Resolution Appointing Data Practices Compliance Official
and Responsible Authority
Proposed Action.
Staff recommends adoption of the following motion: Move that Council adopt Resolution 2016-
032 Appointment of Data Practices Compliance Official and Responsible Authority.
Approval of this motion will result in the appointment of a data practices compliance official and
responsible authority as required by state law.
Overview
:
Staff is recommending that the City Council appoint the City Clerk as the City’s data compliance
official and responsible authority. The Assistant City Manager served in that capacity for a
number of years.
All government entities are required to designate or appoint an employee as a responsible
authority and data practices compliance official. The data practices compliance official is the
designated employee of the government entity to whom persons may direct questions or
concerns regarding problems in obtaining access to data or other data practices problems. The
responsible authority may be the data practices compliance official.
Primary Issues to Consider
:
This action will result in no change with data practices procedures other than the City Clerk
will be handling any complaints or concerns regarding the access to City data.

APPOINTMENT OF DATA PRACTICES COMPLIANCE OFFICIAL
AND RESPONSIBLE AUTHORITY
WHEREAS,
Minnesota Statutes, Section 13.02, Subdivision 16, and Section 13.05,
Subdivision 13, as amended, require that the City appoint an employee as the Data Practices
Compliance Official and Responsible Authority to administer the requirements for collection,
storage, use and dissemination of data on individuals within the City; and
WHEREAS
, the City Council shares the concern expressed by the Legislature about
access to City data and wishes to satisfy this concern by immediately appointing a qualified Data
Practices Compliance Official and Responsible Authority as required under the statute.
NOW, THEREFORE BE IT NOW RESOLVED,
that the City of Hopkins hereby
appoints Amy Domeier, the City Clerk, as the Data Practices Compliance Official and
Responsible Authority, for the purposes of meeting all requirements of Minnesota Statutes,
Chapter 13.
