12-18-90A regular meeting of the Hopkins City Council was held on December 18, 1990 in the City Council Chambers of Hopkins City Hall. Present were Mayor Berg, Councilmembers Anderson, Shirley, Kritzler and Redepenning. Also present were City staff Genellie, Harmening, Thiel, Gessele, Anderson, and City Attorney Jerre Miller. I · CALL TO ORDER Mayor Berg called the meeting to order at 8:03 p.m. II. SPECIAL ORDER OF BUSINESS (a) A special award was made to the Hopkins Police Department by Joanne Bakke of the Triple A for their outstanding record of pedestrian safety. The Hopkins Police Department was one of 440 Cities in the United States selected for this award. The Mayor and Chief of Police Earl Johnson accepted the award. (b) The Mayor read a certificate of appreciation to Dan Dillon, the manager of Red Wing Shoe Store who is retiring. Mayor Berg thanked him for his dedication in keeping the store in .Hopkins and his continuous support of the downtown business area. (c) Mayor Berg read a certificate of appreciation to Jon Thiel for his service to the City of Hopkins for the last four plus years. Jon is moving on to the City of Brooklyn Park to take over the position of Public Works Director. The Council thanked him and wished him well. III. CONSENT AGENDA · · · · · 10. APPROVAL OF GAMBLING LICENSE APPLICATION - AMERICAN LEGION Councilmember Redepenning moved and Councilmember Shirley seconded the motion to approve the Consent Agenda. A poll of the vote was as follows: Councilmember Anderson, Aye; Councilmember Shirley, Aye; Councilmember Kritzler, Aye; Councilmember Redepenning, Aye; Mayor Berg, Aye. The motion carried unanimously. IV. NEW BUSINESS (a) CONSIDER ACTION - BID AWARD - LANDFILL REMEDIATION Staff recommended' the following motion: Move that Council adopt Resolution No. 90-153, for award of bid - Landfill Gas REMEDIATION Project~ Bids were opened on December 12, 1990. The apparent low bidder is Ames Construction, Inc. RCM and Associates have checked the bids and reviewed the qualifications of Ames Construction, Inc. They find that the company has the experience and equipment to complete the project in a timely manner. Jim Gessele and Costa Dimitracopoulos, Engineer from RCM updated the Council on the project. (1) A physical barrier will be placed between the landfill site and the homes. (2) All waste materials will be removed between the landfill site and the homes. Ail hazardous material will be removed from site. A safety contingency plan has been developed should any unexpected emergency arise at the site After discussion Mayor Berg asked if anyone in the audience would like to address the Council. Leslie Davis appeared before Council stating he is a representative of twelve of the homeowners at the Westbrooke Patio Homes. Mr. Davis claims that 70% of the methane has dissipated from this site and could be completely dissipated in a short time. He claimed that the work should not be done at this time. He felt ~hat the danger to the residents was paramount and that they should be relocated before any work was begun. Jim Gessele .informed the Council that a meeting with the Westbrooke Town Homes Association is scheduled for Wednesday, December 19, 1990 in the Council Chambers to update them on what remedies are being planned. December 18, 1990 Page 3 After discussion Councilmember Shirley moved and Councilmember Redepenning seconded the motion to adopt Resolution 90-153. Mayor Berg requested that Council be apprised with weekly updates and special updates when necessary. A poll of the vote was as follows: Councilmember Anderson, Nay; Councilmember Shirley, Aye; Councilmember Kritzler, Aye; Councilmember Redepenning, Aye; Mayor Berg, Aye. The motion carried. (b) CONSIDER ACTION - SPECIAL LEGISLATION - LANDFILL REMEDIATION Staff recommended adoption of the following motion: Move to approve the special legislation to finance landfill redmediation and to authorize staff to proceed with the legislative effort. , Adoption of this motion would allow staff to work with the State Legislature in drafting and, hopefully, adopting special legislation giving the City authority to collect revenues from various sources in order to pay for the remediation efforts at landfill sites. After discussion Councilmember Kritzler moved and Councilmember Redepenning seconded the motion to adopt the motion to allow City Staff to seek special legislation to help defray the costs for the remediation efforts of the landfill sites. A poll of the vote was as follows: Councilmember Anderson, Aye; Councilmember Shirley, Aye; Councilmember Kritzler, Aye; Councilmember Redepenning, Aye; Mayor Berg, Aye. The motion carried unanimously. (c) CONSIDER ACTION - RENEWAL OF LIQUOR LICENSES Staff recommended adoption of the following motion; Move that the Hopkins City Council approve the annual renewal of liquor licenses. Kirby Payne of Hospitality Employee's, Inc. appeared to apprise the Council of the present situation at the Hopkins House. The Council wished him success with this endeavor. Councilmember Redepenning moved and Councilmember Anderson seconded the motion to approve the liquor licenses. The motion carried unanimously. (d) DISCUSSION - TRUTH IN HOUSING ORDINANCE Tom Anderson, Building Official informed the Council of the progress on studying issues pertaining to a truth in housing ordinance. Staff was also requesting further direction from the City Council to be used in the continued development of a draft ordinance. Mayor Berg stated that he is concerned about protecting prospective buyers of property in the City of Hopkins. After listening to the report, Mayor Berg and the Council concurred with the recommendations made by staff and asked Mr. Anderson to continue to further develop the draft ordinance and meet with them at a worksession at a later date. Ve PUBLIC COMMENTS/COMMISSIONS Councilmember Anderson complimented the Hopkins Jaycee's and the City Merchants for the beautiful and outstanding job they have done in decorating the City of Hopkins for Christmas. He also wished everyone a Merry Christmas. Mayor Berg commented on the huge success of the grand opening of the Ice Pavilion. VI. REPORTS - COMMITTEES/COMMISSIONS There were no reports.
