04-04-2017 City Council MeetingHOPKINS CITY COUNCIL REGULAR MEETING PROCEEDINGS APRIL 4, 2017 CALL TO ORDER Pursuant to due call and notice thereof a regular meeting of the Hopkins City Council was held on Tuesday, April 4, 2017 at 7:03 p.m. in the Council Chambers at City Hall, 1010 First Street South, Hopkins. Mayor Cummings called the meeting to order with Council Members Kuznia, Halverson, Gadd and Campbell attending. Staff present included City Manager Mornson, City Attorney Anderson, City Clerk Domeier, Planning and Development Director Elverum, Police Chief Johnson, Building Official Kearney, Police Captain Kreiling, Assistant City Manager Lenz and Public Works Director Stadler. ADOPT AGENDA Motion by Kuznia. Second by Gadd. Motion to Adopt Agenda. Ayes: Kuznia, Halverson, Cummings, Gadd, Campbell. Nays: None. Motion carried. PRESENTATIONS 111.1. Resolution of Support for the Hennepin County Sheriff's Office #NOverdose Drug Awareness and Prevention Public Awareness Campaign; (Memo) Hennepin County Sheriff Stanek discussed the #NOverdose Drug Awareness and Prevention Public Awareness Campaign. Sheriff Stanek explained that the campaign focus is to increase public awareness to help reduce abuse, save lives, bring people together and help reduce the number of opioid overdoses. Sheriff Stanek discussed an upcoming town hall event in collaboration with the Hopkins Schools One Voice Coalition, gave an overview of Hennepin County opioid death statistics and programs to encourage proper disposal of unwanted medications. Mayor Cummings asked about the Drug Take Back Box locations and Narcan availability in the schools. Sheriff Stanek explained that ten boxes are located throughout Hennepin County. Drug Take Back Boxes cost $800-$1200 and are often funded by local civic organizations. Police Chief Johnson will be consulted about possibly locating a box in Hopkins. Sheriff Stanek explained that First Responders carry Narcan. A Hopkins School District representative commented that they could investigate having the emergency treatment available in the schools. Mayor Cummings asked about the fear of arrest for reporting an overdose. Captain Kreiling commented that a person should report an overdose without fear of repercussions but a narcotic possession investigation is still a possibility. There was discussion regarding Deterra Drug Deactivation Bags to dispose of unused medications. Sheriff Stanek commented that the bags would be available at upcoming Town Hall meetings. Mayor Cummings asked what can the schools and cities do to combat the crisis. Sheriff Stanek commented that schools and cities could combine forces to address the issues, work cooperatively and continue to have conversations recognizing the issue of addiction. HOPKINS CITY COUNCIL REGULAR MEETING PROCEEDINGS APRIL 4, 2017 Motion to adopt Resolution 2017-032 Resolution of Support for the Hennepin County Sheriff's Office #NOverdose Drug Abuse Awareness and Prevention Public Awareness Campaign. Ayes: Kuznia, Halverson, Cummings, Gadd, Campbell. Nays: None. Motion carried Rhoda Michealynn, 500 Valleywood Circle, Golden Valley came forward and encouraged the City of Hopkins to continue to communicate and address the dr�g problem and recognize the crisis of addiction. Proposed Fee Adjustments in Chapter 10 of the City Code; (CR2017-054) 6. Ratify Checks Issued in March 2017 7. Approve Minnehaha Creek Maintenance Agreement — Burnes Park Improvements; (CR2017-054) 8. Declaring the Official Intent of the City of Hopkins to Reimburse Certain Expenditures from General Obligation Improvement Bond Proceeds to be Issued by the City of Hopkins (CR2017-059) 9. Approve Construction Services Agreement — Artery Improvements, City Project 2014-09; (CR2017-060) 10.Approve Estoppel Certificate to Minnesota Community Solar Garden Subscription Agreement; (CR2017-061) Public Works Director Stadler explained Consent Agenda number 10. Mr. Stadler explained that the agreement is part of the SunEdison bankruptcy proceedings and that the solar garden site would soon be under construction and the City would be able to begin to take advantage of the reduced energy rates. City Attorney Anderson commented that the Attorney Riggs has reviewed the agreement. Ayes: Kuznia, Halverson, Cummings, Gadd, Campbell. Nays: None. Motion carried. NEW BUSINESS VII.1. Award Contract — Burnes