VII.2. First Reading: Ordinance Amending Chapter 1200.17 of the Hopkins City Code Pertaining to On-Sale 3.2 Percent Malt Liquor Sales; Domeier March 6, 2018 Council Report 2018-036 First Reading: Ordinance Amending Section 1200.17 of the Hopkins City Code Pertaining to On-Sale 3.2 Percent Malt Liquor Sales Proposed Action Staff recommends adoption of the following motion: Move to adopt for first reading Ordinance 2018- 1129, An Ordinance Amending Section 1200.17 of the Hopkins City Code Pertaining to On-Sale 3.2 Percent Malt Liquor Sales. Adoption of this motion will begin the process of amending Section 1200 of the Hopkins City Code to allow for establishments defined as “golf courses” to obtain on-sale 3.2 percent liquor licenses. Overview Minnesota Statute 340A.411 allows cities to issue on-sale 3.2 percent malt liquor licenses to drugstores, restaurants, hotels, clubs, bowling centers, golf courses and establishments used exclusively for the sale of 3.2 percent malt liquor with the incidental sale of tobacco and soft drinks. Staff is requesting that the City Council adopt language adding establishments defined as “golf courses” as a permitted establishment to receive a 3.2 percent on-sale liquor license. The Minneapolis Park Board held an on-sale 3.2 percent malt liquor license for many years at Meadowbrook Golf Course before their clubhouse closed in 2015. They obtained that liquor license because they were defined as a “restaurant”. However, because Meadowbrook no longer has a clubhouse that meets the “restaurant” definition we explored other options for them to obtain a liquor license. The draft ordinance has been reviewed by the City Attorney. A second reading of the Ordinance is tentatively scheduled for March 20. The Minneapolis Park Board plans to apply for the license immediately following the second reading. Primary Issues to Consider  State law allows for this type of license to be issued by the City Supporting Documents  Proposed Ordinance 2018-1129 Amy Domeier, City Clerk CITY OF HOPKINS COUNTY OF HENNEPIN ORDINANCE 2018-1129 ORDINANCE AMENDING SECTION 1200.17 OF THE HOPKINS CITY CODE PERTAINING TO ON-SALE 3.2 PERCENT MALT LIQUOR SALES THE COUNCIL OF THE CITY OF HOPKINS HEREBY ORDAINS AS FOLLOWS: Section 1. That Section 1200.17 of the Hopkins City Code be amended to add the double-underlined material and delete the stricken material as follows: 1200.17 3.2 percent malt liquor, on-sale. An on-sale 3.2 percent malt liquor license may only be issued to drugstores, restaurants, hotels, clubs, bowling centers, and golf courses, where food is prepared and served for consumption on the premises and bona fide clubs, and shall permit the sale of beer for consumption on the premises only. Section 2. The effective date of this ordinance shall be the date of publication.
