06-26-1962 A regular meeting of the Zoning and Planning Commission of the City of Hopkins, Minnesota
was held on Tuesday, June 26, 1962 at 7:30 p.m. in the Council Chambers of the City Hall.
Present were Mayor Milbert, Councilma.n Else, and members Stanna.rd and Sundby, and the
City Manager, Brubacher.
�-- Mr. Else moved and Mr. Stannard seconded the motion that Ma.yor Milbert be appointed
Chairman pro tem. The motion carried.
Mr. Stannard moved and Mr. Else seconded the motion that recommendation be made to the
City Council to approve the request to divide a parcel of land having 141' of frontage
on County Road 73 and 240� deep into one parcel of 66' X 140' for his house; on the re-
ma.ining 75' X 140' the application to construct a proposed apartment building in the
Multyply-Residence District, with the requested variance from 100' to 75� with the proviso,
that the proposed apartment building be set back thirty feet from the front lot line;
the proposed apartment building to be located at the North 141 6/10 feet of the West 271
feet of the Northwest 4 of the Northwest 4i excluding road, Section 24, Township 117,
Range 22, or at 533 - 17th Avenue North. The application for the proposed building made
by Mr. Golden Simmons. The motion carried.
Mr. Stannard moved and Mr. Else seconded the motion that recommendation be made to
the City Council to approve the application to construct a proposed addition to an ex-
isting house in certain Single-Residence District with a variance of side yard require-
ments from 12 feet to 3 feet because of the 80 foot right-of-way of Goodrich Avenue;
�iz: Lots 28, 29 and 30, Block 11, F. A. Savage�s Interlachen Road or 200 Homedale; the
application made by Mr. Thoma.s Carr. The motion carried.
\� Mr. Sundby moved and Mr. Else seconded the motion that recommendation be made to the
City Council to vacate ten (10) feet on each side of Goodrich Avenue to bring Goodrich
Avenue into the regulation width of the rest of the Avenues of the City of Hopkins.
The motion carried.
Mr. Else moved and Mr. Stannard seconded the motion that reco�nendation be made to
the City Council to deny the application to construct a proposed house in certain
Double-Residence District with a variance of side yard requirements from eight (8)
feet to four (4) feet due to established previous interpretations of Ordinance ��131;
viz: Lot 16, Block 2, Stevens Oakwood Park; said application made by Mr. John Meath.
The motion carried.
Mr. Sundby moved and Mr. Stannard seconded the motion that recommendation be made to
the City Council to approve the application to construct an addition to the front of
existing building with a variance in the front yard from thirty (30) feet to fifteen
(15) feet. The proposed addition to be a fourteen (14) feet by eight (8) feet office
section across the front of the existing building providing the addition is brick
faced; viz: 601 - 12th Avenue South; said application applied for by Mr. W. M. Nelsen.
The motion carried.
Mr. Sundby moved and Mr. Else seconded the motion that recommendation be made to
`— the City Council to deny the application for a building permit to construct a single
family dwelling on Lot 7, Bla�k 14, West Minneapolis, 3rd. Division or 20 - 19th Avenue
North until additional information can be submitted by Mr. Dill or Mr. Nelson and for
further study. The motion carried.
The request by Mr. Dill and Mr. Nelson of Dill and Nelson Inc. for approval of a Sub-
division of the following lot located in a Double-Residence District viz: commencing
at a point 240 feet South from the North line and 153.2 feet East from the West line
of lot 70, Auditors Sub-division ��239, thence East 182.4 feet parallel with the North
line thereof, thence South 175 feet, thence deflecting right 108 degrees a distance of
180 feet, thence Northeasterly to point of beginning was tabled without action for the
following reasons:
"The information as submitted is not sufficient for the analysis required,
however, the area is need of attention and it is recommended that the
Planning Commission continue the study and request a detailed site plan
showing easements, lot lines, proposed lot lines, streets and utilities "
Mr. Sundby moved and Mr. Stannard seconded the motion that recommendation be ma.de to
the City Council to approve the building permit application for the proposed construction
of an apartment building at 1214 - lst Street South with a request for a variance of
� a rear yard set-back from Lcrty (40) feet to eight (8) feet with the recommendation
that the proposed building be moved to the South lot line so as to give a twenty (20)
feet side yard instead of the proposed seventeen and one half (17z) side yard; said
application applied for by Mr. Don Hagen. The motion carried.
Mr. Sorenson a�peared before the Commission with the request for a building permit for
a proposed addition to a house in certain Double-Residence District with a variance of
Minutes of the Zoning and Planning Commission meeting of June 26 cont.
four (4) feet instead of the required eight (8) feet. A special hearing will be held
at 7: 15 p.m. on Tuesday, July 3, 1962 with the members of the Zoning and Planning
Commission to comply with the previsions of Ordinance �k131.

Mayor Milbert: "Then too, County road 73 will be widened, how far is this house on the
North set back?"
Mr. Simmons: "That's Henry and he is at least thirty feet from the road,"
Mayor Milbert: "You could set the building back another 10 feet."

