A regular meeting of the Hopkins City Council ras held on .,_
August 16, 1994 in the Council Chambers of Hopkins Cfty
Hall.
Present rare Mayor Redapenninq, Councilme®bsrs Anderson,
Hesch, Rrit~ler and Maxwell. Also present rare staff members
Mielke, Harmening, Gustafson, Kerrigan, Gessela and City
Attorney Jerre Miller.
I. CALL TO ORDER
Mayor Redepenninq called the meeting to order at 8:1a p.m.
II. oPEN AGENDA - PUBLIC ao~n~NTS/CON~:K.~~s
Mike Miller, Hopkins resident, appeared before Council to
voice some concerns he had rith certain types of
businesses. He expressed s desire to cork with the City to
maintain a family oriented atmosphere
Nr. Mielke stated that adult oriented business Ordinances
are being revieNed at the present time. Ha also stated that
the City can regulate but not bar legal business
establ iR~+*~~nts .
Mayor Redepenninq said that perhaps H.B.C.A. could help
businesses present Hopkins in a better light.
Councilmember Hesch said perhaps SCiP could also help to
improve the image.

IV. PRESENTATION
A. RASPBERRY FESTIVAL PROCLAMATION
Dale Specken, President of the Raspberry Festival, presented
the City with a plaque issued by the Governor of Minnesota
in honor of the 60th year anniversary of the Raspberry
Festival. The plaque was presented to the Raspberry Board
during the Festival.
B. PRESENTATION/CONSIDER ACTION - HOYiciHB SCHOOL
DISTRICT ((MSL~IO) AUTHORIZATION OF PROFESSIONAL
(Rpt.94-151)
Lae Gustafson gave a quick introduction on the improvements
proposed for lath Avenue and T.H. 7 intersection. Ha then
introduced Larry Lut$ School District 270 a'ho shoaled the
Council plans for e~cpandinq schools in Hopkins. The schools
era Eisanhaarer Elementary, Alice Smith Elementary and
Katherina Curren Elementary. Ha also thanked the City for
the proposed improvements to the intersection and stated
that the school would work with Mr. Gustafson and staff to
complete the project.
Mayor Redapenninq thanked Mr. Lut$ for updating the City on
the proposed improvements.
Counci~*~~bar Anderson moved and Councilmamber Hasch
seconded the motion to authorise the Mayor and City Manager
to enter into an agro~~nt with Bolton and Mark, Inc. for
Design and Construction services to upgade the T. H. 7 North
Frontage Road at lath Avenue at a cost estimated at
$30,500.00.

Councilmamber Maxwell, Aye; Mayor Radepenninq, Aye. The
motion carried unanimously.
V. OLD BUSINESS
A. CONSIDER ACTION -SECOND READING -AMENDMENT TO THS
NUISANCE ORDINANCE (Memo)
Tom Harmeninq informed the Council that the word permanent
was removed from the definition of graffiti being placed on
permanent structures such as garbage dumpsters, etc.
Counci~~a~t+ar Krit$ler asked if a refuse container was a
permanent structure.

Mr. Mielka read the outline of the Ordinance and Council
decided to amend the ordinance to include "other structural
or equipment".
Counci~~~r-r Hasch moved and Councilmambar Krit$ler
seconded the motion to apprc~rve Ordinance Ho. 94-741 for
second reading and order published with the amendments.
A poll of the vote was as follows: Councilmambar Anderson,
Aye; Councilmember Hesch, Aye; Councilmembar Hritslar, Aye;
Councilmember Maxarell, Aye; Mayor Redepenninq, Aye. The
motion carried unanimously.

Staff ros~mandad adoption of Resolution Ho. 94-74
authoriainq establishment of the following boards:
o Westbrooke Patio Homes Housing Improvements
Area Advisory Board;
o Meadowcreak Housing improvement Area Advisory
Board.
$arlier this year, the City received approval of legislation
allowing for the creation of housing improvement areas
within the City of Hopkins. Tha intent of this legislation
was to allow for the financing of improvements Frith the
various Nestbrook Associations.
Mr. Kerrigan want over the need for Resolution Ho. 94-74 to
be adapted establishing an advisory board for each of the
two neighborhoods.
Councilmember Maxwell requested that the majority Hof the
board members be owner/residents of the property. Ha also
suggested that the City solicit members by using the cable
television, City Hawsletter, etc.
Counci~+~~t~er Haxwell moved and Councilmambar Hasch seconded
the motion to adopt Resolution No. 94-74.

that the Council adopt Resolution No. 94-73 ordering
preparation of Assessment Roll - Miscellaneous Spacial
Assessment, 1994 Alley Improvement Projects.
Councilmembar Hesch moved and Councilmembar Anderson
seconded the motion to adopt Resolution No. 94-73.

Staff recommended adoption of the follorinq motion: Kowa
that Council authorise a revised construction cost as it
relates to the installation of a private fire protection
system at 6a0 16th Avenue South.
Mr. Gessela gent oust the issue with the Council explaining
that the project vent ove r the original cost estimate. He
also stated that the cork vas contracted privately.
Attar discussion Councilmembar Kritsisr moved and
Councilmembar Hesch seconded the notion to approve the
revised constructions costs.

D. CONSIDER ACTION - AMARD OF BID - ALLEY "C" AND
PARKING I~OT 8 (Rpt. 94-154)
Staff recommended that council adopt Resolution No. 94-76
for award of bid, Alley "C" and parking lot improvements.
Mr. Gessale vent over the results of the $ids with the
Council stating that Hardrfves, Inc. vas low bia~ar and
therefore should be awarded the contract.
Councilmambsr Anderson moved and Councilmember Rtitaler

Staff recommended that Council adopt Resolution No. 94-77
approving arard of bid, Hainstraet Improvements to Midrast
Asphalt Corporation.
N'r. Gessele rent over the bids and the cork schedule rfth
the Council.
Councflmember Maxrall moved and Councilmember Anderson
seconded the motion to adopt Resolution No. 94-77.

VII. R$PORTS - COI~IIKITT$BS/COI~IIKISSIONB
Councilmember Hesch said that she is a member of the League
of Minnesota Cities Livable Comsaunities Policy Comaoittee and
that Hopkins is rated very high.
She also said that she had testified at the State
Legislative Commission on Children, Family and Parents.
She had testified as a parent.
Councilmamber Maxrell said that ha had attended the Park
Board meeting and had an update on Maetsold Field and Shady
Oak Beach.
Councilmamber Kritsler stated that he rill ba attending the
Cable Com®ission meeting August 17th.
