Resolution Supporting Condominium, Townhouse and Cooperative Construction
Proposed Action.
Staff recommends adoption of the following motion: Move that Counciladopt resolution 2017-
014 a Resolution Supporting Condominium, Townhouse and Cooperative Construction.
Overview
:
The ULI MN/Regional Council of Mayors Housing Initiative 2016 Work Plan included a priority
for Common Interest Property Liability Reform. The purpose is to engage in a regional effort to
reform common interest property liability laws to spur private sector investment of common
interest developments; townhome and condominium.
Primary Issues to Consider
:
The City of Hopkins 2017 Legislative Policy included support for laws on condominium
development to see if they are a reason why condos are not being developed. It is another
type of housing that could add to our housing diversity.
The ULI MN/Regional Council of Mayors Housing Initiative Mission is to provide a forum
for public officials to connect with private sector time and talent to develop strategies for a
more equitable and competitive region in support of a full range of housing choices. The
Commons Interest Property Liability Reform is just one of the initiatives the group has listed
as a priority.

RESOLUTION 2017-014
A RESOLUTION SUPPORTING CONDOMINIUM, TOWNHOUSE
AND COOPERATIVE CONSTRUCTION
WHEREAS,
the City of Hopkins agrees that a full range of housing choices is critical for the
competitiveness of our region and that home ownership is a key component of healthy
communities and resilient economies; and
WHEREAS,
over the past decade, the production of condominiums, townhomes and
cooperatives has declined dramatically; and
WHEREAS,
the City of Hopkins supports the bipartisan legislative efforts at the Minnesota
legislature to support the development of condominiums, townhouses and cooperatives by
reducing the risk of unwarranted litigation; and
WHEREAS,
the City of Hopkins affirms that to be effective, any legislation in Minnesota must
include common sense elements:
•A requirement that a majority of homeowner association members approve the decision
to pursue legal action against development parties; and
•A requirement for complete disclosure to homeowner association members regarding any
alleged defects to enable association members to be fully informed before commencing
legal proceedings; and
•A requirement for mediation as a cost effective and preferred method of dispute
resolution before proceeding with binding legal action; and
•A requirement for all parties in any litigation to pay their own attorney’s fees, as is
required under comparable apartment and single family home warranty laws; and
•A requirement that all homeowner associations adopt and implement a preventative
maintenance plan.
NOW, THEREFORE, BE IT RESOLVED
by the City Council of the City of Hopkins,
Minnesota, that the City of Hopkins hereby supports these measures identified above to
potentially increase condominium, townhouse and cooperative construction activity in the
community of Hopkins.
