PETITION TO CORRECT AND ANIEND
CERTAIN SPECIAL ASSESSMENTS
HERETOFORE LEVIED PURSUANT T0
HOPKINS RESOLUTION N0. 1218
TO THE COUNCIL OF TI-iE CITY OF HOPKiNS:
N]�IEREAS, The Lmdersigned is the sole awner of Lots l, 2, 3, 4, and
5, Block 2, L. P. Crevier's First Addition to West Minneapolis, situated in the
City of Hopkins, Hennepin County, Minnesota; and,
WHEREAS, The City of Hopkins caused to be constructed certain public
sanitary sewer and water mains along Fifth Street South between llth and 16th
Avenues South, said irrq�rovements having been designed as trunk sewer and water
lines, and having been specially assessed on an area basis pursuant to Hopkins
Resolution No. 1218; and,
Wf�REAS, Said Fifth Street South is an East-West thoroughfare ,and
abuts upon and runs pa�rallel to the North sid.e yard of saia Lot l, Block 2,
L. P. Crevier's First Addition to West Minneapolis; and,
WI-�REAS, No p�r.t -; of` 14th Avenue or 15th Avenue South between
Fifth and Sixth Streets South has ever been built, improved or used as a public
thoroughfare, and no public sewer or water ma.ins have been installed in any part
of said l4th Avenue South in said L. P. Crevier's First Addition to West Minneapolis
or in the North-South alley in said Block 2; and,
WHEREAS, The public sewer and water mains as constructed along said
part of T'ifth Street South can be used as lateral sewer and water mains with a
direct connection from said Fifth Street South into the premises owned by the
Petitioner herein as hereinabove described; and,
WHEREAS, Except for an area specially assessed in connection with said
sewer and water improvements as above set forth, no part of the premises owned
by this Petitioner were ever assessed for the benefits derived by this Petitioner's
premises by reason of the use thereof as lateral utility pipes; and,
WI�REAS, This Petitionex is desirous now of obtaining a permit to con-
nect a contemplated structure to be erected upon said Lots 1, 2, 3, 4 and 5, Block 2,
L. P. Crevier's First Addition to West Minneapolis, and in connection therewith
to connect such structure to both water and sanitary sewer mains located in that
part of said Fifth Street South which abuts upon Lot l, Block 2, L. P. Crevier's
First Addition to West Minneapolis; and,
tNHEREAS, The cost on a front foot basis for the installation of lateral
sewer and water ma.ins at the time such mains were installed in 1962 in said part
of Fifth Street South, abutting upon said Lot l, Block 2, would and should have
been as follows:
Sewer: 163 feet by �13.370759 per foot equals $2,179.43
Water: 163 feet by $10.644776 per foot ec{uals $1,735,19 -
TOTAL: $3,914.53
NOW, THEREFORE, I, the tmdersigned, being the sole owner o£ Lots 1,
2, 3, 4, and 5, Block 2, L. P. Crevier's First Addition to West M�.nneapolis, the
Northerly boundary line o£ said Lot 1 abutting upon the water and`sewer lines in-
stalled and erected in 1962 along Fift,h Street South do hereby Petition that you
do as follows:

l. Amend Hopkins Resolution No. 1218 dated September 3, 1963 by
� adopting, spreading and levying as special assessments against a11 of said Lots
hereinabove described owned by this Petitioner the following amoi.mts for the
following purposes:
Sanitary Sewer: $2,179.43
Water: $1,735.10 `
Total: �"3,�4;53
said special assessment to be divided eaually among said five lots hereina.bove
set forth, and to be and become a lien upon said Lots and to be paid in seven annual
installments of $559,22 each plus interest thereon at the rate of seven percent
per annwn, the first such installment to be due and payahle in the year of 1976
and paid concurrently with the real estate taxes pertaining to said Lots.
2. The Petitioner further hereby agrees that if at any time in the
future there should be constructed lateral water or sewer mains to abut upon any
or all of said Lots hereinabove described, the proportional cost of any such in-
stallments may be specially assessed and levied against any of the Lots hereinabove
set forth abutting thereor� providing that in such eventuality, the swn hereinabove
set forth now to be levied and assessed for such irrq�rovements are then credited
against and upon any such futtzre levy and special assessment for said purposes.
3. Petitioner hereby further waives any and all notices, hearings, and
other Statutory reQuirements in connection with the above amendment to said
levy and special assessments, an.d urges the City Council of the City of Hopkins
to pass and appropriate the Resolution necessary for the amendment of Resolution
No. 1218 and the adoption of the levy and special assessment against said five
lots hereinabove described pursuant hereto.
