Metropolitan Council Livable Communities Transit Orientated Development Program Grant Agreement Extension – Oxford Green; Beekman (CR2016-125) (2) December 6, 2016 Council Report 2016-125 Metropolitan Council Livable Communities Transit Oriented Development Program Grant Agreement Extension – Oxford Green Proposed Action Staff recommends adoption of the following motion: Move to approve the First Extension of Metropolitan Livable Communities Demonstration Account Transit Oriented Development Grant Agreement for the Oxford Village Project. Overview In 2013, The City, on behalf of PPL, applied for and received $1,600,000 from the Metropolitan Council’s LCDA-TOD fund to assist in land acquisition, demolition, and placemaking within and around the project area. The grant agreement requires the funds to be used by December 31, 2016. While approximately $1.2 million of the funds have already been reimbursed to PPL, it is anticipated that not all funds will be used by the expiration of the grant. PPL has requested a 12 month extension that would allow them time to commence construction in order to use the remainder of the grant funds. Supporting Information  First Extension of Metropolitan Livable Communities Demonstration Account Transit Oriented Development Grant Agreement __________________________ Meg Beekman Community Development Coordinator Alternatives The Council has the following alternatives:  Approve Grant Agreement Extension  Approve Grant Agreement Extension with changes  Deny Grant Agreement Extension Amendment #1 SG013-132 Revised 11/01/2016 Grant No. SG013-132 FIRST EXTENSION OF METROPOLITAN LIVABLE COMMUNITIES ACT LIVABLE COMMUNITIES DEMONSTRATION ACCOUNT TRANSIT ORIENTED DEVELOPMENT GRANT AGREEMENT THIS AGREEMENT is made and entered into by the Metropolitan Council (“Council”) and the City of Hopkins (“Grantee”). WHEREAS, in December 2013 the Grantee was awarded a $1,600,000 Livable Communities Demonstration Account Transit Oriented Development grant to help fund site acquisition, stormwater management, demolition, and placemaking associated with the Grantee’s Oxford Green project; and WHEREAS, on March 21, 2014, the Grantee and the Council entered into a grant agreement identified as Council Grant No. SG013-132 (“Agreement”) which made the grant funds available to the Grantee for the Oxford Green project; and WHEREAS, on August 13, 2014 the Council approved certain changes in its extension procedures for Metropolitan Livable Communities Act grant agreements, including that the development or redevelopment project will have commenced within the requested extension timeframe rather than requiring that the development or redevelopment project will be completed within the requested extension timeframe; and WHEREAS, the procedures changed by the Council on August 13, 2014 were applied to all active Metropolitan Livable Communities Act grants; and WHEREAS, on October 11, 2016 the Grantee requested a 12-month extension to complete stormwater and placemaking activities. NOW, THEREFORE, in consideration of the promises and covenants contained in this agreement, the Council and the Grantee agree to amend Grant No. SG013-132 as follows: 1. The “EXPIRATION DATE” identified at Page 1 of the Agreement and referenced in Section 4.01, Term, is changed from December 31, 2016 to December 31, 2017. 2. Notwithstanding text in the Project Summary indicating the uses will be completed by 12/31/2016, the grant-funded activities will be complete by 12/31/2017. Except for these amendments and modifications, the provisions of Grant No. SG013-132 shall remain in force and effect without change. This agreement is effective on the date of final execution by the Council.
