Improvements
Proposed Action.
Staff recommends adoption of the following motion: Move that Council authorize
the Mayor and City Manager to siqn a maintenance agreement between the City
of Hopkins and the Minnehaha Creek Watershed District — Burnes Park
' Im�rovements.
Overview.
The City has received conditional approval of its erosion control and stormwater
management permit covering our Burnes Park improvements. The executed
maintenance agreement is a condition of our permit with the MCWD. The
agreement requires very minimal effort on the part of the city as it is limited to the
maintenance of various vegetated swales that channel stormwater in the
improved area of the park to french drain structures.

Dear Mr. Stadler:
Thank you for applying for a Minnehaha Creek Watershed District (MCWD) permit for Erosion Control
and Stormwater Management located at the above-mentioned address. The review of this application
has concluded, and the MCWD has determined the above-mentioned permit application to be
complete. Therefore, the application is approved with the following conditions:
1. Maintenance Agreement for vegetated swale
2. NPDES Permit Number and Coverage Card
Once the above-mentioned materials have been submitted and all permit conditions have been met,
staff will issue the permit. You are reminded that work on the project cannot begin until the permit has
been issued. The approval expires one year from the date of this letter. If final municipal approval of
the project results in changes to the project, you must submit revised plans to the MCWD for review.

The City of Hopkins
This Maintenance Agreement (Agreement) is made by and between the Minnehaha Creek Watershed
District, a watershed district with purposes and powers set forth at Minnesota Statutes chapters 103B and
103D (MCWD), and the City of Hopkins.
Recitals and Statement of Purpose
W�IEREAS pursuant to Minnesota Statutes § 103D.345, the MCWD has adopted and implements
the Stormwater Management Rule, Wetland Protection Rule, the Waterbody Crossings & Structures Rule
and the Shoreline & Streambank Stabilization Rule;
W�IEREAS under the Stor�nwater Management Rule, certain land development activity triggers
the requirement that the landowner record a declaration establishing the landowner's perpetual obligation
to inspect and maintain stormwater-management facilities;
UVHEREAS in each case, a public landowner, as an alternative to a recorded instrument, may
meet the maintenance requirement by documenting its obligations in an unrecorded written agreement
with the MC WD;
UVI�I�EAS in accordance with the MCWD rules and as a condition of Permit 17-051, the City's
obligation to maintain stormwater facilities must be memorialized by a recorded maintenance declaration
or, alternatively, a maintenance agreement establishing the City's perpetual maintenance obligation;
W��REAS the City of Hopkins and the MCWD execute this Agreement to fulfill the condition
of Permit 17-051, and concur that it is binding and rests on mutual valuable consideration;
THEREFORE the City of Hopkins and MCWD agree as follows:
1. The City of Hopkins, at its cost, will inspect and maintain the stormwater facilities as shown in
the site plan attached to and incorporated into this Agreement as E�ibit A in perpetuity as follows:
A. STOR1�✓IWATER FACILITIES
Vegetated swales. Vegetated swales will remain free from vegetative disturbance,
fertilizer application, yard or other waste disposal, the placement of structures or any
other alteration that impedes the function of the vegetated swale.
11. Reporting. The Declarant Will submit to the MCWD annually a brief written report that
describes stormwater facility maintenance activities performed under this declaration,
including dates, locations of inspections and the maintenance activities performed.
2. If the City of Hopkins conveys into private ownership a fee interest in the property that is the
subject of this Agreement, it shall require as a condition of sale, and enforce: (a) that the purchaser record
a declaration on the property incorporating the maintenance requirements of this Agreement; and (b) that
recordation occur either before any other encumbrance is recorded on the property or, if aft�r, only as
accompanied by a subordination and consent executed by the encumbrance holder ensuring that the
declaration will run with the land in perpetuity. If the City of Hopkins conveys into public ownership a
fee interest in any property that has become subj ect to this Agreement, it shall require as a condition of
the purchase and sale agreement tha.t the purchaser accept an assig;nment of all obligatio�s vested under
this .A.g�eeme�t.

3. This Agreement may be amended only in a writing signed by the parties.
4. The recitals are incorporated as a part of this Agreement.
