NOTICE OF HEARING
The Zoning and Planning Commission of the City of Hopkins will hold
a hearing on Tuesday, September 30, 1986, at 7:30 P.M. , in the Council
Chambers of the City Hall to consider an application by Karen Disrud of
1315 Oxford Street for a Conditional Use Permit to allow a Day Care for
more than five and less than eleven children.

A regular meeting of the Hopkins Zoning and Planning
Commission was held on Tuesday, September 30 , 1986 , at 7: 30
p .m . in the Couneil Chambers of the City Hall .
Present were Chairman Folk , members Berg , Brandon , Janke and
Shirley. Also present were Planning and Economic
Development Director Kerrigan and Community Development
Analyst Anderson .
ITEM: ( 2-4)
Mrs Brandon moved and Mr . Janke seconded a motion
that the minutes of the August 26 , 1986 meeting be
approved and signed . Motion carried unanimously.
CASE N0 : CUP: 86-6 ( 5-70)
Hearing to consider an application by Reuter Inc .
for a Conditional Use Permit to construct an
,� addition to the strueture at �410 - 11th Avenue
South , continued from the August 26 , 1986 meeting.
Mr . Jameson reviewed the plans with the Commission
stating that the present structure would be for
manufaeturing and the proposed addition would be
for office and warehouse . There was no one
present opposing the enlargement of the existing
facility.
The Commission requested that all plans be
finalized before being presented at Council .
Mr . Berg moved and Mrs . Brandon seconded a motion
recommending to the Couneil approval of the
Conditional Use Permit to construct an addition to
the structure at 410 - 11th Avenue South based on
the Findings of Faet : 1 . That the proposed
additions meet the minimum requirements for an I-2
District ; 2. That the proposed additions meet the
requirements for a Conditional Use Permit ; and
— with the Conditions: 1 . Subjeet to approval by the
Watershed Distriet , 2. Subject to approval by the
Direetor of Engineering . Motion carried
unanimously.
CASE N0: VN86-10 (73-213)
Hearing to consider an application by Emil Keller
of 406 - 16th Avenue North for a sideyard varianee
eonvert a carport into a garage .
Mr. Keller and Ken Merkins of Neighborhood
Builders reviewed the request with the Commission .
Mr . Keller had located his lot lines since the
last meeting . There was no one present at the
meeting opposing the conversion .
Mr . Berg moved to recommend to Couneil approval of
the variance to convert a carport into a garage at
406 - 16th Avenue North . with a �4 foot sideyard at
the south property line . Motion died for lack of
a second .

Mr . Janke moved to recommend to Couneil denial of
the variance to convert a carport into a gara�e at
406 - 16th Avenue North based on the Findings of
Faet : that there is an existing nonconforming side
yard ; the ordinance prohibits expanding
nonconforming structures� there is . no real
hardship . Motion died for lack of a seeond .
Mr . Berg moved and Mrs . Brandon seconded a motion
recommending to Couneil approval of the Variance
to convert a carport into a garage at 406 - 16th
Avenue North with the Findings of Faet : 1 . The
carport was built under a previous ordinance ; 2.
The improvement of existing structure does not
enlarge or intensify the structure ; 3 . That the
.-. neighborhood supports the improvement ; � . The
garage would be an improvement to the property; 5 .
That it is the logical place for a �arage . Motion
carried . Mr . Shirley and Mr. Janke voting nay.
CASE N0: CUP86-9 � 218-245)
Hearin� to consider an application by Karen Disrud
of 1315 Oxford Street for a Conditional Use Permit
to allow a Day Care for more than five and less
than eleven ehildren .
Ms . Disrud reviewed the request with the
Commission stating that she has up to eight
children at different times of the day. She also
stated that with the ages of the ehildren , they
are outside very little .
Residents from the area stated concern regarding
traffic in the neighborhood , small yards with
little room for the ehildren to play, home was
small for the number of children .
Mr. Janke moved and Mr . Berg seconded a motion
recommending to the Council approval of the
Conditional Use Permit to allow a Day Care at 1315
Oxford Street based on the following Conditions: l .
that the applicant is licensed by the State of
Minnesota; 2 . That the residenee is inspected by
the City Inspectors ; 3 . That the licensin� body be
informed of the coneerns on traffie ; �+ That a
fence be erected around a play area in the back
yard . Motion carried unanimously.
CASE N0: VN86-15 ( 428-512)
Hearing to consider an application by Naegele
Outdoor Advertising Inc . for a variance to ereet a
sign to exceed the maximum height requirements by
15 feet at 1�10 Washington Avenue South.
Michael Cronin representing Naegele Outdoor
Advertising Inc . reviewed the request with the
_ Commission stating that Naegele has purchased the
- sign from FarVue and that they would request that
the condition for backlighting of the sign be