Park Improvement Project Public Works Director Stadler gave an overview of the contract for the Burnes Park Improvement Project. Mr. Stadler discussed the bids explaining that the low bidder withdrew due to bidding errors. The City Attorney is reviewing the Bid Bond documents. Mr. Stadler explained that the bids came in higher than anticipated but the bids are HOPKINS CITY COUNCIL REGULAR MEETING PROCEEDINGS APRIL 4, 2017 competitive and that staff and project architects support awarding the contract to Morcon Construction Co. Mr. Stadler reviewed the project contracts, costs, funding and project timetable. Mayor Cummings asked about use of the contingency fund. Mr. Stadler explained that the contingency fund is generally used to respond to and take care of unanticipated issues. Mayor Cummings expressed concerns that bids have been higher than anticipated on recent projects and asked about a solution to address this issue. Mr. Stadler commented that staff could be adding 10% to the engineers estimate on future projects. Mayor Cummings commented that as the economy gets stronger, bid numbers are coming in higher. Council appreciates the work of the staff and Park Board and realizes that Burnes will be a fabulous park when completed. Motion by Gadd. Second by Campbell. Motion that Council award a contract to Morcon Construction Co. Inc. in the amount of $1,391,100 for the Burnes Park Improvement project, City project #2016-006. Ayes: Halverson, Kuznia, Cummings, Gadd, Campbell Nays: None. Motion carried. VII.2. First Reading: Ordinance Amending Section 1200.43 of the Hopkins City Code regarding Civil Penalties for Liquor License Violations and Readopting the Days/Hours Provisions of Minn. Stat. § 340A.504 City Clerk Domeier discussed the staff report regarding amending the City Code for Liquor License violation penalties. Ms. Domeier gave an overview of the changes and commented that staff worked with Police Chief Johnson on the changes. Ms. Domeier discussed the reasons for eliminating the Best Practices Program and explained that she has worked with City Attorney Anderson regarding readopting the State Statute with the new Sunday Sales Legislation. The off-sale license holders have been notified. Ms. Domeier commented that the Sunday sales would be allowed from 11 a.m. to 6 p.m. beginning July 2 but establishments could choose their own Sunday hours. Motion by Gadd. Second by Kuznia. Motion adopt for first reading Ordinance 2017-1122, An Ordinance Amending Section 1200.54 of the Hopkins City Code Regarding Civil Penalties for Liquor License Violations and Readopting the Days/Hours Provisions of Minn. Stat. § 340A.504. Ayes: Halverson, Kuznia, Cummings, Gadd, Campbell Nays: None. Motion carried. VII.3. Resolution Supporting Local Decision-Making Authority; (CR2017-055) City Manager Mornson gave an overview of a resolution supporting local decision- making authority. Mr. Mornson explained that a significant number of House and Senate bills would restrict city authority in several policy areas. Mr. Mornson reviewed the restrictions that would affect the City of Hopkins. The League of MN Cities has HOPKINS CITY COUNCIL REGULAR MEETING PROCEEDINGS APRIL 4, 2017 encouraged cities to adopt the Resolution. Councii Member Gadd commented the proposed bills would strip away government control at the city level and that cities need to have their voices heard. Mr. Mornson commented that the Resolution would be submitted to all 201 State Senators and Representatives. Mayor Cummings asked if the Resolution is doing enough to represent the City's interest. Mr. Mornson commented that Council could make contact with State House representatives. Motion by Campbell. Second by Halverson. Motion that Council adopt resolution 2017-031 a Resolution Supporting Local Decision-Making Authority. Ayes: Halverson, Kuznia, Cummings, Gadd, Campbell Nays: None. Motion carried. ANNOUNCEMENTS • Yard Waste and Brush Drop Off Site Opens April1 at 3100 Hopkins Crossroad — Mondays and Wednesdays from 2 to 7 p.m. and Saturdays, 9 a.m. to 3 p.m. • Bulk Item Drop Off is available at Public Works, 11100 Excelsior Blvd., Friday, April 28 from 3 to 7 p.m. and Saturday, April 29 from 9 a.m. to 4 p.m. Public Works Director Stadler explained program costs and further details are available on the City Website. • Free Brush Pick Up: April 10 — 20 .
