A regular meeting of the Hopkins City Council was held on September 16, 1997, in
the Council Chambers of Hopkins City Hall.
Present were Mayor Redepenning and Council Members Maxwell, Jensen, and
Hesch. Also present were staff members Genellie, Johnson and City Attorney
Jerre Miller.
I. CALL TO ORDER
Mayor F~edepenning called the meeting to order at 7:40 p.m.
II. OPEN AGENDA -PUBLIC COMMENTS AND CONCERNS
Tim Hoffman, 237 6~' Avenue North, shared his frustration over the flooding that
was caused by the rain today. Mr. Hoffman asked for more assistance from the
City, especially help with sandbagging.
III. OATH OF OFFICE
1. Human Rights Commission -Dane Dye
•The City Clerk administered the oath of office to Dane, Dye, Human Rights
Commission. The Council welcomed Mr. Dye.

Council Member Jensen moved and Mayor Redepenning seconded a motion to
approve the Consent Agenda. A poll of the vote was as follows: Council Member
Maxwell, aye; Council Member Jensen, aye; Council Member Hesch, aye; Mayor
Redepenning, aye. The motion was carried unanimously.
V. OLD BUSINESS
1. Approval of Shady Oak Beach operations agreement (CR97-162)
Dave Johnson told the Council that at its September 2, 1997, regular meeting,
Council reviewed a draft agreement between the City of Hopkins and the City of
Minnetonka regarding the improvements and maintenance for Shady Oak Beach. A
final agreement was presented for formal review and approval. The final

• agreement included changes that were requested by the Council at the September
' ` 2, 1997, meeting.
Council Member Maxwell moved and Council Member Hesch seconded a motion to
approve a Shady Oak Beach improvements and operations agreement with the City
of Minnetonka. A poll of the vote was as follows: Council Member Maxwell, aye;
Council Member Jensen, aye; Council Member Hesch, aye; Mayor Redepenning,
aye. The motion was carried unanimously. •
VI. NEW BUSINESS
1. First reading, trespassing ordinance (CR97-161)
Jim Genellie told the Council that the Hopkins Police Department is requesting that
changes be made to the current trespassing ordinance to allow a citation to be
issued after a written demand has been received by the person who is trespassing
repeatedly.
A discussion followed.
Council Member Hesch moved and Council Member Jensen seconded a motion to
approve Ordinance 97-803 for first reading. A poll of the vote was as follows:
Council Member Maxwell, aye; Council Member Jensen, aye; Council Member
Hesch, aye; Mayor Redepenning, aye. The motion was carried unanimously.
2. First reading, ordinance regarding sale of liquor and beer (CR97-163)
Jim Genellie told the Council that the current plans for the Hopkins Center for the
Arts grand opening celebration include champagne and a cash bar. As section
1200.29 and section 1210.11 read at this time, that would not be possible. Mr.
Genellie said that these prohibitions have been in the City Code for years and are
no longer relevant.
A discussion followed and Council Member Maxwell asked for more information
concerning the effect of the ordinance before the second reading. Council
Member Hesch asked that a discussion of this item be placed on a work session
agenda soon.
Council Member Maxwell moved and Council Member Jensen seconded a motion
to approve Ordinance 97-804 for first reading. A poll of the vote was as follows:
Council Member Maxwell, aye; Council Member Jensen, aye; Council Member
Hesch, aye; Mayor Redepenning, aye. The motion was carried unanimously.
VII. REPORTS -COMMITTEES/COMMISSIONS
Council Member Hesch said that she had participated in the Apartment Managers
Association meeting with Karsten Elverum. Ms. Hesch said they went on a bus
tour of the apartments and that it was very informative.

' ' Council Member Jensen asked Mr. Genellie if he could update the Council on the
Human Rights Commission. Mr. Genellie said that at the meeting, they watched a
film called "Not in Our Town", a film about hate crimes. The Commission has
authorized the purchase of the film and one other called "Not' in Our Town 11". The
films will be made available for viewing.
VIII. ADJOURNMENT
There being no further business, Council Member Jensen moved and Council
Member Maxwell seconded a motion to adjourn. The meeting was adjourned by
unanimous consent at 8:42 p.m.
