A RESOLUTION ORDERING ABATII�IENT OF
NiJISANCE BY REMOVING CERTAIN
INFECTED ELM AND/OR OAK TREES
ON/OR IN BLOCKS 1 AND 2, DAVISON'S
ADDITION TO WEST MINNEAPOLIS
WHEREAS, Pursuant to City of Hopkins Ordinance No. 73-382, and pursuant
to M.S.A. Chapter 18, and pursuant to Chapter 4, Rules and Regulations of the De-
partment of Agriculture (AGR 101-120) , the forester of the City of Hopkins has found
conditions indicating the presence of Dutch elm or oak wilt infestation exist and
have existed upon Blocks 1 and 2, Davison's Addition to West Minneapolis, and has
delivered appropriate specimens or sa�les thereof to the CorrQnissioner of Agricultuxe
for analysis; and,
Wf-IE?2EAS, Such analysis has confirmed the findings of said forester; and,
Wf-IEREAS, Notice of such findings has been given to the owners of record
of the premises; and,
Wf-IEREAS, No pa�t of said infected trees has been removed or otherwise
treated.
NOW, THEREFORE, It is hereby Resolved by the City Co�cil of the City of
Hopkins as follaws:
That the premises of said infected trees, which are twenty-four in number
and have been an� are duly marked and are located upon Blocks 1 and 2, Davison's
Addition to West Minneapolis, constitute a public nuisance as more fully set forth
in the provisions of Hopkins Ordinance No. 73-382, M.S.A. G'hapter 18, and Rules and
Regulations of the Department of Agriculture (AGR 101-120) , and such nuisances. are
l�ereby� o�dered to be immediately abated by the cutting and removal of all such in-
fected trees thereon.
It is further ordered that a Notice of the intention o.f the Council so to
abate said nuisance shall be published once and a copy thereof mailed to the
affected property owners, which Notice shall specify that action upon this Resolu-
tion shall be taken at a special public meeting of the City Council to be held on
Juaa� 3, ,1975, such publication to be not less than one week prior to the date of
such meeting.
The CoLmcil at such meetin� sha11 hear all property owners with reference
to the above matter. It is further Resolved that a copy of this Resolution shall
be mailed irrnnediately to the owners of the property involved herein.
Passed and adopted at a regular meeting of the Hopkins City Cotm.cil held
May 20, 1975.
