A regular meeting of the Hopkins Zoning and Planning Commission was held on Tuesday, October 29, 1985, at 7:30 p.m. , in the Council Chambers of the City Hall . ^ Present were members Berg, Janke, Kirscht and Shirley. Also present were City Engineer Strojan, Community Development Director Kerrigan, and Community Develop- ment Analyst Anderson. In the absence of Chairman Folk, Mr. Berg chaired the meeting. Action: Mr. Janke moved and Mr. Kirscht seconded a motion that the minutes of the September 24, 1985 meeting be approved and signed. Motion carried. Case No: Request from Walser Leasing of 317 Mainstreet for an easement to place a 85-39 sign in the public right-of-way, continued from the September 24, 1985 11-139 meeting. Mr. Rob Walser, General P�anager for Walser, presented a new plan to the Commission for the proposed sign. The new proposal would place the base of the sign one foot inside the fence on Walser property, with the sign encroaching 22-3 feet into the right-of-way at a height of 8 to 10 feet. The Commission stated concerns regarding the height of the sign indicat- ing that perhaps a height of 8 feet would not be high enough and that Walser would have to assume liability for any damage to the sign. Action: Mr. Kirscht moved and Mr. Janke seconded a motion recommending to the Council approval of the air space easement for the design of the sign presented tonight; to be internally illuminated; of a design to match the other Walser signs; with overhang into the right-of-way being a maximum of 3 feet; bottom of sign being a minimum of 8 feet, subject to review by the City Engineer and Public Works Department to determine exact height; that Walser assume all responsibility and liability in the placement of the sign relative to the right-of-way; and that the sign be in existence only as long as this business is in existence; and that the green space be landscaped as indicated on the original plans. Motion carried unanimously. The Commission also requested that a copy of the test drive course for the business be placed on file with the City. Case No: Hearing to consider rezoning the West 2 of the Southwest 4 of the South- 85-40 west 4 of Section 25, Township 117, Range 22, from R-6 Residential to (A) B-1 Business, continued from the September 24, 1985 meeting. 140-393 Mr. Stalland and Mr. Bloom, representing Mr. Berglund, stated their views -- on the proposed rezoning. They feel that the property should remain with the residential designation and that the owners of the property should be able to rely on the zoning. Also the proposed change would cause finan- cial loss in regard to the sales agreement for residential development on that property. They feel that residential development in that area would be in the best interest of the City. A resident of the Westbrooke Patio Homes questioned the preservation of the park area. The Commission stated that they will be looking for quality construction for that proposed development and preservation of the wooded area. Action: Mr. Janke moved and Mr. Kirscht seconded a motion recommending to the Council that the present zoning on the property of R-6 remain. Motion carried unanimously. Case No: Hearing to consider rezoning the Northwest 4 of the Southwest 4 of Section 85-40 25, Township 117, Range 22, lying south of the northerly 600 feet and west (B) of the east 195 feet from R-6 Residential to I-1 Industrial ; and that part 417-562 of the east 195 feet of the Northwest 4 of the Southwest 4 of Section 25, — Township 117, Range 22, lying south of the north 433 feet from R-6 Resi- dential to R-2 Residential . Zoning and Planning Commission minutes of October 29, 1985 continued (2) Mr. Janke moved and Mr. Kirscht seconded a motion to continue this hear- ing to the next meeting to see the Council action on 'A' the above pro- posed zoning. Motion carried unanimously. Case No: Hearing on an application by Robert Mason for a Variance to locate a 85-57 building within the rear yard setback at 917 P�ainstreet. 563-730 Mr. Mason and Mr. Perkl reviewed the plans with the Commission for re- modeling and enlargement of the former Nelson Shoe Store property with an arcade for access from Mainstreet to the alley. The structure would contain several retail shops on the main floor and one in the basement. The addition to the rear of the present building would contain 2400 square feet and be setback from the alley not less than 7'6". A vari- ance for a 1 foot seback for the dumpster and electrical room is also requested. It was also stated that it has been requested of the City that the side- walk be constructed adjacent to the proposed development. Action: Mr. Janke moved and Mr. Kirscht seconded a motion recommending to the — Council approval of a variance for a 1 foot setback for the dumpster and electrical room and a variance for a setback of not less than 7 feet for the remainder of the entrance to the arcade, to conform with the building to the west and also the idea of containing the dumpster within the con- cept of the buildings and also the necessary setback of the building to encompass the meeting of the building to the east with even setbacks. Motion carried unanimously. Case No: Hearing on an application by Robert Mason for a Conditional Use Permit to 85-50 build an addition and renovate the building at 917 Mainstreet. 731-738 The discussion of the proposed variance took into consideration the need of a Conditional Use Permit. Action: Mr. Janke moved and Mr. Kirscht seconded a motion recommending to the Council approval of the Conditional Use Permit to build an addition and renovate the building at 917 Mainstreet subject to approval of the Fire Marshal and approval of a drainage plan by the City Engineer. Motion carried unanimously. Case No: Hearing on an applica�ion by Mizpah United Church of Christ for a vari- -- 85-58 ance to expand a non-conforming structure at 412 5th Avenue North. 