RESOLUTION 2002-77
Resolution authorizing the Mayor and City Manager to sign and execute an
agreement with Canadian Pacific Railroad for the construction of permanent
concrete railroad crossing on 5th Avenue South at a cost not to exceed $150,000
WHEREAS, the current rubberized and asphalt railroad crossing at 5th Avenue South has
deteriorated to the point where it is in need of upgrading improvements through the
reconstruction of the roadway crossing by installing a new permanent concrete railroad crossing;
and
WHEREAS, the railroad crossing at 5th Avenue South is controlled by the Canadian
Pacific Railroad; and
WHEREAS, the Canadian Pacific Railroad is needing to perform temporary maintenance
measures on the railway before November 2002, which would necessitate the closing of 5th
Avenue South; and
WHEREAS, City staff is requesting that the railroad crossing be upgraded to a
permanent concrete railroad crossing using any combination ofPIR or TIP funding that may be
available, as these improvements are not assessable under the City's assessment policy; and
WHEREAS, the estimated cost for installation of this permanent concrete railroad
crossing is $150,000.
NOW, THEREFORE, BE IT RESOLVED, by the City Council ofthe City of Hopkil1s,
Minnesota, that the Mayor and City Manager are hereby authorized to sign and execute an
agreement with Canadian Pacific Railroad for the construction of permanent concrete railroad
crossing on 5th Street South at a cost not to exceed $150,000.
