Minutes of the February 2, 2016 City Council Regular Meeting ProceedingsHOPKINS CITY COUNCIL REGULAR MEETING PROCEEDINGS FEBRUARY 2, 2016 CALL TO ORDER Pursuant to due call and notice thereof a regular meeting of the Hopkins City Council was held on Tuesday, February 2, 2016 at 7:10 p.m. in the Council Chambers at City Hall, 1010 First Street South, Hopkins. Mayor Cummings called the meeting to order with Council Members Kuznia, Halverson, Gadd and Campbell attending. Staff present included City Manager Mornson, Community Development Coordinator Beekman, Planning and Development Director Elverum, Assistant City Manager Genellie, City Planner Lindahl, City Attorney Riggs and Public Works Director Stadler. ADOPT AGENDA Motion by Kuznia. Second by Halverson. Motion to Adopt Agenda. Ayes: Kuznia, Halverson, Cummings, Gadd, Campbell. Nays: None. Motion carried. CONSENT AGENDA Motion by Gadd. Second by Halverson. Motion to Approve the Consent Agenda. 1. Minutes of the January 15, 2016 City Council Goal Setting Meeting 2. Minutes of the January 19, 2016 City Council Regular Meeting Proceedings 3. Minutes of the January 19, 2016 Work Session following Regular Meeting Proceedings 4. Authorize Out-of-State Travel; (CR2016-011) 5. Declare Cost to be Assessed and Order Assessment Hearing – 2016 Street and Utility Improvements-City Project 2015-10; (CR2016-009) 6. Approve Joint Powers Agreement – 2016 Street and Utility Improvements-City Project 2015- 10; (CR2016-010) 7. Ratify Checks Issued in January 2016; (Memo) 8. Approve Cedar Lake LRT Regional Trail Cooperative Agreement between the City of Hopkins and Three Rivers Park District; (CR2016-014) Council Member Campbell asked about Consent Agenda Item 5 and the decrease in the assessment costs. Public Works Director Stadler commented that the cost reduction is the actual assessment amount. Ayes: Kuznia, Halverson, Cummings, Gadd, Campbell. Nays: None. Motion carried. HOPKINS CITY COUNCIL REGULAR MEETING PROCEEDINGS FEBRUARY 2, 2016 PUBLIC HEARING V.1. Modification to the Redevelopment Plan for Redevelopment Project No. 1 - Tax Increment Financing (TIF) Plan for TIF District No. 1-5; (CR2016-012) Planning and Development Director Elverum gave an overview of the project and the Tax Increment Financing (TIF) plan for the Doran Development. Ms. Elverum commented that the development went through an internal review and it was determined that no capital investment by the Police, Fire and Public Works Department was required and that the Hopkins School District and Hennepin County was informed about the possible TIF District. Ms. Elverum commented that the purpose of the TIF District is to preserve and enhance the tax base, redevelop substandard properties and provide employment opportunities. The Zoning and Planning Commission unanimously voted that the plans conformed with redevelopment within the City. Mayor Cummings opened the public hearing at 7:13 pm. No residents came forward to address the Council. Motion by Kuznia. Second by Gadd. Motion to close the Public Hearing at 7:13 pm. Ayes: Halverson, Kuznia, Cummings, Gadd, Campbell. Nays: None. Motion carried. Motion by Campbell. Second by Gadd. Motion to adopt Resolution 2016-08, adopting a modification to the redevelopment plan for Redevelopment Project No.1; establishing Tax Increment Financing District No 1-5 (The Moline) and adopting a tax increment financing plan therefor. Ayes: Halverson, Kuznia, Cummings, Gadd, Campbell Nays: None. Motion carried. V.2. Hopkins Village Storm Sewer Easement Vacation; (CR2016-015) City Planner Lindahl gave an overview of the property and location of the abandoned storm sewer easement. Mr. Lindahl explained that the vacation is necessary for the applicant to subdivide and prepare the property for possible future redevelopment. Mr. Lindahl gave an overview of preliminary plat and easement vacation. The City Engineer has reviewed the storm sewer easement and determined that it no longer serves a public purpose. There was Council discussion regarding the responsibility of the abandoned sewer pipe. Mr. Lindahl commented that it would be the property owners’ responsibility. Mayor Cummings opened the public hearing at 7:19 pm. No residents came forward to address the Council. HOPKINS CITY COUNCIL REGULAR MEETING PROCEEDINGS FEBRUARY 2, 2016 Motion by Halverson. Motion to adopt Resolution 2016-011, approving Ordinance 2016-1105, vacating the storm sewer easement within the Hopkins Village plat for first reading. Ayes: Halverson, Kuznia, Cummings, Gadd, Campbell Nays: None. Motion carried. NEW BUSINESS VII.1. Preliminary and Final Plat – 9 Seventh Avenue North; (CR2016-013) City Planner Lindahl gave an overview of the Hopkins Village preliminary plat, final plat and explained that the process is necessary for the applicant to finance rehabilitation of the existing building and for possible future development of the underutilized parking lot. Mr. Lindahl explained that any development proposals would come back before the Zoning & Planning Commission and the City Council for review. Mr. Lindahl commented that there were no public comments at the Zoning & Planning Commission Public Hearing. Staff did receive two emails regarding parking concerns. Mr. Lindahl discussed the preliminary plat and commented that the design is consistent with the zoning for the parcel and is not creating new nonconformities. Mr. Lindahl discussed the final plat noting the staff recommended conditions that include the Park Dedication Fee be paid at time of the building permit and that the applicant record a parking and access easement. The City Attorney has reviewed the preliminary and final plat and recommends that the applicant provide title work as part of the plat. The applicant, Community Housing Development Corporation, came forward to address the Council. The applicant explained that the parking lot is currently only 40-50% occupied and that a parking count and parking study would be completed prior to future redevelopment. There was Council discussion regarding the potential sale of the second lot. City Attorney Riggs commented that the property would be encumbered by easements making a property sale necessary to come back before the City Council. Motion by Gadd. Second by Campbell. Motion to adopt Resolution 2016-009, approving the preliminary plat for Hopkins Village subject to the conditions. Ayes: Halverson, Kuznia, Cummings, Gadd, Campbell Nays: None. Motion carried. HOPKINS CITY COUNCIL REGULAR MEETING PROCEEDINGS FEBRUARY 2, 2016 Motion by Gadd. Second by Halverson. Motion to adopt Resolution 2016-010, approving the final plat for Hopkins Village subject to the conditions. Ayes: Halverson, Kuznia, Cummings, Gadd, Campbell Nays: None. Motion carried. VII.2 First Reading: Ordinance Amending Section 1200 of the Hopkins City Code: Sale, Consumption and Display of Alcoholic Beverages; (CR2016-006) Assistant City Manager Genellie gave an overview of the request by the owners of the Royal Comedy Theatre to consider amending the City Code to allow on-sale liquor license for performing arts theaters. Mr. Genellie commented that State law does allow cities to issue licenses to theaters. Mr. Genellie gave an overview of the definition of a theater, attendance guidelines and proposed hours of liquor sales from 6:30-11:30 pm. Mr. Genellie discussed the proposed fees. There was Council discussion regarding the sale of strong beer and private rental of the theater space. Mr. Genellie commented that the sale of strong beer requires the $5000 per year license and that the City Attorney has reviewed the ordinance. Mr. Genellie explained that renters of the space for private events would not be able to serve liquor. The applicant, Michael Edlavitch, came forward to address the Council. Mr. Edlavitch gave an overview of performances, times, capacity, with scheduled opening in May 2016. City Attorney Riggs reviewed the state statute regarding the provision for serving strong beer in the theater. Mayor Cummings welcomed the business owner to the community and encouraged him to reach out to area businesses and the Hopkins Police Department. Motion by Kuznia. Second by Halverson. Motion to adopt Resolution first reading Ordinance 2016-1104, An Ordinance Amending Section 1200 Sale, Consumption and Display of Alcoholic Beverages. Ayes: Halverson, Kuznia, Cummings, Gadd, Campbell Nays: None. Motion carried. VII.3. Resolution Approving the 2016 Goals and Strategic Plan; (CR2016-008) City Manager Mornson gave an overview and explained the changes to the City of Hopkins 2016 Mission and Goals. Mr. Mornson discussed the 2016 accomplishments and opportunities. Mayor Cummings commented that the Goal Setting Meeting is a valuable opportunity for discussion by Department Heads and Council Members. Motion by Gadd. Second by Kuznia. Motion to adopt Resolution 2016-004, Affirming the City of Hopkins Mission Statement HOPKINS CITY COUNCIL REGULAR MEETING PROCEEDINGS FEBRUARY 2, 2016 and Adopting the 2016 Goals and Strategic Plan for the City of Hopkins. Ayes: Halverson, Kuznia, Cummings, Gadd, Campbell Nays: None. Motion carried. ANNOUNCEMENTS • City Manager Mornson commented that the Doran Development Agreement is scheduled to be on the City Council agenda in two weeks. • Highway 169 Rehabilitation Project Open House: Hopkins High School, 2400 Lindbergh Drive, Minnetonka – Wednesday, February 10 – 4 to 6p.m. • 2016 Home Remodeling Fair: Eisenhower Community Center, 1001 Highway 7 – Sunday, February 21, 10:30 a.m. to 3:30 p.m. • Citizens Academy will be held April 7, 14, 21 and 28. Applications are now available on City’s website. • The Drug Prevention Town Hall meeting was cancelled tonight due to weather. The meeting will be rescheduled for spring. ADJOURNMENT There being no further business to come before the City Council and upon a motion by Kuznia, second by Campbell, the meeting was unanimously adjourned at 7:51 p.m. OPEN AGENDA – PUBLIC COMMENTS AND CONCERNS The City Council did not receive any comments or concerns.