Mayor Milbert: "If the variance is granted to you would you set your building back
thir`y feet?"
Mr. Hawks: "The general house scale out there is six feet."
Mr. Simmons: "What I will do if the variance is granted is to set my apartment back

Mr. Stannard moved and Mr. Else seconded the motion that recommendation be made to the

Mayor Milbert: "This is the one where the right-of-way of the street is 80' compared to
the usual 60' street right-of-way.
Mr. Carr: My present garage is really on City property. It is my intention to put the
garage back three foot further and attach it to the house." "If an examination were
ma.de a good per centage of the property owners are encroaching on the City's pgc�erty
� lines. This is because Goodrich Avenue is set out so far." "This is Goodrich, pointing
to a ma.p, This is three feet considering the bank. You could walk up from the garage
tc� the stairway here. I have a high lot, The garage will be at the back and will be 8'
high but it will still be about three .down to the garage, as you can see."

Mayor Milbert: "I can`t see anything wrong with it."
Mr. Hawks: "If you considered Goodrich a sixty foot Avenue like the rest of the
avenues he wouldn't have to ask for a variance."
Mr. Carr: "The only way the people can ��e in compliance would be for the City to grant

a vacation of part of the Avenue."
Mr. Else: "Did we just pave Goodrich;"
Mr. Brubacher: "Part of it; I think we should consider vacation of a section of Goodrich."
"I would suggest the vacation of 10' on both sides of the Avenue ."
Mr. Blomquist: "You can talk about having the street vacated but in the meantime this
building permit is a problem."
Mr. Carr: " I am going to connect with the sewer. "I have a good long ways, about 700
feet."
Mayor Milbert: "We could recommend the varaince be granted subject to the vacation of
of street."
, Mr. Stannard: "I don't know why we can't pass the variance and then pass a vacation
motion."
Mr. Blomquist: "If it has to be that way."

Mayor Milbert: "The proposal is to build on 2 of lot 16 which hill make it a 54' lot."
Mr. Hawks: "(Showing house plans) This is the house he has selected to build on that lot
it is a 46 foot house which give him four feet on each side."
Mr. Else: "What is the total footage of the house?"
Mr. Milbert: "Mr. Meath, do you have any other alternatives whereby you could pick up
�- another four feet of land?"
Mr. Meath: "I could, but I would be taking it away from this other lot."
Mr. Hawks: "Explaining that the 54 foot lot is buildable by wording oi the ordinance.
I would suggest building on the 54 foot lot but with no variancce:�of the eight feet on

Mr. Meath: "There is a vacant lot on the North".
Ma.yor Milbert: "Is there 60 feet on the North?"
Mr. Meath: "There is a 108 foot lot on the North."

neighborhood. Here is the five lot section we are talking about, this is the road."
"The overall intent is to have the house on the back of the lot. You should get a
house plan that does not have to have a variance."
Mr. Stanna.rd: "Is thp�e some real good reason except that �ou like this plan and therefore
want to build with the variance?"
Mr. Meath: With my size of family I have to have a house large enough to take care of
them, if I don't use this type of plan I have to use one that is so deep."
Mr. Else: "By the time you get your overhang you will be two feet from the edge of the
lot."
..- Mr. Sunday: "Is there a house on the lot to the North?"
Mayor Milbert: "No."
Mayor Milbert: "The feeling seems to be John that you should have some reason to grant
the variance. Can you get some land on the North?"
Mr. Meath: "I could get a few feet from Mr. Blatzheim ."
Mr. Else: There would be nothing to keep him from buying part of this from Blatzheim.
Then you could get two lots, (looking at map) one large one on the corner and one on the
back."
Mayor Milbert: "Try to buy some more land on the North, John."
Mr. Meath: "What do I have to do then to get a permit if I can get the extra footage."
Mayor Milbert: "If you can buy the land just get a building permit and go ahead and build."
Mr. Else moved and Mr. Stannard seconded the motion that recommendation be made to the
City Council to deny the application to construct a proposed house in certain Double-
Residence District with a variance of side yard requirements from eight (8) feet to four
(4) feet due to established previous interpretations of Ordiance ��131; uiz: Lot 16, Block 2,
Stevens Oakwood Park; said application made by Mr. John Meath. The motion carried.
5-A. Application for proposed construction of addition to the front of present building
with a -�;ariance in the front yard from 30 feet to 15 feet. The proposed addition to be
a 14' X 8' office section across front of the building with a variance in the front yard
from 30 feet to 15 feet. The proposed construction is located in the Industrial District;
viz: 601 - 12th Avenue South; said application applied for by Mr. W. M. Nelson.
� Mr. Hawks: "I have been over to 12th were he is built; there ���e two building, both old,
32 X 56' . What he is requesting to do is to build on offices to bring it out even to
the South. There is parking, loading, etc. There will be=a problem if 6th ever goes in.
But the general feeling is that they are never going to put a bridge in there. The

building is a one story affair."
Ma.yor Milbert: Will the new addition line up with the buildings to the South if it's
your recommendation th�t we grant this variance?"
Mr. Brubracher: "Can we stipulate that the the building addition be built of brick?"

