkins on this date December 28, 1977, "WHEREAS, it has been the intent and desire of the City of Hopkins to improve conditions in the City of Hopkins; NOW 1/1 THEREFORE, the City Council of the City of Hopkins, Minnesota does hereby make the following finding and determination that the City Clerk is hereby directed to maintain on file a copy of the South Hopkins Industrial Develop- ment Program as submitted this day, together with written opinion of the Planning Commission and the findings and determinations and resolutions of the authorities quoted herein, dated December 28, 1977, passed and adopted 6 * • I Mr. McDonald, cont. by the Council of the City of Hopkins, Minnesota at a special meeting held on the 28th day of December 1977. Mayor Milbert: You say - 111 Mr. McDonald: That's my motion. Mr. Luhmann: I'd like to have you read it a little slower Bob so I can - Mr. McDonald: One more time - well, you've all had the same opportunity that I have with this material at 7:30 tonight. Mr. Lohmann: You're reading frau it and I can't follow what pages you're reading as you go along. Mr. McDonald: You have before you 3 pages of typewritten copy - the caption on Page 1, is "City of Hopkins, Resolution No. 77-2647 - I move that this Council adopt a resolution to read as follows, which you will be helped to follow by reference to these 3 pages and I'll be specific as to location of sae language that I have found here. If you will look at the first paragraph on Page 1 of the 3 pages - this is what the resolution would contain according to my motion - WHEREAS, it has been the intent and desire of the City of Hopkins to improve conditions in the City of Hopkins —then turn to Page 2, and counting the first paragraph beginning - WHEREAS, paragraph 1, counting 1,2,3 and the 4th paragraph which begins, NOW THEREFORE, I would include in the Resolution I moved to be passed, - NOW THEREFORE, the City Council of the City of Hopkins, Minnesota does hereby and make the following finding, singular, and determination, sing- ular: and turn to Page 3, and in the paragraph reading down you find en- umerated 7, 8 A & B. I am looking at this paragraph indexed capital B., which I don't find necessary as part of the resolution I am moving - That the City Clerk is hereby directed to maintain on file a copy of the, and I'll put quotes on it this time to help you, "South Hopkins Industrial Development Program", as submitted this day, together with the written opinion of the Planning Commission and the findings and determinations and resolutions of the Authority, and as a side not there, I am not able to comprehend just what that means but I have no objection to having it in this Resolution, of the Authority dated December 28 , 1977, - and then at the bottom of that 3rd page, presumably to put a culmination on this kind of thing, passed and adopted by the Council of the City of Hopkins, 411 Minnesota at a special meeting held on the 28th day of December 1977. Mayor Milbert: Does everyone follow the motion? All: Yes, we've got it now. Mr. Lohmann: Mr. Mayor for purposes of discussion, I will second the motion so we can bring it on the floor and have it be heard. If Mr. McDonald wishes to speak about his motion - Mr. McDonald:I can make scan further comment, I have an awful lot to say and I would hope it would not be necessary to say that any reasonable citizen would have to say about this kind of business, but I would point out that on those 3 pages from which I have taken some text to form a resolution to be passed by motion of this Council I find nothing else on those 3 pages which I consider this Council to be sufficiently informed about to take any action. Mayor Milbert: Any other comments fram either of you other gentlemen? Dr. Slaton: The question then would be if we passed this abreviated resolution by making 4IP reference to the opinions of the Planning Commission and the HRA will this suffice in the legal standpoint of view? Perhaps we should ask Mr. Vesely. By abreviating this resolution and leaving out specifics, but referring to the opinion of the HRA and Planning Commission, will this resolution suff ice for our purposes? Mr. Vesely: I gathered from his reading ;of the portions he included in his motion, I gathered what he is doing is authorizing certain portions period,which at this time would suffice. If you don't know anything about