Approve Construction Management Services Agreement — Hopkins City Hall
Addition/Remodel Project
Proposed Action
Staff recommends adoption of the following motion: Move that Council approve a construction
management services agreement with Kraus-Anderson Construction Company to provide
construction management services related to the City Hall Addition/Remodel project and
authorize the City Manager to execute the agreement in the amount of $295,265.00
Overview
On June 5, City Council approved the City Hall project schematic design and authorized
design development and construction documents. City staff has recently solicited
proposals for construction management services for our City Hall Addition/Remodel
project and received six proposals. The review committee reviewed and scored the
proposals and selected Kraus-Anderson and RJM Construction as finalists for
interviews. Although both firms are experienced and qualified, the committee has
selected Kraus-Anderson based on a number of factors; including their experience
working with the project architect on similar city hall projects; an experienced and
capable project team; a reasonable cost proposal; their thoughtful, comprehensive and
detailed input via their proposal and interview regarding the various elements and
expected challenges of our unique project. In fact, Kraus-Anderson submitted the
lowest cost proposal for CM services. Their CM fee is 1.99% of construction cost. The
CM agreement will be an AIA A133-2009 document — Standard Form of Aqreement
Between Owner and Construction Manaqer — At Risk. It will be the same form of
agreement as reviewed and approved by the City Attorney for our Hopkins Pavilion
project.

HOPKINS CITY HALL ADDITION AND RENOVATIONS

Background
The City of Hopkins (City) is requesting proposals from selected firms for construction management
services for the renovation of the existing Hopkins City Hall. The work includes a small addition and
remodeling. Work includes renovation of the City Hall portion of the facility, a small addition for a front
entrance/vestibule area and a potentially a new roof (Project). The Project will add approximately 300
SF of new space. Refer to schematic floor plan attached to this RFP. The decision to bring on a
Construction Manager (CM) is to assist with design development and facilitate the cost exploration and
sequencing of work for the efficient and proper allocation of the available funds while maintaining
citywide services. The CM will be part of an integrated team to assure that the Project scope of work
and the goals of the City are properly aligned through the design process. Wold Architects and
Engineers of St. Paul, MN has been selected as the Project Architects.
Invitation
This RFP consists of six pages and attachment documents included by reference. Four copies of the
proposal are to be delivered in person or by certified/ express mail to City of Hopkins, City Hall, 101015t
Street South, Hopkins, MN 55343. To be considered, all proposals must be received by 130 p.m. on
June 28, 2018. Proposals submitted by fax or by electronic mail will not be considered. The City of
Hopkins reserves the right to waive any technicalities and accept or reject any or all proposals at its
discretion.
The Services
CM services to be provided to City include complicated scheduling and coordination for multiple bid
packages. The attached schematic plans, schedule, and renderings define the Project scope and
schedule. Project delivery must al�ow the City to maintain operations including the City's general
election schedule. The preliminary budget for construction is $3mm with a Project cost of $3.5mm. The
City anticipates that the plan will be modified during the design phases. The design team is currently in
the design development phase. The bid package is anticipated to be ready for distribution sometime
between late October and early November.
The CM will assist with completion of the design development phase and the determination of which
Project work will benefit from different scheduling and bid packaging opportunities.

The City expects communication to be maintained through regularly scheduled meetings with written
meeting minutes to keep everyone apprised of the Project activities from early planning meetings to the
final punch list item. Communication skills are essential since many of the materials in the planning and
implementation phases are funneled through two points of contact: the CM, manager of the
construction team, and the Architect, manager of the design team. Both entities are hired as the City's
representatives and will endeavor as a team to protect the City's interests.
The City does not intend that the CM and Architect partner but rather that they provide independent
services to the City and thereby offer checks and balances in maximizing facility improvement funds
while retaining buildings of high quality. The approaches to CM services include the following concepts:
• The CM offers a perspective on cost / quality/ and value to provide the City with the best
information possible in the development of building programs
• The CM acts as Owner's representative in the field during construction
• The Project allows inclusion of smaller, local contractors since the Project is broken down into
numerous small projects
• Multiple bid packages can be implemented and managed to "fast-track" a work scope.
• Added CM experience helps identify lead time concerns and cost control methods during the
design process
• The CM has primary responsibility on the budget and Project delivery schedules during the
implementation phases
While price is a factor, this is not solely a price competition. The City's selection will be based upon
qualifications and experience with similar projects, in addition to price. The City will evaluate proposals
and enter into negotiations with the highest scoring respondent based upon the combined scores of the
evaluation of the proposals and reference checks. The City reserves the right to conduct interviews if
desired. A tentative schedule for proposals and selection is as follows:
• Publication of RFPs: June 8, 2018
• Submission of Proposals To City: June 28, 2018
• City Reviews Proposals, Forms of Agreement: July 2-6, 2018
• Committee Interviews (if City desires): July 12, 2018 2PM-3 PM
• Committee Recommendation and Council Action: luly 17, 2018
The proposals should be broken down into two phases including, 1) preconstruction and bidding
services and 2) construction and post construction services. The anticipated contract period will be from
the date of the City-CM agreement construction is completed, provided, however, that the City will
reserve its right to ruminate for cause or for convenience in the agreement.

