A regular meeting of the Hopkins Zoning and Planning Commission was held on Tuesday, April 28 , 1987 , at 7 : 30 p .m. , in the Council Chambers of the City Hall . Present were Commissioners Brandon , Ebel , MeGlennen and Richardson . Also present was Community Development Analyst Anderson . In the absence of Chairman Anderson , Mrs . Brandon ehaired the meeting . ITEM: (4-6 ) Ms . Riehardson moved and Mr. McGlennen seconded a motion to approve and sign the minutes of the March 31 , 1987 meeting. Motion carried unanimously . CASE N0: WVR87-1 (7-28) Hearing to consider an application by Sohan Uppal for a Waiver of the Platting Requirements to divide Lots 3 , 4 , & 5 , Block 1 , Uppals Addition , for the purpose of eonstrueting a four family dwelling on each lot � ( located on the east side of 9th Avenue South , north of Nine Mile Creek) , continued from the March 31 , 1987 meeting. Mr. Uppal reviewed the request with the Commission and stated that he would not be requestin� any varianees . It was also noted that the request would be for fewer dwellings than previously approved . No one appeared ob�eeting to the request . Mr. MeGlennen moved and Mrs . Ebel seconded a motion recommending to the Council approval of the Waiver of Platting Requirements with the Findings of Fact : 1 . That the sub�ect lots meet the minimum lot requirements for an R-2 District ; and with the Condition: 1 . That the Waiver of the Plat is accepted by the Hennepin County Recorder. Motion carried unanimously. CASE N0: CUP87-9 �29-73 ) Hearing to consider an application by Mizpah United Church of Christ , 412 - 5th Avenue North , to loeate a — sign in a lesser setback than required and to exceed the maximum size requirement . Mr. Paul Hedblom, representing Mizpah Chureh , stated the sign is for better identification for the church. The new sign will face north/south. He also stated the existing signs would be removed but they would like to erect a direetional sign at their driveway to desi�nate the entrance . There were no neighbors present to speak for or against this issue . Ms . Richardson moved and Mr . MeGlennen seconded a motion recommending to the Council approval of the Conditional Use Permit to ereet the sign in a lesser setback and to exceed the maximum size at Mizpah United Chureh of Christ , 412 - 5th Avenue North . Motion carried unanimously . � Z & P Minutes of 4/28/87 2 _ CASE N0: CUP87-10 (74-324) Hearing to consider an application by Knox Lumber Company , 250 5th Avenue South , for a Conditional Use Permit to construct a warahouse on the property weat of their current building . Mr. Joseph Jameson , architect , reviewed the plans with the Commission . He stated that the new structure would be on leased land to the west of the current building. He stated that the exterior surface of the building would be metal , gray in color. The present entranee will be relocated to the north side of the buildin� and the interior of the building will be changed to aceommodate the new entrance . They will have thirty additional parking stalls added to the site . Mr. Dave Constable of the R. L. Johnson Company, stated that they were not aware the proposed building was a metal building . He felt that a metal building would depreciate the value of their proposed development to the west . Mr. Bob MeDonald , of the CCDC stated that they had not reviewed the plans to date , that they were opposed to metal buildings and asked that the Commission not act on this issue until the CCDC meets with the applicant . A meeting has been set of Monday , May 4 , 1987 . Mr. Jameson stated that the proposed building materials are consistent with the zoning district . Mrs . Ebel moved and Mr. MeGlennen seconded a motion to continue this case to the May 26 , 1987 meeting which would give the applicant time to meet with the CCDC . The Commission also stated that they would like to see a sample of the proposed exterior material at the next meeting. Motion earried unanimously. CASE N0: VN87-3 �325-413) Hearing to consider an application by Rudy Luthers Hopkins Motors for variances for the square footage of the sales lot to exceed the square footage of the _ building and a 15 foot variance to allow parking in the front yard setback of a proposed auto sales lot at the southwest corner of 5th Avenue South. Mr. John Simons , used car manager , reviewed the plans with the Commission . He stated that the proposed lot will be for used cars and will be an extension of the existing dealership aeross the street . The design of the sales lot will be a mirror image of the new car sales lot . He also stated that landscaping will be added between the car lot and Dow Towers with a 5 foot chain link fence . It was also stated the need for this lot due to possible future redevelopment of the lot at 7th Avenue . Ms . Riehardson moved and Mr. MeGlennen seconded a motion recommending to the Couneil approval