Metropolitan Council TBRA-TOD Cleanup Grant Application – 325 Blake Road; Beekman (CR2017-131)November 6, 2017 Council Report 2017-131 Metropolitan Council TBRA-TOD Cleanup Grant Application – 325 Blake Road Proposed Action Staff recommends adoption of the following motions: 1. Motion to approve Resolution 2017-070 authorizing an application for the Tax Base Revitalization Account for 325 Blake Road. 2. Motion to approve Resolution 2017-071 authorizing an application for the Tax Base Revitalization Account for 325 Blake Road. Overview The Minnehaha Creek Watershed District owns the Cold Storage site at 325 Blake Road. The primary tenant, Deli Express, will vacate the building at the end of this year. The Watershed District would like to demolish the building as quickly as possible once it is vacant for a number of reasons; foremost being to make way for the City and County’s reconstruction of Blake Road in 2018, which will clip a corner of the existing building. The estimated cost of demolition, site clearance, and soil remediation is $3.66 million. A number of funding sources will be needed in order to complete this work and a number of grants are being pursued. As part of the grant applications resolutions approving the use of grant funds and authorizing Minnehaha Creek Watershed District to apply for these grants are required. The Watershed District is requesting authorization to apply to two grant programs; Hennepin County Environmental Response Fund (ERF) and Metropolitan Council’s Tax Base Revitalization Account funds. If approved funds would be used for asbestos abatement, demolition, and soil remediation at 325 Blake Road. All funds would be provided to the City of Hopkins and Minnehaha Creek Watershed District would be the sub recipient of the funds. Supporting Information Resolution 2017-070 Resolution 2017-071 ___________________________ Meg Beekman Community Development Coordinator Council Report 17-131 Page 2 Financial Impact: $_________Budgeted: Y/N ___ Source: __________ Related Documents (CIP, ERP, etc.): _______________________________________ Notes:_______________________________________________________________ Alternatives The Council has the following alternatives: Approve Resolutions 2017-070 and 2017-071, authorizing application Deny Resolutions 2017-070 and 2017-071, and opt not to support the Watershed District’s applications for grant funding RESOLUTION NO.2017-070 CITY OF HOPKINS,MINNESOTA RESOLUTION AUTHORIZING AN APPLICATION FOR THE TAX BASE REVITALIZATION ACCOUNT FOR 325 BLAKE ROAD WHEREAS the City of Hopkins is a participant in the Livable Communities Act’s Local Housing Incentives Program for 2017 as determined by the Metropolitan Council, and is therefore eligible to make application to apply for funds under the Tax Base Revitalization Account; and WHEREAS the City has identified a contamination investigation project within the City that meets the Tax Base Revitalization Account’s purposes and criteria and are consistent with and promote the purposes of the Metropolitan Livable Communities Act and the policies of the Metropolitan Council’s adopted metropolitan development guide; and WHEREAS the City has the institutional, managerial and financial capability to ensure adequate project and grant administration; and WHEREAS the City certifies that it will comply with all applicable laws and regulations as stated in the contract grant agreements; and WHEREAS the City finds that the required contamination cleanup will not occur through private or other public investment within the reasonably foreseeable future without Tax Base Revitalization Account grant funding; and WHEREAS the City represents that it has undertaken reasonable and good faith efforts to procure funding for the activities for which Livable Communities Act Tax Base Revitalization Account funding is sought but was not able to find or secure from other sources funding that is necessary for completion of the investigation and states that this representation is based on the following reasons and supporting facts: Additional sources of funding have been sought and were either not received or unable to fund the extent of the environmental cleanup costs. NOW THEREFORE BE IT RESOLVED that, after appropriate examination and due consideration, the governing body of the City finds that the City of Hopkins authorizes the Minnehaha Creek Watershed District to submit an application for Metropolitan Council Tax Base Revitalization Account grant funds and, if the City is awarded a Tax Base Revitalization Account grant for this project, the City will be the grantee and agrees to act as legal sponsor to administer and be responsible for grant funds expended for the project contained in the Tax base Revitalization grant application submitted on November 1, 2017. By: ______________________________ Molly Cummings, Mayor Attest: _______________________________ Amy Domeier, City Clerk RESOLUTION NO. 2017-071 CITY OF HOPKINS, MINNESOTA RESOLUTION APPROVING THE USE OF HENNEPIN COUNTY ENVIRONMENTAL RESPONSE FUND FOR 325 BLAKE ROAD WHEREAS the City of Hopkins has partnered with the Minnehaha Creek Watershed District to redevelop the Cold Storage site at 325 Blake Road; and WHEREAS the City of Hopkins together with the Minnehaha Creek Watershed District are seeking funds to assist with the asbestos abatement, demolition, and soil remediation on the site; and WHEREAS the applicant has requested the City’s support in their application for Hennepin County Environmental Response Fund grant funding NOW THEREFORE BE IT RESOLVED that, after appropriate examination and due consideration, the governing body of the City finds that the City of Hopkins approves the use of Hennepin County Environmental Response Fund for 325 Blake Road, for which an application is being submitted by the Minnehaha Creek Watershed District to the Minnesota Brownfields’ Brownfield Gap Financing program funded with an Environmental Response Fund grant from Hennepin County Department of Environmental Services. th Adopted by the City Council of the City of Hopkins this 6 day of November, 2017.
