A regular meeting of the Hopkins Zoning and Planning Commission was held on Tuesday, — January 28, 1986, at 7:30 p.m. , in the Council Chambers of the City Hall . Present were Chairman Folk, members Berg, Bourne, Brandon, Janke and Shirley. Also present were City Manager Rapp, City Engineer Strojan, Community Development Director Kerrigan and Community Development Analyst Anderson. Item: Mrs. Brandon moved that the minutes of December 30, 1985 be amended to 0-16 read in Case VN85-3 "Mrs Brandon voting aye" ; Case CUP85-1 to read "Mr. Berg voting nay" and leaving the meeting at that time. Mr. Janke seconded the motion. Motion carried unanimously. Cas2 No: Hearing to consider an application by Robert Mason/Don Perkl , for a Waiver WVR86-1 of the Platting Requirements to divide the lot at 917 Mainstreet into two 17-47 parcels. Mr. Mason explained the request to the Commission stating that the division was necessary for the purpose of receiving two tax statements for the parcel under consideration with the proposed construction on the adjacent lot. Mr. Berg moved and Mr. Janke seconded a motion recommending to the Council adoption of a Resolution approving the Waiver of Platting Requirements at 917 Mainstreet with the Findings of Fact: 1. That the Waiver of the Plat- " ting Requirements will form two conforming lots ; 2. That the building as proposed may be built on the proposed lot; 3. That the proposed lots con- form to all requirements of the City's zoning ordinance and with the Condition that said Waiver be approved subject to approval of the Henne- pin County Recorder. Motion carried unanimously. Case No: Hearing to consider a change in the Comprehensive Plan for the West 2 of CP86-1 the SW4 of the SW4 except road, Section 25, (the Berglund-Johnson parcel ) 47-68 from B-2, B-3 Business, and I-1 Industrial zoning to R-6. Mr. Kerrigan explained to the Commission that the proposed change is necessary to bring the Comprehensive Plan into conformance with the zoning ordinance. He also stated that any approval should be subject to approval of the Metro- politan Council . Mrs. Brandon moved and Mr. Janke seconded a motion recommending to the Council approval of the change in the Comprehensive Plan on the Berglund-Johnson parcel from B-2, B-3 Business and I-1 Industrial zoning to R-6 Medium Density Multiple Family. Motion carried. Ms. Bourne abstained. Case No: Hearing to consider an application by Marvel Eggum for 0 & E Ventures for a � WVR86-2 Waiver of the Platting Requirements to divide a single lot at #1 Loring Road. 68-565 Mr. Marvel Eggum and Mr. Lewis Oberhauser reviewed the request with the Commission. They stated that the waiver was requested to facilitate the lot division for construction of another home with access either from Loring Road or Minnetonka Boulevard. The strip of land on the southerly portion of the lot is for utility easement and access is necessary. Sixteen residents of the Bellgrove area were present and spoke in regard to the lot division stating that they felt it was not appropriate in keeping with the quality of the neighborhood. They wish to see the larger lots re- main both for privacy and value to the area. They also stated concerns in regard to title to the property, type of construction proposed on the lot, drainage for the area. and also lack on the part of the applicant to meet with the neighborhood to make his plans known. It was also stated that previous lot splits in the area created larger lots than the one in question and some were only for the purpose of creating proper setbacks. Mr. Berg moved and Mrs. Brandon seconded a motion that the hearing be con- tinued to the February meeting giving the applicant time to meet with the neighbors and look at the use of an alley for access purposes; have staff �' refer the title issue to the City Attorney with applicant providing the abstract; study of the drainage problem in the area and also determine if County support for the subdivision is contingent on access to Loring Road or if access is prohibited to Minnetonka Boulevard. Motion carried unani- mously. Zoning and Planning Commission minutes of January 28, 1986 continued. Case No: Hearing to consider an application by Honeywell Inc. for a Concept Review CR86-1 for a building addition at 600 Second Street N.E, 572-795 Mr. Paul Laederach of Honeywell Inc. reviewed the proposed expansion with the Commission. Discussion involved the use of parking areas across the street from the proposed site being used in figuring the F.A.R. After discussion, it was the consensus of the Commission that the proposed ex- pansion would be in keeping with the building and area and that the ap- plicant should have complete landscaping plans when applying for a Con- ditional Use Permit. Case No: Hearing to consider changing the Conditional Use Permit section of the ORD86-1 Zoning Ordinance. 796-884 No one was present to comment on the proposed changes. The Commission proposed changes in the wording of the proposed ordinance under Section 427.26(11) and 427.26(11) (a). Ms. Bourne moved and Mr. Berg seconded a motion recorr�nending to the Council `� approval of the proposed changes and that the City Attorney put in Ordinance form. Motion carried unanimously. Item: Review of proposed changes to the Sign Section of the Zoning Ordinance. 885-1037 The Commission reviewed proposed changes with staff and requested that staff get samples of window signs and also a definition of window signs for the February meeting. Mr. Berg will contact the Downtown Committee in regard to the proposed changes and staff will schedule a hearing to be held at the March meeting. Discussion regarding proposed change in the sign ordinance in regard to Signs , Advertising Lights and Devices - Section 427.42 (4) . The Commission reviewed the proposed ordinance with staff and concurred with the changes. Ms. Bourne moved and Mr. Janke seconded a motion that a hearing be held at the February meeting regarding the change. Motion carried unanimously.
