75-409 iCITY OF HOPKINS HENNEPIN COUNTY, MINNESOTA ORDINANCE NO. 75-409 AN ORDINANCE ESTABLISHING WATER AND SANITARY SEWER RATES AND CHARGES AND REPEALING ORDINANCE NO. 333 AND ALL THE PROVISIONS OF AND CONTAINED IN SECTIONS 520:00, 520:05, 520:10, 520:20 and 520:25 OF THE 1970 AND THE 1973 CODES OF ORDINANCES OF THE CITY OF HOPKINS BE IT ORDAINED by the Council of the City of Hopkins as follows: That Sections 520:00, 520:05, 520:10, 520:20 and 520:25 of the 1970 Code of Ordinances and of the 1973 Code of Ordinances of the City of Hopkins be and the same are hereby amended as follows: . Section 520:00. DEFINITIONS. For the purpose of this Ordinance, the following words shall have the following meanings: Subdivision 1. Residential shall mean and include single family dwellings or duplex or a double bungalow or apartment building or complex or condominium. Subdivision 2. Commercial shall mean and include any and every other kind Of structure, building, occupancy, use or endeavor except residential as hereinabove defined. Subdivision 3. Gross, when applied to any service, billing or charge, shall mean that amount payable before the allowance of any discount therefrom, and shall be determined or calculated by adding to the net water and sewer charges the sum equal to 5% thereof. Subdivision 4. Net, when applied to any billing or charge shall mean that sum payable after allowance of any discount, which net shall be the amount derived by dividing the total gross charge for such service by 1.05. 411 Subdivision 5. Discount is the amount derived by subtracting the net from the gross billing. Section 520:10. WATER RATS. The gross rates per water meter shall be $.05 per each 100 gallons plus 5% thereof. Page 2 The number of gallons of city water furnished from time to time shall • be determined by water meter readings, and if any such water is used on premises without a proper water meter or whenever such meter is out of order, the amount of water used at such interval shall be determined either by averaging previous water bills at such location with the same or similar use, or by the average amount of water consumed at other premises during a similar interval with a similar use or business. Any and all meters may be read by officials of the Hopkins Water Department either every month or every quarter, but where such readings are monthly, the gross rates as above set forth shall be calculated and applied as though such meters were read quarterly. Section 520:10. SANITARY SEWER SERVICE CONNECTIONS. Every city water meter shall be deemed, for the purpose of this Ordinance, to be a sanitary sewer service connection unless such meter is located in premises not connected to the city sanitary sewer system. Wherever premises are con- nected to the sanitary sewer system but are served entirely from a private water source, such premises shall be liable for and subject to the same charges for sanitary sewer service as though the premises were served with metered city water, and the city may require the installation of water meters on any private well and pump, which meter shall be subject to and governed by the same rules, regulations and ordinances as meters for city water. • Section 520:20. SANITARY SEWER SERVICE CHARGES AND RATES. Subdivision 1. Sanitary Sewer Service Rates and Charges for Residential Customers. The gross sanitary sewer service charge for residential customers shall be the sum equal to 120% of the net water charges plus 5% of such sewer charge, provided that in arriving at such monthly water consumption for any single family residential customers, such sewer use and charge shall be determined by using the amount of such water consumed in such single family dwelling in the annual quarters ending in January, February or March of each year divided by three; provided further that in cases of new con- struction or addition to any residential unit, the average water consumption is to be determined by the first thirty day period following its completion or occupancy until the next ensuing quarter ending in January, February or March. Whenever such average water is used in any such single family dwellings during the quarters ending in January, February or March may be unfairly disproportionate because of the customer's methods or lack of operation or any other reason, then and in that event the City of Hopkins shall estab- lish an average water charge and corresponding sanitary sewer charge by the use of suitable methods which will be as fair as pos- • sible, such determination by the City of Hopkins to be final. Subdivision 3. Sanitary Sewer Service Rates for Commercial Customers. Sanitary sewer service charges for all commercial custo- mers shall be equal to 120% of the net water billing plus 5% of such sewer charge.