The following goals reflect the purposes for which the City has elected to seek CM services:
o To develop, manage and complete the project within a defined time schedule.
o To develop, manage and complete the project within a given budget.
o To develop, manage and complete the project within quality and program guidelines.
The City will consider in this RFP process whether to go forward with the CM during the construction
phase as a CM at risk or a CM advisor as structured within the AIA contract documents.
Contract Award
The firm awarded the Project shall be a CM firm with its headquarters in the State of Minnesota or be
registered to provide such services within the State of Minnesota. The selected CM firm must have
demonstrated expertise in site work/design estimating, and project management without the use of
additional subcontractors with such ability.
The City intends to review all respondents' qualifications and proposals conscientiously and award the
contract based upon selection criteria described in this RFP. The City may enter into negotiations with
any of the firms until a contract sum can be finalized with the successful candidate. If the City cannot
arrive at a satisfactory agreement with a candidate, the City reserves the right to end negotiations with
that candidate and pursue negotiations with the City's next CM choice.
The form of Contract will be an AIA Contract Document as identified in this RFP for CM at risk or CM
advisor. The RFP does not commit the City to enter into an agreement with any of the proposing firms
and the City reserves the right to reject all proposals and re-publish an RFP.
While award of this proposal is based on stated selection criteria, the City will not consider paying any of
the costs associated with develo�ing and pr�senting this proposal. Firms �re encouraged to prepare
fees and cost schedules based on the criteria established and the scope of services outlined within this
document because the City intends to enter into negotiations to finalize an agreement so that the
recommendation for award can be presented as quickly as possible.
Please provide estimated fees and cost schedules as part of the submittal package.
Contract between the Owner and Construction Manager
The STANDARD FORM OF AGREEMENT BETWEEN OWNER AND CONSTRUCTION
MANAGER as CONSTRUCTOR (printed AIA Document A133-2009) will be used as the basic contract for
construction management services.
The Owner reserves the right to make modifications to this document. In the event of any conflict
between the terms and conditions stated in any amendments and those in any part of AIA
Document A133 - 2009, the amended document shall supersede the AIA Document A122 - 2009 and
shall govern in all respects.

Wold Architects and Engineers has provided an agreement to the Owner (City of Hopkins) using the
EJCDC Format, EJCDC E-500 Standard Form of Agreement Between Owner and Engineer for Professional
Services.
The CM proposal and form of agreement must be compatible to avoid conflicts in
the agreements that might be cause for renegotiation of any previously approved agreements.
The CM is not eligible to bid onProject construction work.
Submittals and Requirements
It is intended that proposals be brief. However, proposals must provide the following minimum
information in all bound proposals and it is preferred that the information be provided in the following
general order:
Cover Page:
a. Identify the name of the Project
b. Company Name, Address, Phone & Fax Numbers, Contact Person, voice telephone,
fax telephone, and e-mail address.
Part I: Business Organization and History
a. Brief history of the firm, including listing of principal officers, corporate structure, and
ownership type. Identify the number of years the firm has provided similar construction
management services.
b. Identify other services your firm presently provides, besides construction management, under
the name stated above or any other name. Identify construction services and/or other services,
you provide as agency construction manager.
Part II: Team Identification
a. Identify key staff, consultants, and positions for each of the phases proposed for this work.
Include basic and brief resume' information focusing on project experience that enhances
qualifications for this work.
b. Identify project availability during the work and any Project conflicts based upon other work
or project commitments.
Part III: Key Qualifications and Approach
a. Based upon your knowledge of the proposed work, describe why the City of Hopkins should
team with your firm this Project. Key reasons may include some of the essential process items
listed below.
b. Briefly, how do you propose to administer this project?
Part V(Cost Proposal) shall include your firm's cost proposal under both 1) the CMar, including
the methodology and criteria your firm uses to formulate a CM Guaranteed Maximum Price
("GMP"), which shall include the fee for CM services and all other fees, and 2) the CMad fee for
services. For the CMar proposal please state whether your firm intends to bid for certain work

scopes or whether the CMar services will not include bidding for work and explain why your firm
intends to bid or not bid for work as the CMar.
Part IV: Project Examples, Supplemental Information
a. Briefly, utilize this portion of the proposal to�identify those "value-added" qualities,
conditions, services, or attributes of your proposal that enhance or support the proposal
docu ment.
b. Letters of recommendation might also be provided as well as project examples or project data
sheets.
Part V: CM at risk and CM as advisor
Proposals must include a discussion of the firm's experience with projects as a CM at risk with a
6uaranteed Maximum Price (CMP) as well as serving as a CM advisor. Proposals should discuss
the advantages and disadvantages of each method for public projects, for both the CM and
public owner. The City reserves the right to use either method and notes that the City reserves
the right to defer the final decision whether to go forward with a CM at risk or CM advisor
Project delivery after contractor bids are submitted to the City and the CM has submitted its
GMP proposal. The proposal should also discuss the ability of the firm to continue as CM
advisor if the City does not accept the firm's GMP proposal. The CM is not eligible to bid on the
Project construction work or otherwise perform the work.
Part V: Cost Proposal
a. Please outline your firms not to exceed staff cost, not to exceed CM Fee expressed as a dollar
amount, and not to exceed reimbursable expenses expressed as a dollar amount, and any City-
CM as CM at risk Project cost savings proposals to which the firm is willing to commit.
b. Please note the number of hours you will allocate per week toward onsite supervision during
the construction phase.
c. Please separate the costs as stated in V.a. above into two phases; preconstruction/bidding
services and construction/post construction serv9ces.
d. The City of Hopkins may select either a CMar or a CMad project delivery for this Project.
Accordingly, please provide a summary of the advantages and disadvantages to the City of
Hopkins each of these delivery methods provide for this Project.