740 Mr. Kirscht moved and Mr. Janke seconded a motion that the request be tabled at the request of the applicant. Motion carried unanimously. Case No: Hearing on an application by Mizpah United Church of Christ for a Con- 85-51 ditional Use Permit for additions to the present structure at 412 5th 745 Avenue North. Mr. Kirscht moved and Mr. Janke seconded a motion that the request be tabled at the request of the applicant. Motion carried unanimously. Case No: Hearing on an application by Kokesh Athletic Equipment for a parking 85-52 variance at 350 17th Avenue North. 747-840 Frank Kokesh and Sue Layton reviewed the request with the Commission stating that they have a 30 day lease due to the uncertainty of light rail transit. It was also stated that the property would probably be available for use by them for at least a year. The applicant stated that with the revised use of their building they would be employing two more employees. Also they could provide additional parking on the — site by reworking their landscaping if necessary. Action: Mr. Kirscht moved and Mr. Janke seconded a motion recommending to the Council approval of the parking variance on the basis that Kokesh is Zoning and Planning Commission minutes of October 29, 1985 continued (3) adding two more employees and that they are utilizing railroad property for the parking; if the railroad right-of-way is not available, Kokesh will have to present solutions for five additional spaces fronting on 17th Avenue. Motion carried unanimously. Case No: Hearing on an application by Midwest Outdoor Advertising Inc. , for a 85-52 Conditional Use Permit to place a sign in a lesser setback than required 841-971 at 410 llth Avenue South. Mr. Peter Remes of Midwest Outdoor Advertising Inc. presented the plans to the Commission stating that the size of the sign 5'xll' deemed it a junior billboard and the placement of the sign was required for windshield visibility. Action: Mr. Kirscht moved and Mr. Janke seconded a motion recommending to the Council denial of the request to place a sign in a lesser setback than required abiding by the ordinance. Motion carried unanimously. Case No: Hearing on an application by Dale Egberg for a Variance for lot width for 85-54 construction of an office building at 630 llth Avenue South. 974-1196 — Mr. Egberg reviewed the request with the Commission stating the need for a variance from 150 feet to 100 feet to accomodate the proposed building. He stated that the issue was not discussed at the Concept Review. The Commission stated concern regarding drainage of the property but the City Engineer stated that drainage to the street would be acceptable by grading the lot. Action: Mr. Janke made a motion recommending to the Council approval of the lot width variance from 150 feet to 100 feet based on the square footage of the lot meeting the requirements of the ordinance. Motion died for lack of a second. Case No: Hearing on an application by Dale Egberg for a Conditional Use Permit for 85-55 construction of an office building at 630 llth Avenue South. — 1197-1322 Mr. Egberg commented on the staff report in regard to the size of the parking stalls on the site and stated that there was no problem increas- ing the size from 18 feet to 20 feet. Mr. Janke moved and Mr. Kirscht seconded a motion recommending to the Council approval of the Conditional Use Permit for construction of an office building at 630 llth Avenue South subject to parking stalls being increased from 18 feet to 20 feet; approval by the Fire Marshal ; approval by the City Engineer of a drainage plan, and taking into consideration the adjoining properties and perimeter of the parking lot to see if curbs or retaining walls are necessary. Motion carried unanimously. Case No: Hearing on an application by Brian Zubert for a Conditional Use Permit to 85-56 construct a car care facility and coin operated laundry at the southwest 1326- corner of llth Avenue South & 7th Street. 430 Tape 2 Bob Fields , partner of Brian Zuberg, reviewed the proposal with the Com- mission for the car wash and coin operated laundry with access from llth Avenue. He stated that there would be no stacking in the street and that they would police that problem themselves. Hours of operation would be "' from 9:00 a.m. to 10:00 p.m. with the laundry hours corresponding to the hours of operation of the car wash. Mr. Herman, operator of the Westbrooke Mall , spoke in regard to concerns of parking in their lot for possible drying of cars. Mr. Tholen also Zoning and Planning Commission minutes of October 29, 1985 continued (4) � spoke in regard to cars parking in their lots during winter months when snow removal is a problem. The Commission stated concern with regard to traffic on llth Avenue and suggested that it would be better if ingress/egress were provided from 7th Street. Mr. Fields stated that this could be accomplished if their plan were turned around. It was also suggested that they incorporate an emergency lane for exit for use if necessary. The City Engineer stated that the sewer system was adequate for thier use. Mr. Janke moved and Mr. Kirscht seconded a motion recommending to the Council approval of the Conditional Use Permit to allow construction of a car care facility and coin operated laundry at the southwest corner of llth Avenue South & 7th Street, with the conditions that the size of the trees on the landscape plan be increased from 2" to 22" ; approval by the Fire Marshal ; approval by the City Engineer of drainage plan; egress be revised with no entrance from llth Avenue; stacking area for 18 spaces in place of the 30 required as parking area would provide added spaces when necessary; surface of parking area to be edged with asphalt curb. Motion carried unanimously. Case No: Hearing on an application by Brian Zubert for a parking variance for a 85-59 car care facility and coin operated laundry at the southwest corner of 430 llth Avenue & 7th Street South. Mr. Kirscht moved and Mr. Janke seconded a motion recommending to the Council approval of the parking variance as request from 30 spaces to 18 spaces with condition that they can accomodate 30 spaces should the owner or City see need for it and it can be accomplished by use of the parking area. Motion carried. Mr. Berg voting nay. Mr. Kirscht moved and Mr. Janke seconded a motion that the meeting be adjourned at 12 :30 p.m. P�otion carried.
