2002-053 CITY OF HOPKINS Hennepin County, Minnesota RESOLUTION NO: 02-53 RESOLUTION MAKING FINDINGS OF FACT AND APPROVING A CONDITIONAL USE PERMIT TO CONSTRUCT A RETAIL AND RESIDENTIAL DEVELOPMENT WHEREAS, an application for Conditional Use Permit CUP02-3 has been made by The Cornerstone Group; WHEREAS, the procedural history of the application is as follows: 1, That an application for a conditional use permit was made by The Cornerstone Group on May 8, 2002; 2. That the Hopkins Zoning and Planning Commission, pursuant to mailed and published notice, held a public hearing on the application and reviewed such application on May 28, 2002: all persons present were given an opportunity to be heard; 3. That the written comments and analysis of City staff were considered; and 4. A legal description of the subject property is as follows: Lots 1-6, Lot 46 and Lot 7, except the southerly 2 feet of said Lot 7, Block 3, West Minneapolis, according to the recorded plat thereof, Hennepin County, Minnesota, NOW, THEREFORE, BE IT RESOLVED that the application for Conditional Use Permit CUP02-3 is hereby approved based on the following Findings of Fact: 1. That the proposed use meets the requirements for a conditional use permit. BE IT FURTHER RESOLVED that application for Conditional Use Permit CUP02-3 is hereby approved based on the following conditions: 1. That the watershed district approves the proposed development. 2. A details sheet must be submitted and approved along with this plan set, The City of Hopkins Engineering Guidelines should be used in developing the details sheet and the guidelines need to be specified and followed on this project. 3. A contractor's guarantee is required on this project and should be specified in accordance with the Hopkins Engineering Guidelines, . 4. A Registered Civil Engineer must sign the Civil Drawings before the City can grant approval. 5. A park dedication fee is required for each unit. 6. That all comments of the Public Works Department as outlined in the memo dated May 21, 2002 shall be met and addressed in future submittals. 7. The Public Works Department reserves the right to continue reviewing any plans submitted for approval and to place new or revised conditions on construction as may be required. All future plan sets must be signed and submitted with revision dates. 8. That the applicant satisfies all conditions and requirements for and obtains final approval of the plat of the subject property, 9. That the subject property is overlaid with a PUD zoning, 10. That the alley is vacated. 11. A detailed traffic control and detour plan must accompany any City street closure submittal. 12. That the trash enclosure is relocated to an area acceptable to staff. 13. That Cornerstone agrees to implement the parking easement letter dated May 14, 2002 to City staff. If at a future date the easements are not implemented or are terminated, Cornerstone agrees to undertake a parking study in accordance to a scope of work acceptable to City staff that will identify how best to address any parking deficiency if any. 14. That Cornerstone agrees to provide the property at 15 Eighth Avenue a temporary bituminous access from Eighth Avenue. If the Lomen's decide that the temporary access will be a permanent access, Cornerstone will construct a permanent concrete access on Eighth Avenue for the property at 15 Eighth Avenue. 15. Any soil retaining system to be installed within the right-of-way must be temporary in nature and removed after installation. Adopted this 4th day of June 2002.
