AWARD OF CONTRACT
SCADA System Upgrade Project
Proposed Action:
Staff recommends adoption of the following motion: Move that Council award a contract to
Telemetry and Process Controls, Inc. in the amount of $326,655.00 for the upgrade of the Citv's
water and sewer SCADA system.
Overview
Bids were opened on June 1, 2017 for the SCADA Improvement project. We received four bids
for the work, bids ranged from $326,655 to $420,943.00. The engineer's final estimate was
$313,000. The low bidder was TPC, Inc., Oakdale MN at $326,655.00. The second low bidder
was Primex at $382,529.00. After review of the bid and a recommendation to award from our
consulting engineer, AE2S, City staff recommends an award to TPC, Inc.
i"he ��ADA sys�em is the programmabie, PC-based moniioring �nd confroi sysfem Tor rhe
water and sanitary sewer infrastructure. The system monitors water tank levels, activates
pumps based on water levels, maintains communication between devices and sends out
alarms, as required based on water levels exceeding certain ranges or equipment failure. The
existing SCADA system was installed in 1996 with periodic updates since.

6.01 Submitfal and Processing of Payments
A. CONTRACTOR shall submi� A.pplications for P�yment in accordance with Article
14 of the General Conditions. App[ications for Payment will be processed by
ENGINEER as provided in the General Condi�ions.
6.02 Progress Paymenfs; Retalnage �
A. OWNER shall m�ke progress payments on accaunt of the Contract Price on the
� basis of GONTRACTOR's Applications for Payment on a monthiy routin� basis
during performance of the Work as provided in fihe paragraphs 6.02.A.'1 and
6.02.A.2 below, All such payments will be measured by the schedule of values
established in paragraph 2.�7.A of the General Conditions:
1. Prior to Substantial Comp(etion, progress payments wili be made in an
amaunt equal to fhe percentage indicated below but, in each case, less
the aggregafie of payments previously made and less such amounfis as
ENGINEER may determine or OWNER may withhold, in accordance with
paragraph � 4.02 of the General Conditions:
a. 90 percent of Work completed (with the balance be�ng retainage).

ENGINEER, and if the character and progress of the Work have

2. Upon Substantial Complet�on, 4WNER shall pay an amount sufficient to
increase tofial payrnents ta GONTRACTOR to 95 percent of fhe V1Cork
comp(eted, less such amounts as ENGINEER shall defermine in
accordance with paragraph' 14.02.B.5 of the General Conditians and less
10� percent of ENGINEER's estimafe ofi the value ofi W'ork to be

completed ar corrected at�ached to the cerfificate of Subsfiantial
Completion. .
B. In accordance with Minnesota State Statutes 471.425, the CONTRACTOR sha(I
pay subcontractors and suppliers wifihin �en (10) fen days ofi CONTC�ACTOR'S
receipt of payment from the OWNER for undisputed serv�ces provided by
subcontractors and suppliers. Paymenfs not paid on �ime to subc�nfiractors and
suppliers shall be subject to provisians in Minnesota Sfafiutes Section 471.425 as
amended. The CONTRACTOR is required to be in compliance with al[ applicab[e
sections and subdivisions of ii/linnesofa State S�atutes 4�1.425.
6.03 F�nal Paymenf
A. Upon final complet�on and acceptance of the Work in accordance wifih_paragraph
_
14.07 of the General Conditions, OWNER shall pay the remainder ofi the
Contract Price as recommended by ENG(NEER as provided �n said paragraph
14.07�.
B. The CONTRACT�R must submif N[innesota Deparkment of Revenue Form IC-
� 34 before the OV1lNER wi[1 issue the final payment for the project.
ARTICLE ? - iNTEREST
7.01 A(1 rnoneys not p�id when due as provided in Article 14 of the General Conditions shall
bear interest afi the maximum rate allowed by law at the place of the ProJect.

the general, local, and Site conditions that may affect cost, progress, and
perfiormance of the Work.

conditions in or relating to existing surface or subsurface structures at or
contiguous to the Site (except Underground Facilities) which have been identified
in the Supplementary Condifiions as provided in paragraph 4,02 of the General
Condifiions and (2) reports and drawings of a Hazardous Environmental
Condition, if any, �t the Site which has been identified in the Supplementary
Conditions as provided in paragraph 4.06 of the General Conditions,
E. CCJNTRACTOR has obtained and carefully studied (or assumes responsibili�y for
having dor�e so) all additional or supplementary examinations, investigations,
explorations, tests, studies, and data concerning con�itions �surface, subsurface,
and Underground Facilities) at or contiguous to the Site which may af�ect cost,
progress, or performance of the Work or which relate to any aspect of the means,
methods, techniques, sequences, and procedures of the construction to be
employed by C4NTRACTOR, including applying the specific means, methods,
t��hniq�aes, �egu�nces, and procedures of construction, if any, expressly
required by the Contact Documents to be employed by CONTRACTOR, and
safefy precautions and programs incident thereto
F. CONTRACTOR does not consider that any further examinations, investi�gations,
exp[orations, test, studies, or data are necessary for the performance of the Work
at the Contract Price, within the Contract Times, and in accordance with the o�her
terms and conditions of the Contract Documents,
G. C�NTRACTOR is aware of fhe general nature of work fio be performed by
4V11NER and others at the Site �hat relafies to the Work as indicated in the
Contracfi Documents.
H. CONTRACTOR has corre[ated the information known to CONTRAC�TUR,
information and observat�ons obfained from visits to the Sifie, reports and
drawings identifiied in the Con�ract Documents, and all addi�ional examinafions,
invesfiigafiions, explorations, tests, studies, and data v�rifh fihe Contract�
Documents.
