11-26-1963 A regular meeting of the Zoning and Planning Commission of the City of Hopkins was
held in the Council Chambers of the City Hall on Tuesday, November 26th, at 7:30 p.m.

Present were Chariman Sundby, and members Mayor Milbert, Councilman Pokorny, Jr. ,
� Gustafson, Malecha and Larson. The City Manager, Brubacher, the City Building In-
spector, Blomquist and the City Planner, Hawks.
Case No. 63-48-Zoning
Applicant: Robert Mason and Arnold Brusch.
Subject: A hearing published October 17th, 1963, for the rezoning of certain property
from Double-Residence to Multiple-Residence. The area to be rezone is
that part of the West 2 of the Northeast 4 of Section 24, Township 117
North, Range 22 West, described as follows: Beginning on the East line
of the West 2 of the Northeast 4 at a point 1426.0 feet South of the North-
east corner thereof; thence South along the East line of the West 4 394.7
feet to the North line of Minnetonka Mills Road; thence Northwesterly
along the North parallel with the East line of the West 2 of the Northeast 2
of the Northeast 4 (29.68) feet; thence Southeasterly parallel with the
Northerly line of Minnetonka Mills Road 171.72 feet; thence South parallel
with the East line of the West 2 of the Northeast 4 171.54 feet; thence
East 486.87 feet to the point of beginning, except for the East 164 feet
thereof, or from 509 to 617 Minnetonka Mills Road.
Request: To rezone from Double-Residence to Multiple-Residence.

Action: Mr. Stannard moved and Mr. Malecha seconded the motion that any action on
Reel -5- the request to rezone the above described property be held in abeyance
Side -1- until more time be given to study the zoning of the entire area and there-

Commission meeting which will be held at 8: 30 p,m, on Monday, December 30th,

Subject: A hearing published November 14th, 1963, for a request for a Special-Use
413 - 503 Permit for a proposed construction of an Industrial building in an In-
dustrial District. The location, that part of Lot 75, lying West of a
line parallel with and 635 feet West measured at right angles, from the
East line of said Lot 75, except the Northwesterly 30 feet thereof. Also
that part of Lot 76, lying West of a line parallel with the 635 feet West,
measured at right angles, from the East line of said Lot 76. "Excepted
from said premises the part heretofore taken for highway purposes," or
West of National Tea building, North of Excelsior Avenue and East of Monk
Avenue.
Request: A Special-Use-Permit for the construction of an Industrial building in an
Industrial District.
Action: Mayor Milbert moved and Councilman Pokorny, Jr, seconded the motion that
413 - 503 the request for a Special-Use-Permit for the construction of a sales
building in an Industrial District on the above described property with
the provision for a thirty (30) feet set-back at Monk Avenue running East
in a line to a point even with the National Tea Food Company sign, (about
100 feet) and except that part of said premises that heretofore were taken
for highway purposes. All plans for the types of signs and construction
to be approved by our Building Inspector and City Planner. The motion

Case No. 63-50-Front and Side-yard variances.

Subject: A hearing published November 14th, 1963, for a request for variances for
503 - 8,53 the Zoning and Planning Commission recommend to the City Council that that
body approve the request for the variances for the construction of a proposed
building to be used as a roiler rink on the following described premises
^ situated in Hopkins, Hennepin County, Minnesota; the North 80 feet of
that part of Southeat 4 of Section 23, Township 117, Range 22, lying West
of a line parallel with the distance 505.2 feet West from center line of
Nineteenth Avenue South and South of a line running West at right angles
from said center line at a point distance 127.3 feet North along same
from North line of County Road ��3 (C.M. & St. P. R.R. right-of-way) except
road; or approximately 139 Shady Oak Road. Case No. 63-50-Variance.

Case No. 63-52-Variance
Applicant: Mr. Gibb Swanson
— Subject: A request for a side-yard variance on both sides of a lot to allow for
853 - 930 the proposed construction of a residence in such a matter as to save
the cutting down of a tree located on the lot. The tree shades the home
of the neighbor; the neighbor requests that the proposed house be located
in such a way as to save the tree.
Request: For side-yard variances of from eight (8) to six (6) feet on both sides
of the lot.
Action: Mr. Gustafson moved and Mr. Larson seconded the motion that Resolution
853 - 930 ��166 "A RESOLUTION ORDERING A HEARING FOR THE ISSUANCE OF A VARIANCE FOR
BOTH SIDES OF A RESIDENCIAL LOT FOR THE PROPOSED CONSTRUCTION OF A HOME",
on the following descibed property: Lot 16, Block 85, West Minneapolis,
Second Division or 225 - 7th Avenue North. The hearing to be held at the
next special meeting of the Zoning and Planning Co�nission on December lOth,
1963. The motion carried. Case No. 63-52-V. Applicant: Gibb Swanson.
Case No. 63-28-Z �
Applicant: The Zoning and Planning Commission.
Subject: Request and study a proposed ordinance requiri�g all buildable lots to
have frontage on a public right-of-way. _

Request: After the study of this evening any additional suggestion and data relat.�ve''r
to the proposed ordinance be recommended to the City Council for their
consideration of having an ordinance drawn.
Action: Mayor Milbert moved and Mr. Stannard seconded the motion that the Zoning
935 - 1057 Planning Commission recommend to the City Council that that body consider
the proposed findings requiring all buildable lots to have frontage on a
public right-of-way before a building permit be issued. The motion carried.
Case No. 63-28-Z. Applicant: The Zoning and Planning Commission.
There was a general discussion relative to the study of the new proposed
3rd Avenue North. It was determined that neither the County or the people
living in the area concerned be approached relative to the new road until
after the December lOth, 1963 election. No formal action was taken.
No further business being on the agenda, the Zoning and Planning Commission adjourned.

WHEREAS, said applicant request adjustment of said requirement:
NOW THEREFORE, IT IS HEREBY ORDERED that the Zoning and Planning
Commission of the City of Hopkins will hold a hearing on said application
in the Council Chambers of the City Hall of Hopkins, Minnesota at 7:30 p.m.
o'clock on November 26th, 1963, and that the Building Inspector shall give
seven (7) days published notice of said hearing in the offical newspaper
of the City by publishing a copy of this hearing notice therein
