Hennepin County, Minnesota NOTICE OF HEARING The Zoning and Planning Commission of the City of Hopkins will hold a hearing on Tuesday, August 25 , 1987 , at 7 :30 p .m. , in the Council Chambers of the City Hall to consider an applieation by Kathy MeGee , 1301 Highway No. 7 , �105 , for a Conditional Use Permit to operate a Day Care in her home . Anderson Community Development Analyst To be published in the HOPKINS SAILOR, August 10 , 1987 • � _ A regular meeting of the Hopkins Zoning and Planning Commission was held on Tuesday, August 25 , 1987 , at 7 : 30 p .m. , in the Council Chambers of the City Hall . Present were members R. Anderson , Brandon , Denny, and Richardson . Also present were Community Development Director Mielke , Planning & Economie Development Director Kerrigan , and Community Development Analyst Anderson . In the absenee of Chairman E.Anderson , Mrs . Brandon chaired the meeting. ITEM: (3-6 ) Mr. R. Anderson moved and Mr. Denny seconded a motion that the minutes of the July 28 , 1987 meeting be approved and signed . Motion carried unanimously. CASE N0: CUP85-51 �9-81 ) Hearing to consider an application by Mizpah United Chureh of Christ for a Conditional Use Permit to construet an addition to the west side of the � existing ehureh at �12 Fifth Avenue North. Hearing previously tabled at the request of the applicant October 29 , 1985 . Mr. Paul Snyder of Armstrong , Torseth , Skold & Rydeen and Mr. John Glasgow, representing Mizpah Church, reviewed the the plans with the Commission . They stated that there would be no additional seating and that the parking area will remain the same . The addition is to provide for better internal circulation and handicap aceess . Their plans also include an elevator shaft and hopefully they will have enough money for an elevator. No one appeared in opposition to the proposed pro3ect . Mr. R . Anderson moved and Ms . Richardson seconded a motion recommending to the Council approval of the Conditional Use Permit for an addition to the west side of Mizpah Chureh with the Findings of Faet: 1 . That a ehurch is a permitted use in an R-4 District ; 2 . That the addition meets the requirements for an R-4 District . Motion carried unanimously. CASE N0: CUP87-21 ( 8�-116 ) Hearing to consider an application by Kathy MeGee for a Conditional Use Permit to operate a Day Care in her home at 1301 Highway No .7 �105 . Ms . MeGee appeared before the Commission and stated that she cares for seven ehildren at the present time , one of whieh is her own . She stated that her building is situated so that the children have a play area that is enelosed by buildings . She also stated that she has had day care in her home for one year. It was noted that the Fire Marshal has inspected her home and approved her for six ehildren . If the applicant wants day care for over six ehildren it i must be inspected by the Building Inspector and meet the Building Code . Z & P 8/25/87 Page 2 Mr. Denny moved and Mr . R. Anderson seconded a — motion recommending to the Couneil approval of the Conditional Use Permit for Day Care at 1301 Highway No . 7 #105 , with the Findings of Faet: 1 . That a day care is a permitted use in an R-4 District ; and with the Conditions: 1 . That the Fire Marshal inspect the home , 2 . That the applicant is licensed by the County. Motion carried unanimously. CASE N0: CUP87-22 ( 118-675) Hearing to consider an application by Diek Hughes Inc . Towing and Starting , for a Conditional Use Permit for an impound lot at approximately 900 Second Street N. E. (a portion of the Massey- Ferguson property) . Mr. Hughes appeared before the Commission . He stated that he presently has the towing contraet with the City and leases land from the City on the former landfill site . His lease will not be renewed due to possible development of the landfill site . He stated that the debris that is on the — leased site is not from his towing business but from tenants he has sharing the lot with him. He does no dismanteling or repair of cars on his site . Mr . Hughes stated he will move a new mobile home on the site whieh will meet all the building code requirements . There is a person on duty 24 hours a day, with the exception that this person may leave for a short period of time for a night call . He would like to have lights on the lot which would face away from the street into the lot . He also stated that another fence will be added behind the existing fence to allow for the 50 foot setbaek . The Commission stated concern about inoreased traffic in the area. Mr. Hughes stated that they tow about 10 cars a day and many of those are towed at night . Staff stated concern with this type of use in this area and are against the proposal . Ms . Richardson moved and Mr. Denny seeonded a motion to continue the hearing to the next meeting and require the applicant to: 1 . Meet with the surrounding owners and tenants , 2 . Prepare a landseape plan for the 50 foot setback , 3 . Prepare a surface plan for the 80 ,000 square feet in asphalt , concrete or another alternative , � . Plan for an opque type fenee . Ms . Riehardson and Mr. Denny voting yea; Mrs . Brandon and Mr. R. Anderson voted nay. Tie vote . Item forwarded to Couneil with no recommendations or findings of fact . CASE N0: VN87-8 Hearing to consider an application by Claude H. Black for a 5 foot side yard variance to construet an addition to the building at 620 12th Avenue South .
