10-29-1963 A regular meeting of the Zoning and Planning Commission of the City of Hopkins was held in the Council Chambers of the City Hall on Tuesday October 29th, 1963, at 7:30 p.m. o'clock. Present were Chairman Sundby, members, Mayor Milbert, Gustafson, Stannard, Malecha and Larson. The City Manager, Brubacher, the City Engineer, Strojan, the City Building "' Inspector, Blomquist and the City Planner Hawks represented by a Mr. Dale. Case No. 63-4-MR-1, MR-2 and C-2 areas. Applicant: The Zoning and Planning Commission. Subject: The proposed Ordinance �k224 was referred from the October lst, 1963, Council Reel -3- meeting back to the Zoning and Planning Commission for additional study. Side -3- The hearing was published August 29, 1963 on the rezoning of certain de- 326 - 469 scribed property from Multiple-Residence to MR-1; from Multiple- Residence to MR-2 and from Business-Residence to Commercial-2 Districts viz: Section 3. LOCATION AND BOUNDARY LINE OF MR-1 DISTRICT. The location and boundary lines of the area in the City of Hopkins comprising the MR-2 District is as follows: Lots 13 through 23, inclusive, Block 58, West Minneapolis; All of Elmo Park Addition; That part of the Northwest 4 of the Northwest � of the Northwest 4 of Section 24, Township 117, Range 22, Iying North of a line parallel to and 450 feet North of the North right-of-way line of State Highway No. 7. And the official Hopkins Zoning Map is hereby amended in conformity herewith. Section 5 CERTAIN BUSINESS-RESIDENCE DISTRICT ARF,A NOW CHANGED TO ,... C-2 DISTRICT: The following described lands in the City of Hopkins now located and zoned as Business-Residence (B-R) Districts are hereby re-zoned and removed from such B-R Districts and hereby zoned as, and placed in the Commercial-2 (C-2) District. viz: The October 29th, 1963 Zoning and Planning Commission meeting minutes continued. That part of the Northeast 4 of the Northeast 4 of Section 23, Township 117, Range 22, lying South of the South right-of-way line of State Highway ��7 and East of — the Northeasterly right-of-way line of the Chicago and Northwestern Railway; That part of the Southeast 4 of the Northeast 4 of Section 23, Township 117, Range 22, lying Northeasterly of the Southwesterly right-of-way line of the Chicago and North- western Railway. Lots 7 through 11, inclusive, Block 1, Souba Addition; Lots 14 through 18, inclusive, Block 2, Gibb�s lst Addition to West Minneapolis. And the official Hopkins Zoni�g Map is hereby amended in conformity herewith; continued from the Special meeting of October 8th, 1963 ^ to be rewritten and again submitted to the City Council for its second reading. Request: Refer after additional study and re-writing back to the City Council for its second reading. Action: Mayor Milbert moved and Mr. Stannard seconded the motion that the re- commend changes relative to "high-rise" provisions in the MR-2 areas and other small changes to be made by the City Attorney, Mr. Vesely, be made and then the revised Ordinance be recommended by the Commission to the City Council for that bodies second reading. The motion carried. Case No. 63-45-Special-Use-Permit. Applicant: Mr. J. E. Reimann Subject: A hearing published October 17th, 1963, for a Special-Use-Permit for the 0 - 49 proposed construction of a Drive-in resturant. The location; Lots 1, 2, 3, and the East 25 feet of Lot 4, Block 16, and including portion of vacated alley, West Minneapolis Center; or 519 Excelsior Avenue East. Request: A Special-Use-Permit for the proposed construction of a Drive-in resturant. -- Action: No one appeared to oppose the request. Mr. Larson moved and Mr. Gustafson seconded the motion that the Zoning and Planning Commission recommend to the City Council that that body approve the request for the Special-Use- Permit for the construction of the Drive-in resturant. The motion carried. Case 63-48-Re-zoning: Applicant: Robert Mason and Arnold Bursch. Subject: A hearing published October 17, 1963 for the rezoning of certain property 49 - 251 from Double-Residence to Multiple-Residence. The area to be rezoned is that part of the West 2 of the Northeast 4 of Section 24, Township 117 North, Range 22 West describ>_d as follows: Beginning on the East line of the West2 of the Northeast 4 at a point 1426.9 feet South of the Northeast corner thereof; thence South along the East line of the West 2 394.7 feet to the North line of Minnetonka Mills Road; thence Northwesterly along the North line of Minnetonka Mills Road 703.64 feet; thence North parallel with the East line of the West Z of the Northeast 4 291.68 feet; thence South- easterly parallel with the Northerly line of Minnetonka Mills Road 171.72 feet; thence South parallel with the East line of the West 2 of the North- east � 111.54 feet; thence East 486.87 feet to the point of beginning, except the East 164 feet thereof or 509 to 617 Minnetonka Mills Road. ^ Request: The rezoning from Double-Residence to Multiple-Residence District the above described property. Action: Mr. Malecha moved and Mr. Stannard seconded the motion that the Zoning and Planning Commission continue the above request for rezoning until the next regular meeting,or November 26th, 1963, of the Commission. Ordinance �k224 will be approved and the provisions of MR-2 spelled out so the Commission will know the provisions of MR-2 and how it will apply to this area. The motion carried. Case No. 63-47-Variance � Applicant: Suburban Chevrolet Subject: A hearing published October 17, 1963, for an application to waive the set- back from the alley for the proposed construction of a Car Sales office. The location; Lots 11 through 15, Block 70, West Minneapolis, 2nd. Addition or 1115 Excelsior Avenue. Request: A variance of "set-back" from the alley for a proposed construction. Action: Mr. Gustafson moved and Mr. Larson seconded the motion that the Zoning and 253 - 317 Planning Commission recommend to the City Council that the request for a variance of the "set-back" of two feet instead of the required ten feet from the alley line be denied based on the requirements of Ordinance ��131 Section 8, Subdivision 5 (B) which states that any East-West alley on the side of such alley adjacent to property fronting on Excelsior Avenue must have a "set-back" of ten (10) feet. The motion carried. Case No. 63-49-Special-Use-Permit. Applicant: Hansord Agency Inc. 1328 Hennepin Avenue, Minneapolis, Minnesota. Subject: To construct a proposed building in the Industrial zone on that part 316 - 326 of Lot 75, lying West of a line parallel with and 635 feet West measured � at right angles from the East line of said Lot 75, except the Northwesterly 30 feet thereof. Also that part of Lot 76, lying West of a line parallel with and 635 feet West, measured at right angles, from the East line of said Lot 76. "There is also excepted from said premises the part hereto- fore taken for the highway purposes". Present owner: C. V. Egekvist. Request: Order a hearing for a Special-use-permit. Action: Ma.yor Milbert moved and Mr. Malecha seconded the motion that Resolution �k165 "A RESOLUTLION ORDERING A HEA.RING FOR THE ISSUANCE OF A SPECIAL USE PERMIT FOR THE PROPOSED CONSTRUCTION OF A BUILDING IN THE INDUSTRIAL ZONE" or on the above described property.
