06-21-05• A regular meeting of the Hopkins City Council was held on June 21, 2005, in the
Council Chambers of the Hopkins City Hall.
Present were Mayor Maxwell and Council Members Brausen, Thompson, and
Rowan. Also, present were staff members Getschow, Genellie, Stadler, Kerrigan,
and City Attorney Jerry Steiner.
I. CALL TO ORDER
Mayor Maxwell called the meeting to order at 7:37 p.m.
II. OPEN AGENDA -PUBLIC COMMENTS AND CONCERNS
There were none.
III. OATH OF OFFICE
The City Clerk administered the oath of office to Kari Kyllo, Park Board.
IV. PRESENTATION
1. Hopkins Raspberry Festival
Charlie Yunker came forward and announced that the Raspberry Festival will be
held from July 7th through the 17th. There will be a carnival from July 13th through
the 17th. The carnival will be held on St. Joseph's lot. The carnival will have their
own clean up and security.
2. Hopkins Youth Hockey Association
John Anderson stated that they had a S 1000 contribution from charitable gambling
for the City. Mr. Anderson stated that he had spoken with Chief Reid. Chief Reid
indicated that the Police Department had a need for a dummy that would cost
$1000. Mr. Anderson stated that the Association would like the money to be used
for the purchase of the dummy for the police department. Mr. Anderson
introduced the new association president, Brady Bizal. Mr. Bizal presented a check
for S 1000 to Mayor Maxwell.
V. REPORTS -COMMITTEES/COMMISSIONS

• Bert Schmidt reported that Ted Duepner reported on the annual "School's Out"
event. Michael Borowiak reported on the canine search. The dog hit on 12 to 14
cars. The canine searches may need to be done more often. "Reduce the Use" is
in a holding pattern, waiting to find out abut funding from two federal grants that
Mr. Borowiak has submitted. The Commission discussed the alcohol and tobacco
crime statistics and what information they hope to get out of the statistics. Kathy
will invite the Drug Task Force Officer to come and speak to the Commission at the
September meeting. The August Chemical Health Commission meeting will be
cancelled. The Commission discussed the Mac's Liquor hearing and penalties.
They also discussed membership. They will lose two high school students with
graduation this year.

Council Member Brausen moved and Council Member Thompson seconded a
motion to approve the Consent Agenda. A poll of the vote was as follows: Council
Member Brausen, aye; Council Member Thompson, aye; Council Member Rowan,
aye; Mayor Maxwell, aye. The motion carried unanimously.
VII. PUBLIC HEARING
1. TIF District1-3 (Block 64) (CR2005-082)
Over the last several months, staff and the City Council have been working with a
developer to undertake a redevelopment project on the block bounded by 5th and 6th
Aves, north of Mainstreet and south of 1St St N (Block 64). The proposed project
would consist of approximately 220 condominium-housing units and 8,800 square-
feet of retail space. The City is also in discussions with another developer
regarding a redevelopment project between portions of 6th and 8th Avenues, north
of Mainstreet and south of 1St St N.
TIF District 1-3 would encompass several parcels between 5th Ave and 8th Ave,
north of Mainstreet and south of 1St ST N. The proposed district would be a
redevelopment district. A study by LHB determined that the subject area meets

statutory qualifications for this type of district. The establishment of the district
does not obligate the City or HRA to provide tax increment assistance.
The Zoning and Planning Commission determined that the proposed district is in
conformance with the Comprehensive Plan and recommended approval.
Sid Inman, Senior Vice President, Ehlers and Associates, came forward and stated
that there are two actions that need to be taken. The first action would be to
create the district. The second action would be to consider a redevelopment
agreement. The only action before the Council tonight is the action to create the
district. Mr. Inman answered questions.
Mayor Maxwell opened the public hearing at 7:55 p.m.
Bradley J. Gunn, attorney for Mr. Rixmann who is a property owner in the area of
the proposed district came forward. Mr. Gunn gave the Council several handouts.
Mr. Gunn stated that they would like the City Council to continue the item to give
them more time to review the information, as they were not provided with key
documents on a timely basis. Mr. Gunn stated that in his opinion, the block
64/GPS project fails the "but for" test for the use of TIF; that the proposal to use
TIF is unlawful because the project is not primarily for a public purpose and
because over 50% of the properties are not structurally substandard.
City Attorney Jerry Steiner stated that a lot of material was presented and that if
the City Council would like time to review the information, they could continue it to
the next meeting. Mr. Inman and Mr. Kerrigan concurred that the City Council did
not need to act on the item at this time.
Council Member Brausen moved and Council Member Rowan seconded a motion to
close the public hearing. The public hearing was closed by unanimous consent at
8:20 p.m.
Council Member Brausen moved and Council Member Rowan seconded a motion to
continue the item for action to the July 5th meeting. A poll of the vote was as
follows: Council Member Brausen, aye; Council Member Thompson, aye; Council
Member Rowan, aye; Mayor Maxwell, aye. The motion carried unanimously.

There being no further business, Council Member Brausen moved and Council
Member Thompson seconded a motion to adjourn the meeting. The meeting was
adjourned by unanimous consent at 8:24 p.m.
