A regular meeting of the Hopkins City Council ras held on October
6, 199a in the city Council Chambers of the Hopkins city Hall.
Present rare Mayor Barq, Councilmembers Anderson, Shirley,
l~itsler and Radepanninq. Also present rare staff members

Schadlar and City Attorney Jana Killer.
I. CALL TO ORDER
Mayor Barg called the meeting to order at 7:30 p.m.

Councilmember Shirley stated that item #9, moratorium on
religious institutions, should only apply to chur~ho~. Mr.
Harmeninq said that the staff could look into the language
concerning religious institutions in the soninq code.
Councilmembar Rritsler had a question concerning item #11 so it
ras removed from the consent agenda.
Councilm~~r Anderson moved and Cauncilm~~*• Shirley seconded
the motion to approve the Consent Agenda.

IV. P'QBLIC HEhRING
(a) CONSID~ ACTION - l~ISCR*•T•#NEOUS ASSESS~NTS
Staff reca adoption of Resolution No. 92-77 for the
miscellaneous special assessments.
Nayor Berg eYplainad that this was a continuation of a public
~P~rinq Which began on September 15. Jim Gessele e~cplained that
there had been three appeals.
The first appeal, from lam. Dahlberg, bad been denied by the
Council at its September i5 meeting. Mayor Berg said that 1~.
Dahlberg had talked to him since that meeting. 1~. Dahlberg said
that some of the changes in the ordir_~*:~~s regarding utility
bills were aimed at him. 8e said that he would agree not to
contest future assessments if the past assessments were waived.
No motion was made to naive the assessments.
The second and third appeals concerned service ~~*•qes. John
Schedler •~cplained service charges and the background of these
two appeals.
No one asked to speak at the public ~+~~rinq. Councflmember
Redepenning coved and Councilmember Rritaler seconded the motion
to close the public ~+~~rinq at 7:48 p.m.

After same discussion Councilmsmber Anderson moved and

carried unanimously.
Mayor Berg moved and Councilmember Anderson seconded the motion
to deny the appeal from Lots 4 i 5, Block 56.

Staff reco~nanded adoption of the follarinq motion: AY~rr~ra
Resolution No. 92-71 a~~•~.rinq school Bus parking, Handicap .
Parking, and a 1riTC Bus Stop on South side of l~ainstreet batrean
13th and 14th Avenues.
This motion would allow the construction of School Bus Parking
and Handicap Parking signage, and to allay unrestricted parking.
The motion also Mould allow a reserved space for an lfl'C Bus Stop
if deemed appropriate.
Thomas Cramer appeared from St. Josephs to urge passage of the
resolution. Ha thanked members of their staff for their efforts.
Mayor Barg auplainad that any unrestricted parking spaces ~rould
ba available for any user. lam. Cramer said that ha understood
that.

David 1Cirscht appeared to explain the site plans. Councilmember
Anderson raised questions regarding the landscaping on Tyler
Avenue and the paving of the parking areas.
1~. Rirscht said that EDCO could cork rich city staff on the
Tyler Avenue Landscaping. He also said that EDCO had no plans at
this time to pave the area behind the building on the Tyler
Avenue side.
Councilmember Redepenninq asked a question concerning the boarded
up aindoas in the building on the ~~saer of Tyler Avenue and and
Street. ~. Gustafson, representing EDCO, stated that chile they
intended to fix up that building in the future, they had no plans
to do it at this time.
Resolution No. 9a-83 acs amended to remove the requirement to
pave all unpaved parking areas and to extend the time limit to 9
months.

Staff recoam:e~ndad the follo~ring motion: Move to a~Yr~re
Resolution No. 92-84 a~~~.-inq a conditional use permit to
construct a Z4 unit handicap hausinq building on the northeast
corner of 5th Avenue and and street south.
The resolution acs unanimously approved by the Honing and
Planning Ca~ittee.
Mr. Kerrigan explained the project. Mr. Michael Bjerkesett
appeared to answer questions. Councilmember Redepenninq said
that the Soning and Planning Coeeiission was concerned about the
landscaping of the nee Doe To~rers~ parking lot. The Ca~nission
requested that a site plan be given to them prior to a~Yi~val.
The Council directed staff to do this.
Councilmember Shirley moved and Councflmember Anderson seconded

Staff racaosnandad the follawinq motion: l~ova to a~~~ra
Resolution Ho. 93-87 approving a variance to park in the front
yard setback.
The Hopkins Library is lo~catad at aZ 11th Avenue North. Hennepin
County is proposing to purchase the tvo homes to the north of the
parking area, rase thaw and construct additional parking for the
library.
After discussion the resolution vas amended to require a 3 foot
area on the vest side of the parking lot ba sat aside, and that a
fence ba constructed in this area if needed in the future.
Councilmembar Shirley moved and Councilmembar Anderson seconded

Councilmember Kritsler had a question concerning the amount of
the bicycle fee. Staff `ras instructed to find out more about
this fee and report back to the Council. Resolution No. 9a-78
Nas amended to remove the bicycle fee.
