RESOLUTION 2016-011
RESOLUTION MAKING FINDINGS OF FACT AND APPROVING ORDINANCE NO.
2016-1105, VACATING THE STORM SEWER EASEMENT WITHIN THE HOPKINS
VILLAGE PLAT FOR FIRST READING.
WHEREAS, an application for Vacation 2016-02-VAC has been made by Community
Housing Development Corporation; and
WHEREAS, the procedural history of the application is as follows:
1. That an application for a vacation of the storm sewer easement was made by
Community Housing Development Corporation, on December 23, 2015;
2. That the Hopkins City Council, pursuant to mailed and published notice, held a
public hearing on the application and reviewed such application on February 2,
2016: all persons present were given an opportunity to be heard;
3. That the written comments and analysis of City staff were considered; and
4. Legal description of the easement to be vacated is shown on Exhibit A, attached.
NOW, THEREFORE, BE IT RESOLVED that the City Council of the City of Hopkins
hereby approves Ordinance 2016-1105, vacating the storm sewer easement within the Hopkins
Village plat for first reading based on the following Findings of Fact:
1. That the above-described easement is not needed for a public purpose.

That part of the East-West Alley located within Block 2, West Minneapolis, according to the recorded
plat thereof, Hennepin County, Minnesota described as follows:
That part of said East-West alley, lying between the extension Northerly across it of the East boundary
line of Lot 42 and of the West boundary line of Lot 7 said Block 2,West Minneapolis, and between the
extensions Northerly across it of the West boundary line of said Lot 42 and a line parallel thereto and
distant 10 feet Easterly thereof.

That part of Block 2, West Minneapolis,according to the recorded plat thereof, Hennepin County,
Minnesota, and of the vacated alleys in said Block 2,described as follows:
A strip of land in Block 2,West Minneapolis, 14 feet in width, being 7 feet on either side of the following
described center line: Beginning at the Southwest corner of Lot 1 in said Block 2;thence Southeasterly
to a point 43.5 feet West of the East line and 12.2 feet North of the South line of Lot 40, said Block 2;
thence East, parallel with the South line of said Lot 40, a distance of 72 feet; thence Northeasterly to the
intersection of a line drawn 7 feet North of and parallel to the Northerly line of Lot 7, said Block 2, and
the East line of Lot 3, said Block 2 as the same is extended Southerly;thence East along a line drawn 7
feet North of and parallel to the North line of Lot 7,said Block 2,to the West line of Sixth Avenue and