of the varianees with the Findings of Fact : 1 . That a unique cireumstance is present due to the shape of the � Z & P Minutes of 4/28/87 3 property , 2 . A 20 foot setback would restrict the use — of the property, 3 . That a building on the site would restrict the use of the property; and with the Conditions : 1 . That the applicant be granted a Conditional Use Permit to operate an Auto Sales Lot , 2 . That the variances be reviewed if the applicant does not lease the abuttin� right-of-way. Motion carried unanimously. CASE N0: CUP87-11 (41 �-452) Hearing to consider an application by Rudy Luthers Hopkins Motors for a Conditional Use Permit for an auto sales lot at the southweat corner of 5th Avenue South & Mainstreet . Ms . Richardson moved and Mr. MeGlennen seconded a motion recommending to the Council approval of the Conditional Use Permit for an Auto Sales Lot with the Findings of Fact: 1 . That an auto sales lot is an efficient use of the site . 2 . That an auto sales lot is a permitted use in a B-3 District ; and with the Conditions : 1 . That the requested variances are ^ granted , 2 . At sueh time as the County makes a final determination on the implementation of light rail transit or should the applicant loose the lease to the County property , the Zoning and Planning Commission should have the opportunity to review the appropriateness of the Conditional Use Permit . Motion carried unanimously. CASE N0: CUP87-12 ( 458-465 ) Hearing to consider an application by Mark Eklo Homes for a Conditional Use Permit to eonstruct an eight unit townhome at the rear of properties east of Van Buren Avenue North and south of Oak Park Lane . The applicant requested that this request be continued to the May 26 , 1987 meeting. Ms . Richardson moved and Mrs . Ebel seconded a motion to continue this case to the May 26 , 1987 meeting . Motion carried unanimously . " CASE N0: 87-WVR87-2 (�66-u87 ) Hearing to consider an application by Jon Schwartzman for a Waiver of the Platting Requirements to add a 15 foot wide strip of land to the west side of 413 Cottage Downs . Mr. Schwartzman stated that he wishes to sell the property to the west of his home and the proposed lot division would give him a greater side yard . No one appeared in opposition to this request . Ms . Richardson moved and Mrs . Ebel seconded a motion recommending to the Couneil approval of the Waiver of Platting Requirements to divide the property at 413 Cottage Downs with the Findings of Fact : 1 . That the lots meet the minimum lot size for an R-1 -D Distriet , � Z & P Min�tes of 4/28/87 4 — 2 . That the existing setbacks will not be deereased by the Waiver , 3 . That the Commission has previously granted Waiver of the Plat for a single property division ; and with the Condition 1 . That the Waiver is aceepted by the Hennepin County Recorder. Motion carried unanimously. Item: (488-802) Diseussion regarding the use of skate boards in residential districts . This hearing had been continued for 60 days to give staff and skateboard users the opportunity to obtain additional information regarding the issue . Mrs . Wonson of Interlachen Park spoke on the use of skateboard ramps in residential districts in regard to on street parking of up to 15 cars at one time , noise level , use from afternoon until dark weekdays and longer on weekends , unattractiveness of strueture . It was pointed out that the ramps draw young people from ._ all over , not �ust a neighborhood recreation facility. She stated that if the City deals with the issue as a nuisance it places the burden of complaint on the neighbors , therefore creating neighbor problems . She felt that the use of skateboard ramps should be prohibited in residential districts . Mr. Lavin and Mr. Guldberg of the Bellgrove area stated that the noise from these skateboard ramps is very annoying and that people are unable to enjoy their own yards due to the noise level . They feel that they are a nuisance and their use should be prohibited in residential districts . It was noted that the existing skateboard ramps would probably be grandfathered in if the City adopted an ordinanee prohibiting them in residential districts . It was also the feeling of the Commission that they would not want to prohibit the small temporary ramps that children use from time to time . .-. Mrs . Ebel moved and Ms . Richardson seconded a motion to have staff see if the City Attorney could draft an ordinanee to prohibit permanent type skateboard ramps and their use in residential distriets , but not prohibit the temporary ramps . Motion carried . Mr. MeGlennen abstained . ITEM: (803-806 ) Set date for Public Hearing for vaeation of alleys in Block 7 , West Minneapolis . Mrs . Ebel moved and Ms . Richardson seconded a motion that a public hearing date be set for May 26 , 1987 regarding the vacation of alleys in Bloek 7 , West Minneapolis . Motion carried unanimously.
