DBA Pub 819; Domeier (CR2017-099) July 31, 2017 Council Report 2017-099 Extension of On-Sale Liquor License Premise for 819 Mainstreet Inc. DBA Pub 819 Proposed Action Staff recommends adoption of the following motion: Approve Extension of On-Sale Liquor License for 819 Mainstreet Inc. DBA Pub 819 to allow the sale of alcohol on Mainstreet on September 23, 2017. Passage of this motion will result in the ability of the Pub 819 to serve alcoholic beverages at their event on Saturday, September 23. The event is scheduled from 8 p.m. to 12 a.m. Overview The owners of Pub 819 have requested an extension of their on-sale liquor license to cover the sale of alcohol in the barricaded area of Mainstreet between 8th and 9th Avenues, as well as live music entertainment, during their B Squared Block Party Event. The establishment is required to obtain an insurance certificate for the event and send a letter to the surrounding neighbors advising them of this outdoor event. The Police Department , Public Works Department and Fire Department reviewed the request and have no objection to the liquor license extension or event, provided Pub 819 abides by the attached stipulations. Primary Issues to Consider  What measures will be taken to assure that persons under the age of 21 will not have access to alcohol? (See attached list of stipulations)  What measures will be taken to assure that outdoor activities will cease at 1 2:00 a.m.? (See attached list of stipulations) Supporting Documents  Stipulations  Site Plan Amy Domeier, City Clerk Financial Impact: $____________Budgeted: Y/N ____ Source: ________________ Related Documents (CIP, ERP, etc.): ______________________________________ Notes: ______________________________________________________________ STIPULATIONS  All of the below stipulations are inclusive of both the exterior areas of the Pub 819 including Mainstreet between 8th Avenue and 9th Avenue for purposes of this event. The extension of the premises is valid only for September 23, 2017.  Notification, via letter, to surrounding neighbors expected to be impacted by the event, specifically businesses located between 8th and 9th Avenues, advising them of the date and time of the event and what to expect.  City provided barricades surrounding the street closure will be secured to establish the outdoor event area. Both ends of the street must be blocked. The barricades may not be installed before 3 p.m. on the event day. All barricades must be removed within three hours after event ends.  Controlled access to the event with Pub 819 security personnel to identify and wrist band those of legal age to consume. The gate/emergency exit of the barricaded area will also need to be continuously manned to prevent patrons from leaving with alcoholic beverages.  Event is “21 and over” after 9 p.m.  All outdoor music will be done by 12 a.m.  Event hours for the service of alcoholic beverages will be from 8 p.m. to 12 a.m. All patrons must exit the Mainstreet by 12:30 a.m.  Pub 819 security will assist the Police Department in clearing the event at closing time at 12:30 a.m. The closing time should be prominently displayed throughout, so there is no confusion at the end of the evening when patrons are asked to leave.  For the event, Pub 819 will hire two uniformed police officer to supplement their security staff as required by the Police Department. Monitoring of those consuming alcohol will be done by members of Pub 819 and the Hopkins Police Officers hired to assist with the oversight of the event.  The Police Chief/Fire Chief or designee has the ability to direct the event manager to control the level of noise and/or terminate the event at any time.  If needed, submit application for tent permit to Fire Chief and comply with fire code requirements.  Any mobile food units must be licensed by the City Clerk.  Pub 819 agrees to defend and hold the City harmless from claims, demands, actions or causes of actions, of any nature of character, arising out of, or by reason of conduct of the event authorized by such premise extension, including attorney fees and all expenses.  Pub 819 will indemnify the City for all damages that may result to City property, including any portion of Mainstreet, as a result of the event. 9 n
