RESOLUTION NO: 2018-061
A RESOLUTION APPROVING THE FINAL
PLAT OF SANCTUARY AT OAK RIDGE
WHEREAS, on April 27, 2018, Anderson Engineering of Minnesota, LLC, on behalf of
Airborne Construction One, LLC (collectively, the "Applicant"), made application for final plat
approval of Sanctuary at Oak Ridge; and
WHEREAS, the subject property is legally described as Lot 2, Block 1; and Outlots A &
B, all in Oak Ridge Place 2nd Addition, Hennepin County, Minnesota(the "Property"); and
WHEREAS, City staff has completed a review of said application and made a report to
the Hopkins Planning &Zoning Commission, a copy of which has been updated and presented to
the City Council; and
WHEREAS, on May 22, 2018, the Hopkins Planning&Zoning Commission, pursuant to
proper notice, held a public hearing on the application and following said public hearing
recommended approval of the application; and
WHEREAS, on June 18, 2018, the City Council adopted Resolution 2018-056, which
approved a comprehensive plan amendment and re-guided the Property from high density
residential to low density residential; and
WHEREAS,on June 18,2018,the City Council also adopted Resolution 2018-058,which
approved the preliminary plat of Sanctuary at Oak Ridge, and said Resolution 2018-058 is
incorporated herein by reference, along with all of its recitals, findings, terms, conditions and
approvals, as if fully set forth herein; and
WHEREAS, on July 17, 2018, the City Council adopted Ordinance 2018-1133, which
effectuated a rezoning of the Property from R-5 (High Density Multiple Family)to R-1-D(Single
Family Low Density) with a Planned Unit Development; and
WHEREAS, based upon the procedural history, staff comments and analysis, and the
recommendations provided, the City Council hereby finds that the final plat for Sanctuary at Oak
Ridge meets the requirements of the Hopkins City Code and its Comprehensive Plan, as amended,
and further finds that approval of the final plat, subject to the conditions outlined below, is
warranted.
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Hopkins
as follows:
1. The recitals set forth above are incorporated into this Resolution as if fully set forth herein
and,where applicable, constitute the findings of the City Council.

2. That the final plat for Sanctuary at Oak Ridge is hereby approved, subject to the following
conditions:
a. Satisfactory completion of all recitals, findings, terms and conditions set forth in
Resolution 2018-058,which is incorporated herein by reference as if fully set forth
herein.
b. Approval of the City's Comprehensive Plan amendment of the Property to low
density residential by the Metropolitan Council.
c. The Applicant shall enter into a development agreement with the City and execute
a planned unit development agreement, which shall both be in a form and of
substance acceptable to the City, and all requirements contained in said
development agreement shall be satisfied.
d. The Applicant shall address and conform to all conditions and requirements of the
City Engineer, including, but not limited to, those provided in the June 18, 2018
staff report and the July 7, 2018 engineering memorandum.
e. The Applicant shall address and conform to all requirements of the Minnehaha
Creek Watershed District, including, but not limited to, the requisite wetland
approvals and delineations summarized in the July 17, 2018 staff report.
f. The Applicant shall submit current title work for the plat and shall conform to any
requirements resulting from City staff and the City Attorney's review of the title
work and plat opinion.
g. The Applicant shall form a homeowner's association to manage and maintain
shared amenities and common areas,including the requisite shared access,in a form
satisfactory to both City staff and the City Attorney.
h. The Applicant shall pay to the City all applicable fees and expenses incurred by the
City as related to the development.
i. Except as otherwise expressly authorized by City resolution or ordinance, all
aspects of the development shall comply with all applicable state laws, city codes,
ordinances, and regulations.
3. The Mayor and City staff are hereby authorized and directed to take all necessary action and
to execute all appropriate documents, including but not limited to this Resolution and the
aforementioned development agreement presented on this date, to effectuate the transaction
contemplated by this Resolution.
4. The Mayor,City staff and City consultants are hereby authorized and directed to take any and
all additional steps and actions necessary or convenient in order to accomplish the intent of
this Resolution.

5. This Resolution shall become effective immediately upon its passage and without
publication.
