MINUTES
CITY COUNCIL WORK SESSION -MARCH 1, 2005
A work session of the Hopkins City Council was called to order by Mayor Gene
Maxwell at 6 p.m. on Mazch 1, 2005, at the City Hall.
Present: Mayor Gene Maxwell, Council Members Rick Brausen, Diane Johnson, Bruce
Rowan, and Jay Thompson, City Attorney Jerry Steiner, Planning & Economic Development
Director Jim Kerrigan, Housing and Development Coordinator Kersten Elverum, Bob Deike
of Bradley &Deike, and Dan Wilson of Wilson Development Services
Block 64 Project:
Mr. Kemgan provided an overview of the eminent domain process and the status of
property acquisition by GPS Financial Group for the Block 64 redevelopment project. Mr.
Kerrigan stated that GPS has control of all the properties on this block except those owned by
Fifth Avenue Partnership (Pazk Plaza). He also stated that GPS said they are moving more
toward the possibility that the city will need to use its eminent domain authority to secure
ownership of this property. Mr. Kerrigan stated that prior to undertaking any eminent domain
process for this project, a development agreement would need to be executed and all
conditions of that agreement would need to be satisfied.
Mr. Kerrigan further stated that in proceeding with eminent domain, the developer
would need to provide payment to the city in an amount equal to the estimated total
acquisition price and relocation costs.
Dan Wilson of Wilson Development Services stated that once eminent domain is
instigated, the residents of Pazk Plaza would be eligible for relocation payments. Mr. Wilson
also outlined various timing issues as relate to relocation.
Mr. Kerrigan stated that there aze presently court cases at both the federal and state
levels dealing with eminent domain. He stated that the outcome of these cases could impact
the city's ability to use the eminent domain process. Bob Deike of Bradley &Deike
discussed legal challenges of eminent domain. He stated that if they occurred they would
probably be on public purchase and/or the findings as relate to the establishment of the tax
increment district.

Mr. Thompson moved, Mr. Rowan seconded, to adjourn the work session. The
motion was approved unanimously. The meeting adjourned at 7:12 p.m.
