2002-110 CITY OF HOPKINS Hennepin County, Minnesota RESOLUTION NO: 02-110 RESOLUTION MAKING FINDINGS OF FACT AND APPROVING A CONDITIONAL USE PERMIT TO CONSTRUCT A FIRE STATION AND AN ADDITION TO THE PUBLIC WORKS FACILITY WHEREAS, an application for Conditional Use Permit CUP02-8 has been made by The City of Hopkins; WHEREAS, the procedural history of the application is as follows: 1. That an application for a conditional use pelmit was made by The City of Hopkins on October 28, 2002; 2. That the Hopkins Zoning and Planning Commission, pursuant to mailed and published notice, held a public hearing on the application and reviewed such application on November 26, 2002: all persons present were given an oppOliunity to be heard; 3. That the written COlmnents and analysis of City staff were considered; and 4. A legal description of the subject property is as follows: Beginning at the intersection of the south line of Excelsior Avenue with the west line of Section 24 thence south along said west line distance 608.12 feet thence east parallel with said south line to the southerly extension of the centerline of 16th Avenue thence south along said extension distance 30 feet thence east parallel with said south line to the southerly extension of the centerline of 15th Avenue thence north to a point distance 272 feet south from south line of Excelsior Avenue as measured along extension of 15th Avenue thence westerly to a point on extension of 16th Avenue distance 248 feet south from south line of Excelsior Avenue thence north to said south line thence west to beginning road. That part of the southwest Y4 of southwest Y4 lying south of north 608.l2 feet thereof mld west of the center line of 16th Avenue extended south also that pmi of the southwest Y4 of southwest Y4 lying south of nOlih 638.27 feet mld west of the east line of 15th Avenue extended south and east of the center lin~ of l6th Avenue extended south excluding rail road right-of-way and street. NOW, THEREFORE, BE IT RESOLVED that the application for Conditional Use Pelmit CUP02-8 is hereby approved based on the following Findings of Fact: 1. That the proposed use meets the requirements for a conditional use pennit. BE IT FURTHER RESOLVED that application for Conditional Use Permit CUP02-8 is hereby approved subject to the following conditions: 1. That the watershed district approves the proposed development. 2. That additional trees are added to comply with the landscaping requirements. 3. That the Public Works department approves the drainage, utility and grading plans.
