Liquor License Request; Domeier CITY OF HOPKINS Memorandum To: Honorable Mayor and Council Members From: Amy Domeier, City Clerk Copy: Mike Mornson, City Manager Date: December 8, 2015 Subject: Liquor License Request ___________________________________________________________________________________________________________ Michael Edlavitch and Teresa Angier, owners of Royal Comedy Theatre, have submitted a request asking the City Council to consider amending City Code Section 1200.05 to allow for on-sale liquor licenses to be issued to performing arts theatres located in Hopkins. Minnesota Statute 340A.404 allows cities to issue on-sale intoxicating licenses to various establishments including theaters as referenced below: A city may issue an on-sale intoxicating liquor license, an on-sale wine license, or an on-sale malt liquor license to a theater within the city, notwithstanding any law, local ordinance, or charter provision. A license issued under this paragraph authorizes the sales on all days of the week to persons attending events at the theater. Mr. Edlavitch and Ms. Angier will be present at the work session to provide more information about their proposed business plans and liquor operations. After the presentation, the City Council should advise staff how to proceed with the request. Options that will assist staff in moving forward include the following: 1. Does the City Council support amending the liquor code to include the licensing of theaters? 2. If the City Council supports moving forward with the amendment would they prefer to allow for full on-sale or wine and on-sale malt beer? Or an option for both types of sales? 3. Determining any restrictions on the days and hours of sales. If the City Council is comfortable moving forward with an amendment, it is anticipated a first reading for the liquor ordinance would be held in January.
