09-24-1985 A regular meeting of the Hopkins Zoning & Planning Commission was held
on Tuesday , September 24 , 1985 , at 7 : 30 p .m . , in the Council Chambers of the
City Hall .

' resent were Chair Folk , members , Berg, Bourne , Janke and Kirscht . Brandon & Shirley
were absent . Also present were City Engineer Strojan , Community Development
Director Kerrigan and Community Development Analyst Anderson .
Item: APPROVE AND SIGN MINUTES OF THE AUGUST 27 , , 1985 MEETING.
Ms . Bourne moved and Mr. Janke seconded the motion to approve and
sign minutes of the August 27, 1985 meeting. The motion carried
unanimously .
Case # REQUEST FROM WALSER LEASING OF 317 MAINSTREET FOR AN EASEMENT TO
85-39 PLACE A SIGN IN THE PUBLIC RIGHT-OF-WAY.
Mr . Kirscht moved and Mr . Janke seconded the motion to continue
this item per request from the applicant . The motion carried
unanimously .
Case # HEARING TO CONSIDER REZONING THE Wz OF THE SW4 OF THE SW4 OF
85-40 SECTION 25 , TOWNSHIP 117 , RANGE 22 , FROM R-6 RESIDENTIAL TO B-1
BUSINESS .
` The Commission was presented with a letter from the attorney of
Berglund/Johnson requesting a continuance of this item to allow
them to come in with a plan showing what they would propose to do
with their portion of this land .
The Commission discussed whether the rezoning issue should be
separate from a review of their plan and should be acted on ,
rather than continued . Donald Taragas of 1309 Landmark Trail
stated that he would object to residential because of the
congestion in the area.
Mr . Berg moved and Mr . Janke seconded the motion to continue this
item to the next meeting, allowing Berglund/Johnson to appear for
a concept review and to ask the City Attorney for a written
opinion regarding the zoning issue prior to the meeting. The
motion carried . Bourne and Folk voting no .
Case # HEARING TO CONSIDER AN APPLICATION BY NAEGELE OUTDOOR ADVERTISING
85-48 FOR A VARIANCE TO ERECT A BILLBOARD 15 FEET OVER THE MAXIMUM
ALLOWABLE HEIGHT . . . . . TO BE LOCATED SOUTH OF COUNTY ROAD 3
— AND EAST OF COUNTY ROAD 18 .
Mr . George DeGideo , representing Naegele Signs , appeared before
the Commission . He stated that the sign they were requesting
would be located 15 feet north of the track farthest to the
north , 20 feet from County Road 18 overpass , south of County
Road 3 , south of Hopkins depot on the railroad right-of-way .
The sign would be a two faced advertising sign 10 ' x 25 ' . The
advertising space would be changeable . The property is leased for
10 years and the sign would be lighted with halogen lights .
The present City Ordinance does not address the matter of signs
being constructed in railroad right-of-ways .
Mr . Berg moved to recommend to Council approval of the variance
to construct a sign 35 ' in height based upon the height of
highway 18 that makes a variance necessary to make the sign
visible with the following conditions : ( 1 ) that the sign not be
larger than a two face sign , 10 feet by 25 feet ( 2 ) that it be
subject to review in 10 years , based upon the length of the
existin� lease and that it provide either a directional signal or
'� notation "Hopkins" with the wordin� to be worked out with the
staff . The motion died for lack of a second .

Mr . Janke moved and Ms . Bourne seconded the motion to recommend
to Council that they deny the request for the variance . The
motion carried with Mr . Berg voting no .
Mr. Janke stated his reason for denial would be because of the
nature of the advertising and the proximity to the core of the
city . Ms . Bourne stated she seconded the motion because of no
control of content .
Mr . Berg stated that he did not believe the Commission had the
authority to control the content of the billboard .
Case # HEARING ON AN APPLICATION BY ST . THERESE HOME INC . FOR A VARIANCE
85-49 TO ALLOW PARKING WITHIN THE 30 FOOT FRONT YARD SETBACK AT
1001-1011 FELTL COURT .
The applicant was granted a Conditional Use Permit to construct a
residential/nursing home facility . They now are requesting a
variance to allow parking within the front yard setback . The
proposed plan would allow a setback of 15 feet . This would allow
-. 140 parking spaces . This would allow enough parking for the
second phase of their development .
Mr . Kirscht moved and Ms . Bourne seconded the motion recommending
approval of the 15 foot variance requested with the condition
that it go no further south than the closest projection of ':he
building to Feltl Court and that landscape screening being opaque
in nature be planted in proximity to the parking lot curb and be
maintained to the height of 4 feet minimum and to work out a
landscape that would not "dead end" terminate on the south .
The motion carried unanimously .
Mr . Kirscht stated that he made this motion due to the fact that
it is more desirable to have increased parking on site rather
than on the street .
ITEM : DISCUSSION REGARDING POSSIBLE REZONING OF PROPERTIES IN THE
SOUTHWEST PORTION OF THE CITY .
A hearing notice was published to rezone the western portion of
the landfill from R-6 to I-1 . Since that time there was
'� discussion of the possible rezoning of the east section of the
landfill from R-6 to I-1 and also to rezone a strip ow Westbrooke
Patio Homes from R-6 to R-2 .
Mr . Berg moved and Mr . Janke seconded the motion to set a hearing
to consider the rezoning as above noted . The motion carried
unanimously .
ITEM : DISCUSSION REGARDING SIGNAGE OF THE KSTP BILLBOARD
The Commission would like a draft of a resolution addressing
billboards on right-of-ways and a draft of Ordinance precluding
future billboards in Hopkins , either based on size or other .
Secondly that any currently grandfathered billboards will , on the
termination of their leases , be eliminated , or 5 years , whichever
is longer. Thdy woul�d ��Ii�ae �n b�p�inio�� fro��n�>_th�� Ci�ty A�tt��r�ney as
tb the legality of such an ordinance .
In discussion of the KSTP billboard , the Commission recommended
that the sign have "HOPKINS" in the middle without an arrow and
that both sides of the Hopkins sign have a space to hang a
""" special event banner and that hooks be provided on the sign to
accommodate hanging of the banner.
ELECTION OF OFFICERS :
Jim Folk was nominated and elected unanimously for the position
of Chairperson for the next year. Nelson Berg was nominated and
elected for vice chairperson for the next year.
The Commission discussed having a joint meeting with the City
"' Council . A tentative date was set for October 22 .
ADJOURNMENT : Mr . Kirscht moved and Mr. Berg seconded the motion to adjourn
the meeting a 9 : 45 p •m . The motion carried unanimously .
