V.1. Adopt Assessment Roll – 2016 Street and Utility Improvements, City Project 2015-10; Stanley (CR2016-025) February 29, 2016 Council Report 2016-025 ADOPT ASSESSMENT ROLL 2016 STREET AND UTILITY IMPROVEMENTS CITY PROJECT 2015-10 Proposed Action Staff recommends adoption of the following motion: Adopt Resolution 2016-019, Resolution Adopting Assessment Roll, 2016 Street and Utility Improvements, City Project 2015-10. This action continues an assessable project for street improvements. Overview Assessment calculations were prepared based on the overall lowest bid received for the 2016 Street and Utility Improvements. At its February 2, 2016 meeting the Hopkins City Council ordered preparation of the assessment roll for the project. At that same meeting, the Council ordered an assessment hearing for the project to be held February 29, 2016. This assessment hearing sets in motion levying of assessments against benefiting properties. A public hearing notice has been published and mailed, along with an assessment statement to every affected property owner. As of this writing, no written objections contesting the proposed assessments have been submitted. Written objections to Council must be submitted no later than the hearing date. Staff is recommending adoption of the assessment roll following the public hearing. Primary Issues to Consider. Standard forms for written objections have been available at City Hall and need to be submitted no later than the hearing date. Appeals Received • No appeals have been received as of the date of report preparation. Public Information • A public informational meeting was held on Thursday, February 25 which focused on providing detailed information related to assessments including calculation methodology, interest calculation, payment options, and deferring assessments. Example calculations were presented for assessments and payments involving several different situations. The City Finance Director and Assessment Clerk were also in attendance to present information and answer questions. Project Costs and Assessments • Based on the low bid, indirect costs and contingency the total estimated project cost is $4,649,900. The current estimated project amount is lower than the previous estimate, and the cost savings are reflected in lower assessments. Table 1 provides a summary of the assessment information for residential properties in the neighborhood. Table 2 provides a summary of commercial property assessment information. Council Report 2016-025 Page 3 Table 2 – Commercial Property Summary Street Preliminary Final Assessed Cost Decrease Assessment Cost Cost Range Mainstreet $7,849 - $21,376/Unit $3,700 - $16,055/Unit $2,174 - $8,331/Unit The assessments are based on the City’s assessment policy, whereby 70% of the street reconstruction cost and 50% of the sewer and water service replacement are assessed to benefiting properties. The policy also allows for assessments to be capped should assessments exceed previous year assessments by 20%; the costs for this project did indeed trigger the assessment cap. The 2016 assessment cap for residential properties is $83.79 per front foot; there is no cap for commercial property. When analyzing the unit prices to calculate the assessments, it was noticed that the low bidder had significantly higher unit prices for the sewer and water service work than other bidders. The recommendation to award the contract considers the lowest total bid rather than individual unit prices, and many factors unique to each contractor affect the way unit price bids are determined. While staff recommends contract award to the low bidder, the project team felt the unit prices from the low bidder for the service work were not a fair representation of the true cost of the sewer and water service improvements. Staff looked at the unit prices for the sewer and water service work submitted by the bidders finishing second through fifth lowest and saw that the unit prices were more reasonable. Staff decided to base the assessments for the sewer and water services on the average of the unit prices submitted by the second through fifth place bidders, as the project team felt these more accurately represented a fair amount to be assessed for the work. This resulted in a decrease for sewer and water assessment amounts. The interest rate will be 2 percentage points above the Total Interest Cost (TIC) of the bonds to be sold for the project. It is anticipated that the interest rate on assessments will be between 3.5% and 5% for this project, as the interest rate on previous recent bond sales has fallen in this range and no drastic market changes have occurred that would alter this expectation. Staff has tentatively scheduled the bond sale for this May and will notify property owners of the exact interest rate after the sale. Staff recommends adopting a 15-year term for the assessment as discussed at previous City Council meetings. Property owners can prepay without interest through June 30, 2016. To avoid the assessment being certified on property taxes, owner must make payment prior to November 29, 2016. Staff Recommendation • Staff recommends adoption of the assessment roll for this project with adoption of Resolution 2016-019.
