+ A regular meeting of the Hopkins Zoning and Planning
Co��ission was held on Tuesday, January 27 , 1987 , at 7 :30
p .m. , in the Council Chambers of the City Hall .
Present were Chairman Anderson , members Brandon , Denny,
Ebel , MeGlennen and Shirley. Also present were Community
Development Director Mielke , Planning & Economie Development
Director Kerrigan , and Community Development Analyst

t�rs . Brandon moved and Mrs . Ebel seconded a motion that
the minutes of the November 25 , 1986 meeting be
approved and signed . Motion carried unanimously.
CASE N0: ZN86-1 (6-114)
Review of an application by Dennis Madden of Bursch' s
to vacate a portion of the North-South alley in Bloek
3 , West Minneapolis , behind the restaurant , continued
from the November 25 , 1986 meeting .
Mr. Madden reviewed the request with the Commission
stating his concern about residents of the Hopkins
Plaza apartments using his parking lot as a short-cut
to their apartments . The building extends below the
area in which the traffic is taking this short-cut and
he is concerned this extra traffic will cause problems
for the building below.
It was the consensus of the Commission that the
vacation of the alley would not solve his problem and
there is an access requirement for fire trueks of 150
feet .
Mr. McGlennen moved and Mrs . Brandon seeonded a motion
recommending to the Council denial of the request for
vacation of the alley with the Findings of Fact:
1 . That there is an access requirements for fire trucks
of 150 feet .
2 . That the vacating of the alley would limit fire
access .
— 3 . That access points to the adjacent apartment will be
limited to a one way.
Motion carried unanimously.
CASE N0: 86-13 � 122-137)
Hearing to consider an application by Dennis Madden of
Bursch' s for a Conditional Use Permit to construct a
canopy pro�ecting into the public right-of-way at 17 -
8th Avenue South , continued from the November 25 , 1986
meeting .
Mr. Madden stated that the request for the canopy was
to keep the entrance free of snow.
Mr . Denny moved and Mrs . Brandon seconded a motion
recommending to the Council approval of the Conditional
Use Permit to construct a canopy into the public right-
of- way with the Findings of Fact : 1 . That the canopy
meets the conditions for a Conditional Use Permit and
with the Condition: 1 . That the applicant provide proof
� of Liability Insurance holding the City free of all
responsibility. Motion carried unanimously.

CASE N0: CUP87-1 ( 138-140 )
Hearing to consider an application by Barbara Raygor of
39-5th Avenue South for a Conditional Use Permit to
allow Day Care .
The application was withdrawn as the owner refused to
allow a business in the eomplex .
CASE N0: CUP87-2 ( 1 �10-207)
Hearing to consider an application by Accent Engraving
to locate a sign in a lesser setbaek than required at
1600 Second Street South.
Mr. Chuck Taegre and Mr. Reuven Rahamin appeared before
the Commission and explained that many of the old signs
on the building will be removed and consolidated into
.^ the proposed sign . It was also noted that the proposed
sign will be attached to the planter. It was the
Peeling of the applicant that the planter will soften
the size of the sign .
The City staff stated concern With the overal bulk of
the sign and planter.
Mr. McGlennen moved and Mrs . Ebel seconded a motion
recommending to the Council approval the Conditional
Use Permit to locate a sign in a lesser setback at 1600
Second Street South with the Findings of Fact:
1 . The proposed signage meets the requirements for the
I-1 District ; and with the Condition that the applicant
remove all other signs . Motion carried unanimously.
CASE N0: CUP87-3 �210-270)
Hearing to consider an application by Debra Packard of
83 Renaissance Court for a Conditional Use Permit to
operate a Day Care .
,. Debra Packard appeared before the Commission and stated
that she is licensed for up to 11 children but does not
plan on having that many. She stated that her backyard
is fenced along the road and there is a common play
area near. She also stated that there is a real need
for home day care because of the high cost in the
centers .
Mrs . Brandon moved and Mrs . Ebel seconded a motion
recommending to the Council approval of the Conditional
Use Permit for day care at 83 Renaissance Court with
the Findings of Faet: 1 . That the applicant meets the
conditions for a Conditional Use Permit ;
and with the Conditions:
1 . That the applicant is licensed by the State of
Minnesota.
2 . That the residence is inspected by the City
Inspectors .
Motion carried unanimously.
CASE N0: VN87-1 (279-505)
� Hearing to consider an application by Zion Lutheran
Church at 241 - 5th Avenue North for a Variance to
construet an addition within the 50 foot sideyard
setback .

Mr. Orlan Narr and Mr . Joel Raffenbuel of Zion Church
reviewed the expansion plans with the Commission ,
stating their needs for a better entrance system,
additional office and education Pacility.
Mr. MeCardy and Mr. Hennemuth of RCM showed drawings of
the proposed expansion stating that the additions would
match the existing exterior of the building . They also
noted that the 50 foot setbaek for the side yard is one
of the largest in the zoning ordinance . There was some
confusion regarding the front and side yards due to the
corner lot .
There was no one present at the meeting objecting to
the proposed additions .
A letter was presented to the Commission from Mr. Don
J . Milbert , 206 5th Avenue North , stating that he was
in favor of the proposal and that he felt it was a
�` benefit to many .
Mr . McGlennen moved and Mr. Denny seconded a motion
recommending to the Council approval of the Variance to
construet an addition within the 50 foot sideyard
setback at Zion Lutheran Church with the Findings of
Fact:
1 . That it does present a unique cireumstance and
hardship that would �ustify the varianee .
2 . That part of the building is already non-conforming
and this would enlarge on the non-conformity but not
intensify.
3 . Visual impaet of the intersection is not adversely
impacted by the development .
Motion carried unanimously.
ITEM: (518-848)
Discussion to eonsider changing the lot size in the
Bellgrove Area .
The Commission , staff and residents of the Bellgrove
+ area discussed the various lot size requirements . The
residents of Bellgrove stated that they did not want to
affect other parts of Hopkins , only deal with their
neighborhood . It was their desire to create a new
zoning district with a lot area requirement of �0 ,000
square feet . It was noted that a change in the zoning
ordinance allows those existing non-conforming
structures to be enlarged or altered .
The Commission instructed staff to draft a proposed
ordinance creating an "R-1 -E" District with a minimum
lot area of 40 ,000 square feet for the Bellgrove area
and set the date for hearing on February 2� , 1987 .
ITEM: (849-878)
Discussion regarding the use of skateboard ramps .
Staff recommended a proposed ordinance to eliminate
skateboard ramps in residential districts . After some
discussion it was the feeling of the Commission that
— the issue was best handled in this respect . The
Commission instructed staff to set a hearing on the
proposed ordinance for the February 24 , 1987 meeting .

ITEM:
Discussion regarding a joint meeting with Zoning and
Planning and City Council to exchange ideas .
Staff was instructed to see if either February 25 or
March 4 would be convenient for both groups . Staff
will notify Council and Commission when a date has been
set .
There is to be a one hour work session before the
February 24 , 1987 Zoning and Planning meeting .
Mrs . Brandon moved and Mrs . Ebel seconded a motion that
the meeting be adjourned . Motion carried .
