RESOLUTION MAKING FINDINGS OF FACT AND
APPROVING AN ORDINANCE
REZONING THE MARKETPLACE LOFTS DEVELOPMENT TO PUD
WHEREAS, an application for Zoning Amendment ZN02-5 has been made by The Comerstone
Group;
WHEREAS, the procedural history of the application is as follows:
1. That all application for zoning amendment ZN02-5 was made by The Comerstone
Group;
2. That the Hopkins Zoning and Planning COlllillission published notice, held a
public hearing on the application and reviewed such application on May 28, 2002:
all persons present were given all opportunity to be heard;
3. That the written comments and analysis of City staff were considered; and
4. The legal description ofthe property is as follows:
Lots 1-6, Lot 46 and Lot 7, except the southerly 2 feet of said Lot 7, Block 3,
West Milmeapolis, according to the recorded plat thereof, Helmepin County,
Minnesota.
NOW, THEREFORE, BE IT RESOLVED that the application for Zoning Amendment ZN02-5
is hereby recommended for approval based on the following Findings of Fact:
1. That the overlay distlict is consistent with the Comprehensive Plan.
2. That the underlying zoning of B-3 remains.
BE IT FURTHER RESOLVED that application for Zoning Amendment ZN02-5 is hereby is
approved subject to the following conditions:
1. That the Applicant satisfies all conditions and requirements for and obtains final
approval ofthe plat ofthe subject property.
2. That the Applicant satisfies all conditions and requirements for and obtains final
approval ofthe conditional use penuit for the proposed development.
3. That the alley is vacated.
4. That the ApplicaIlt and the City enter into all agreement that satisfies all the
conditions and requirements for this PUD development.