it all you can do file it. O R'1r. Craig: If I may speak to the issue this has nothing to do with the filing with the County which is the necessary item which was to be addressed prior to the end of week. Mr. Lohmann: The filing does not implement the program? Mr. Craig: No it does not give you any status program as of 1977. Mr. McDonald: Mr. Mayor, I find nothing here of any reference of any kind of filing with the County I simply do not understand that business. Mayor Milbert: The motion is to file with our Clerk? Mr. McDonald: My motion is to file with the Clerk what information is of value here. Mr. Lohmann: I see Mr. McDonald's point well taken and I see nothing in the resolution that originally proposed this piece of filing with the County. Mr. Craig: That's what we do with it though. The resolution itself is the document • that ends up at the County. TO explain this I can display the work on the CBD and this is the fashion in which it was prepared. Mr. Lohmann: Don't look at me and say that as I haven't been, and that's why I'm getting fascinated as to what's going on here. Because I don't see that here. Mr. Craig: Tb capsule this - it is shown in this example - CBD north has a submission and this is what is necessary for the County to take your District and raise the values and cause the machinery to begin as a tax increment district under the law of the State. Mr. Lohmann: When you say "freeze the values" it means in effect the taxpayers won't have any increase in their tax requirements. Mr. Craig: No, it freezes the level of taxation which is returned to the several units of government and the proportion which is established. In other words, at the present time the City of Hopkins gets 19 on the dollar and would con- tinue to get 19< on the dollar for the dollar amount currently being paid in that area. Any increase would be principally due to new investment, new construction and in it's entirty would be conveyed to a special account kept by the City of Hopkins that would be the increment, the amount of taxation • received and that is what pays off the expenses which would be necessary to adequately compensate the owner of the property, or let's say what would be an industrial price for their land. Mr. Lohmann: But the present owners until the property is acquired in one fashion or another would possibly increase taxes if the taxes went up in the County? Mr. Craig: Anybody in the District - no,their taxes are going to be just like anybody elses taxes. If the property value goes up may not necessairly mean theres more tax. Reel 130 At this time in the meeting the Council adjourned temporarily while the Side 1 Commissioners of the Hopkins Housing & Redevelopment Authority met to 5- discuss this subject. * * * * * * * * * Action: Mr. McDonald moved, that Resolution No. 77-2647 reading as follows, be adopted: "RESOLUTION SETTING FORTH FINDINGS AND DETERMINATIONS BY, AND RESOLUTIONS OF, THE CITY COUNCIL OF THE CITY OF HOPKINS, MINNESOTA RELATIVE TO AND APPROVING A PROGRAM FOR REDEVELOPMENT OF THE SOUTH HOPKINS INDUSTRIAL AREA IN HOPKINS, MINNESOTA, ENTITLED 'SOUTH HOPKINS INDUSTRIAL REDEVELOPMENT PROGRAM"', on this date of December 28, 1977 Wim, it has been the intent and desire of the City of Hopkins to improve conditions in the City of Hopkins; NOW THEREFORE, the City Council of the City of Hopkins, Minnesota does hereby make the following finding and determination that the City Clerk • is hereby directed to maintain on file a copy of the South Hopkins Industrial Development Program as submitted this day, together with written opinion of the Planning Commission and the findings and determinations and resolutions of the authorities quoted herein, dated December 28, 1977, passed and adopted by the Council of the City of Hopkins, Minnesota at a special mooting held on the 28th day of December 1977. Action: Mr. Lohmann seconded the above motion for purposes of discussion. Action: After considerable discussion Mr. Lohmann moved to amend and postpone Resolution No. 77-2647, to the January 17, 1978, Council meeting. Notion lost for lack of a second. Action: Dr. Slaton moved, and Mr. Lohmann seconded the motion, to table this Resolution to the Council meeting of January 17, 1978. A poll of the vote was as follows: Mr. McDonald, yea; Dr. Slaton, yea; Mr. Lohmann, yea; and Mayor Nilbert, yea. motion carried unanimously.
