08-16-05A regular meeting of the Hopkins City Council was held on August 16, 2005, in the
Council Chambers of the Hopkins City Hall.
Present were Mayor Maxwell and Council Members Brausen, Thompson, Johnson,
and Rowan. Also, present were staff members Getschow, Stadler, Kerrigan, Harkess,
Anderson, and City Attorney Jerry Steiner.

Mayor Maxwell called the meeting to order at 7:31 p.m.

Council Member Brausen moved and Council Member Johnson seconded a motion to
approve the Consent Agenda. A poll of the vote was as follows: Council Member
Brausen, aye; Council Member Thompson, aye; Council Member Rowan, aye; Council
Member Johnson, aye; Mayor Maxwell, aye. The motion carried unanimously.
V. NEW BUSINESS
1. Resolution to Continue Utility Franchise Fees (CR2005-1 14)
One additional form of revenue that was adopted in 2004 to balance the budget after
the loss of Local Government Aid was the franchise fee on gas and electric utilities.
The original ordinance was written with a sunset clause that would terminate the
franchise fees after a given number of years unless the Council chose to continue the
fees. This ordinance would continue the franchise fees.

Council Member Thompson moved and Council Member Rowan seconded a motion to
adapt Ordinance 2005-949 for first reading. A poll of the vote was as follows:
Council Member Brausen, aye; Council Member Thompson, aye; Council Member
Rowan, aye; Council Member Johnson, aye; Mayor Maxwell, aye. The motion carried
unanimously.
The City Council went into closed session to discuss pending litigation regarding the
Advantage Media billboard lawsuit at 7:35 p.m.

The City Council went into regular open session at 8:10 p.m.
3. Emergency Adoption of Ordinance Amendments, Sign Ordinance (2005-
1131
At the August 3, 2005 City Council Meeting, the City Council declared an emergency
because of a preliminary injunction on the enforcement of the sign ordinance. The
City Council then adopted an emergency interim sign ordinance placing a moratorium
on all signs in excess of six square feet of surface area. Staff and City Attorneys
have now drafted an ordinance amending the sign ordinance.
Council Member Thompson moved and Council Member Rowan seconded a motion to
adopt Resolution 2005-075, approving the preamble to proposed Ordinance 2005-
954, declaring an emergency necessitating the repeal of the Ordinance 2005-954 and
all previous ordinances regulating the construction, installation, and maintenance of
signs in the City of Hopkins and approving the preamble to proposed Ordinance 2005-
955, declaring an emergency necessitating the adoption of a comprehensive,
constitutionally sound ordinance regulating the construction, installation, and
maintenance of signs in the City of Hopkins. A poll of the vote was as follows:
Council Member Brausen, aye; Council Member Thompson, aye; Council Member
Rowan, aye; Council Member Johnson, aye; Mayor Maxwell, aye. The motion carried
unanimously.
Council Member Johnson moved and Council Member Brausen seconded a motion to
adopt emergency ordinance 2005-956,for the Purpose of Protecting the Health,
Safety, and Welfare of City Residents and for Repealing the Existing Emergency
Interim Ordinance Regulating the Construction, Installation and Maintenance of Signs
and all Previous Ordinances Regulating the Construction, Installation and Maintenance
of Signs. A poll of the vote was as follows: Council Member Brausen, aye; Council
Member Thompson, aye; Council Member Rowan, aye; Council Member Johnson,
aye; Mayor Maxwell, aye. The motion carried unanimously.

Council Member Brausen moved and Council Member Rowan seconded a motion to
adopt Ordinance 2005-955, an Emergency Ordinance for the Purpose of Protecting
the Health, Safety, and Welfare of City Residents and for Regulating the Construction,
Installation and Maintenance of Signs. A poll of the vote was as follows: Council
Member Brausen, aye; Council Member Thompson, aye; Council Member Rowan, aye;
Council Member Johnson, aye; Mayor Maxwell, aye. The motion carried
unanimously.
VI. ADJOURNMENT
There being no further business, Council Member Brausen moved and Council Member
Johnson seconded a motion to adjourn the meeting. The meeting was adjourned by
unanimous consent at 8:15 p.m.
