1. The applicant is proposing to build a ten unit townhouse devel'~ent on 9th

2. The proposed townhouses will b~ on Lots 3 thru S. In July 1980 the applica~t
applied and wa~ granted approval of the plat on lots 2 thru 5< The applit.;,.tlt
replatted these lots on the recommendation from the Commission on February 25,
1980. The CornmissiO!. rccorrr!l~nded that lots 2 thru 4 be t'~piatted to allow
triplexes and Lot 5 for construction of a dUiJ,1f!y. sti'IJcture (totalling 8 tmHs).
Existing trlplexes are iocatec on lots 1 & 2 of the plat. .
3, The three lots have the required lot area of 12,000 sq. ft. as required by
427.31 for an R-2 district. Ano~:her requireJreot also is 3500 sq. ft. of lot
area pe~ 1 family. The proposed development has required 3500 sq. ft. pEr
family. The lots do not have ti-:~ r'equired lot width. In January 1979 the
.' &p~licant was pennitted to plat Lots 1 thru 5 ~t 92 feet based on a histQrical
agreement between the City and the previous owner for land usage in that area.
Since then the lots have been replatted. The lots which the townhouses are
proposed have an 80.56 width and two lots 96 foot width.
4. The proposed development will have a h'ont yard setback of 38 feet, a rear yard
setback of 69 feet, and s i de!'a.rd setbacks of 12 feet and 516". A variance has
b2en applied for the side yard setbacks. fhe height of the townhouses is 33
feet.
5. The subject property boa;-ders Nine ~1;le Creek and the flood plain consumes a
good part of the propertj. An approvo.d plan from the Ni ne Mi le Creek Watershed
District will be required as \t'el1 as final review by the City Engineer for flood
plain encroachment and drainage.
6. Ordinance 427.31 requires a maximum building coverage of 35% i ~ an R-2 district.
The proposed development has a building coverage of 21%.
The open space ratio in an R-2 district is 1:1.5. The subject site would have
an open space ratio of 1:1.89.
The landscape plan shows planting:; of maple and ash along 9th Avenue and also in

24 feet wide. The applicant has already constn~cted a triplex wi.th an overall
width of 68 feet (with end uni ts at 22 teet wide) on l.ot 1 Uppals Addition

in constructing the sm.':!iler cnd units, inferior units (to what could be ~on-
structed) have been erected. The applicant has claimed the size of the units
as his hardShip for granting a v~riance. It was explained that variances are
granted as a resul t of Uli.i que conditions of .he land and not for the applicants
desire to construct a 1ar.g0.r uni t '.
3. To this date l~e appli~ant has not f.i.l ed a final plat for Uppals Addi. tion and
