.�ul 29 2015 � Council Re ort 15-87 Y � p SITE PLAN REVIEW — TACO BELL Pronosed Action Staff recommends the followin� motion: Adopt Resolution 15-56, approvin� a site pian to canstruct a T�co Bell at 919 Cambridge Street. At the Zonii�� and Planning meetz�ng, Mr. Tait moved and Mr. McNeil seconded a motion to adopt Resolution RZ15-15, recammending approval of a site plan ta construct a Taco Bell at 919 Carrabridge Street. The motion was approved unanimou�ly. Overview The applicant, Border Foods, is proposing to constaruct a i�ew Taco Bel] restaurant at 919 Cambridge Street. 919 Cambridge Street is the former site of Lindee`s Saloon. The existing vacant building will be razed and a new Taco Bell restaurant will be cp�skructed. The new building will be located on the west side af the site. The applicant has also applied for a conditional use permit. A conditiona� use permit is required for a fast food restaurant. The existing Taco Bel� will remain until the new Taco Bell is constructed. At this time it is not known what will be constructed an the old Tacc� Bell site. The zoning af the property is B-3, General Business. The Cornprehensive Plan has designated this slte as Corrtrr�ercial. The proposed use complies with the zoning and C�mprehensive Plan. What are the specifics of the redevelopment? Building The buiiding will be situated on the we�t side af the site, with the drive-thro�gh on the west side of the buildin�. The drive-ihrough lane will have stackin� space far 11 vehicles. The plac�ment of the building wi11 provide a lang drive-through waiting lar�e. The build�ng will alsa have a covered patio with a frepIace on the north side of the building. The building will have a par�pet to screen the mechanicals on the roof. The east side of the building wi�l have a mural, Exterior The exterior will be of various surfaces. The exteriar will consist of fiber ceinent panels, bricic, fiber cement board and trim and metal paneis. T�le colar will be a variety of browns and grays. ParkinglAccess Access to the site will be from Cambrid�e Street. The parking area will be located on the east side of the site. Tl�e plan indicates 62 parking spaces. The site reguires 39 parking spaces. Landscaping The si�e is required to have 17 trees of the required size. The landscape plan indicates l 7 trees of the required size. There is also a variety c�f ornamental trees, deciduous and evergreen shrubs, and perennials and grasses surrounding the site. Sidewalk There is a sidewalk along Cambridge Street on the south side. This sidew�lk will remain. A sign p�r�r�it will be required for all signage. En�ineering The engineering comrzlents are as follows: • The flarc;d end sectii�n and riprap at the SE corner of the site sh.ould be shifted ta make sure they are outside of the Cambridge Street right-of-way. • The biofiltration basin at the SW carner of the site must not encroach into thE right-of-way. • The boulevard grade behind the curb along Cambridge Street should not exceed 2°l0. • The applicant will be responsibie for restoration of impacts to Carnbridge Street. Pavement must be restoxed to the City standard section. Lift Station There is a l�ft station that serves the current Taco Bell and for�ner Lindee's site. The applicant wi�l take over the respansibility for this lift statian. Fire Marshal The Fire Marshal has reviewed the preliminary plans. He has found them acceptable. Tras� The trash wi11 be loc.ated within the bui�ding o�� the sauth side. Lighting The parking area will be lit with two poles in the center parking area. There will be three sr`ngle poles for the drive-thnx lane, and the building will have gooseneck lights. Surrounding Uses The site is surroundcd by Highway 7 to the north, commercial to the east and west and a wetland to the south. • What is the a�Plicant's time line? Tlie applicant is planning to start construction as soan as passible. CR15-$7 Page 4 • What was the discussion at the Zoning and Planning meeting? Ms. Anderson reviewed the proposed new Taco Bell restaurant. Barb Schneider, representing Taco Bell, and Dean Madson, the architect, appeared before the Commission. Ms. Schneider reviewed the site plan with the Commission. Ms. Schneider stated that they modeled the flow of the site from the Golden Valley restaurant, and at that location they get small service vehicles and they expect these vehicles at this location. Mr. Madson reviewed the proposed Taco Bell restaurant exteriors r�vith the Caminissian. t�10 o�e appeared at the public meeting regarding this issue. Alternatives i. Approval the site plara ta construct a Taco Bel� at 9l 9 Cambridge Street. By approving the site plan, the applicant will be able to construct the building as proposed. 2. D�ny the site plan to construct a Taco BeII at 919 Cambridge Street. By denyiz�g the site plan, the applicant wilI not be able to construct the building as proposed. If the City Council considers this alternative, findings will have to be identified that support this alternative. 3. Continue for further information. If the City Council indicates that further information is needed, the item should be continued. CITY OF HOPKINS HENNEPIN COUNTY, MINNESOTA RESOLUTION 2015-56 RESOLUTION MAKING FINDINGS OF FACT AND APPROVING A SITE PLAN TO CONSTRUCT A TACO BELL RESTAURANT AT 919 CAMBRIDGE STREET WHEREAS, an application for Site Plan approval SPR15-4 has been made by Border Foods; WHEREAS, the procedural history of the application is as follows: 1. That an application for Site Plan approval was made by Border Foods, on June 25, 2015; 2. That the applicant has submitted, for the review and approval of the City the site plan drafted by Marvin Devolopment IV, LLC; and dated 6-24-15 (herein the “Site Plan”); 3. That the Hopkins Zoning and Planning Commission, pursuant to mailed and published notice, held a public hearing on the application and reviewed such application on July 28, 2015: all persons present were given an opportunity to be heard; 4. That the written comments and analysis of City staff were considered; and, 5. A legal description of the subject property is as follows: Tracts A and D, Registered Land Survey No. 1250, Hennepin County Minnesota NOW, THEREFORE, BE IT RESOLVED that the application for Site Plan approval SPR15-4 is hereby approved based on the following Findings of Fact: 1.That the Planning Commission reviewed the proposed building and has recommended approval of the Site Plan. 2.That the Site Plan and meets the requirements for site plan approval if the conditions below are met to the satisfaction of the City. 3.That the existing use is in compliance with the Comprehensive Plan. 4.That the existing use is in compliance with the B-3 zoning. BE IT FURTHER RESOLVED that application for Site Plan approval SPR15-4 is hereby approved subject to the following conditions that shall be met, to the satisfaction of the City, prior to the issuance of any permits, unless otherwise expressly provide for below: 1.That the application and Sit Plan is subject to the review and approval of the watershed district. 2.The final drainage, drainage and utility plans are subject to the review and approval of the City Engineer. 3.Based on the applicant’s intended use of the property and anticipated water and sanitary sewer usage, prior to the City’s issuance of a Certificate of Occupancy for the property, the applicant shall: (i) enter into an agreement, subject to the review and approval of the City, with the owner of the adjacent property located at 819 Cambridge Street, to share both the use of the lift station which serves both the 819 and 919 Cambridge Street properties, as well as the maintenance obligations for such lift station; (ii) said agreement shall be recorded against the property records of both properties; and (iii) execute any other documents reasonably required by the City for both properties to maintain the lift station. 4.Use of the subject property shall, at all time, comply with local, state and federal rules and regulations.