deleted from the previous conditions so they could
use up-lighting . There were to be no other
changes to the sign .
Mr. Shirley moved and Mrs . Brandon seconded a
motion recommending to the Council approval of the
Varianee to allow the sign at 140 Washington
Avenue South to exceed the maximum height
requirements by 15 feet with the Findings of
Fact : l .That a unique cireumstanee is present due
to the height of the overpass; 2 A hardship exists
due to the height of the overpass whieh dictates
the height of a billboard to be visible from
Highway 18; and with the Conditions: 1 . To retain
sign at present size and location; 2. That the
City accept the offer of Naegele to prohibit the
,� advertising of aleohol and tobaeeo . Motion
carried . Mr. Folk voting nay.
CASE N0: VN86-13 � 51 �-733)
Hearing to consider an application by Warrington &
Associates , Ine . for a sideyard varianee to
construet an office building with a 10 foot
sideyard on the empty lot north of 601 Second
Avenue South .
Representatives from Warrington explained the
expansion plans to the Commission . They explained
that they have 25 years to go on their present
lease and the expansion will be for single tenant
use .
Two neighbors spoke in favor of the pro�ect but
had a few concerns about landscaping and traffie .
Mr . Shirley moved and Mrs . Brandon seconded a
motion reeommending to the Couneil approval of the
, Variance with the following Findings of Fact : 1 . A
unique cireumstance exists due to the inability of
the applicant to purchase the sub3ect site ; 2. A
hardship exists due to the access that is required
to the proposed building; 3 . The negative impact
of the varianee will be minimized due to the fact
that the building will have the proper side yard
setbacks , exeept for the link ; and with the
Condition: 1 . That the connecting link be
conditioned upon both buildings remaining in
common usage by one owner and/or tenant . Motion
carried unanimously.
CASE N0: 86-10 (733-8�t2)
Hearing to consider an application by Warrington &
Associates , Inc . for a Conditional Use Permit to
construct an office building on the empty lot �ust

Mr . Shirley moved and Mr . Janke seconded a motion
recommending to the Council approval of the

office building on the empty lot just north of 601

Second Avenue South with the Findings of Faet : 1 .
The proposed building meets the requirements for
the B-1 Distriet ; 2. That the proposed building
meets the requirements for a Conditional Use
Permit ; and with the Conditions: 1 . Approval by
the Watershed District ; 2 . Approval by the Fire
Marshal . Motion carried unanimously.
CASE N0: 86-1 � (7�t3-856)
Hearing to consider an application by Burschs for
a front yard variance of one foot to allow an
addition to the building at 17 - 8th Avenue South .
The applicants reviewed the proposed addition with
the Commission . Residents from the area expressed
coneern regarding parking . It was noted that the
parking spaces in their lots are larger than
required and with restriping of the lots they
would have more spaces . The consultant has
determined that the lots are not 100$ full and
there should be no real problem due to the
addition.
Mr . Berg moved and Mr . Janke seconded a motion
recommending to the Council approval of the one
foot Variance to allow an addition to the
building at 17 - 8th Avenue South , with the
Findings of Fact : 1 . That there would be a minimal
affect on the building; 2. That there would be no
greater intrusion into the front yard than the
existing building . Motion carried unanimously.
ITEM: ( 865-927)
Diseussion regarding the Official Map , referred to
Zoning and Planning by Council .
The Commission viewed the sites under
„ consideration on a bus tour previous to the
� meeting .
Mrs . Brandon moved and Mr . Janke seconded a motion
recommending to the Council to set a date for
hearing to amend the Official Map to correspond to
the recommendations dated September 29 , 1986 .
Motion carried unanimously.
ITEM: (928-1086)
Diseussion regarding skateboard ramps and
skateboard use within the City referred to Zoning
and Planning by Council .
After considerable discussion it was deeided to
have staff check with other cities to see how they
deal with the issue and report back to the
Commission at the next meeting .

Mr. Janke moved and Mrs . Brandon seconded a motion that the
meeting be adjourned . Motion carried unanimously.