Mr. Hawk: "I just found out he put four foot footage on the other two buildings.
Mr. Blomquist: "He will ma.ke it of brick. He told me it was going to be brick. He is
ge�ing educated to what is happening down there."
Mayor Milbert: "I hope so."
Mr. H<�wks: "Mr. Nelson is getting out."
Mr. Sundby moved and Mr. Stannard seconded the motion that reco�nendation be made to the
City Council to approve the application to construct an addition to the front of existing
building with a variance in the front yard from thirty (30) feet to fifteen (15� feet.

7-A. A building permit application by Dill & Nelson Inc, to construct a single iamily
dwelling on lot 7, Block 14, West Minneapolis 3rd Division at ��20; 19th Avenue North
on a 40 foot lot in a Double-Residence District.
Mr. Hawks: I did talk to him on this. The ordinance states that if the lot was in existence
he could build on it. I don't know, if was plotte� before that. The lots down there are
a11 40 foot ones. I don't know if he had those lots at that time. If he was to build
now he would have to have a variance as it is." "There are houses in the same area on
forty foot lots. He is not asking for any variance, the house fits on the forty foo:'�
lot. (pointing at a map) "It is right here in this area."
Mr. Sundby: "i�te, couldn't give a variance when we might not need to give one."
Mr. Hawks: "1956 was when the ordinance on 40' lot was passed; if the lot was owned by
one party they can now build, but if it has been sold since that time the new owner can't
build. "It's a nice area, quite a number of variances, not pattern really, 40, 50 and
60 foot lots."
Mr. Else: What are we going to gain by delay?"
Mayor Milbert: "If we found that it was under one ownship then we would need to have

Mr. H.�wks: "When you go past there you look down on the place where Mr. Tweed is wanting
to put that garage."
�- Mr. Sundby: "Jim, is it your recommendation that we grant the variance?"
Mr. Hawks: "It is like a lot of houses in Minneapolis, all set way back."
Mr. Brubacher: "Would it all right to table it for now, and then get more complete informa.tior

Council to deny the application for a building permit to construct a single family dwelling

Mr. Donald Hagen: "That is the piece across from the Fair grounds, on 13th."
Mayor Milbert: "Is there an old house next to it or are there two?"
Mr. Hagen: "There are two houses but not connected."
Mr. Hawks: "Is this piece of land not on the market?"
Mr. Hagen: "It is owned by Dr Kucera's mother. We have tired to work out a trade with

her. She and her Mother have to live close in because they have to be in the up-town
•�district. They both work I think, cleaning or something."
Mr. Hagen: The folks around there say they would like to see anything go in there.
They say you can build anything if you get rid of what we have got."

Mr. Sundby: "How many unit in the apartment building?"
Mr. Hagen: "There will be 12 units."
Mr. Hawks: " "It is hard to say what to do with it, it is like a dump now."
Ma.yor Milbert: "Are you going to request the improvement of 12 to 13th?"
Mr. Hagen: "Yes, and sewer and water."
Mr. Brubacher: "They have got septic tanks."
Mr. Hagen: "Yes, and some of them don't have them."
Mr. Hawks: "There are two sides to this situation. You have to assume this house is not
going to be there. What will happen to this lot? (looking at map)"

Mr. Sundby moved and Mr. Stannard seconded the motion that recommendation be made to the
City Council to approve the building permit application for the proposed construction of
an apartment building at 1214 - lst Street South with a request for a variance of
a rear yard set-back from forty (40) feet to eight (8) feet with the recommendation that
the proposed building be moved to the South lot line so as to give a twenty (20) foot
side yard instead of the proposed seventeen and onehalf (172) side yard; said application
applied for by Mr. Don Hagen. The motion carried.
Mr. Sorenson appeared before the Commission with the re�uest for a building permit, a
proposed addition to a house in certain Double-Residence District with a variance of

Mr. Sorenson: "I wish to build an addition on back of my house. The house wont be any
wider but the lot lines run off. That's at 20 - 18th Avenue North,"
Ma.yor Milbert: "You will need a variance then?"
Mr. Sorenson:" Yes, the lot is sort of on a slant; and on the side as the addition goes back
the side yard looses 1 foo�; it is still paral��el to the line, you see what i ',rean?"
Mr. Hawks: "This is a 40 foot lot; the house is 24 X24 feet; The house is about 5 feet
from the lot line now, which is all right."
Mayor Milbert: (looking at lot plan) "If the neighbor were to build on his house would
drift away."
� Mr. Hawks: (looking at lot plan) "It looks like the neighbor's tool shed is on the line."
Mr. Strojan :"Yes, it is."
Mr. Stannard: "The variance would be on the side yar� only?"
Mr. Blomquist: "I believe it has been accepted that five feet is all right for a 40 foot

foot lot, but because it is a tapered lot the rear would be under the five feet."
Mr. Blomquist: "At one time the ordinance stated that the side yards much be 10% of the
width of the lot, so on a 40 foot lot the side yard should be 4 feet."
�– Mayor Milbert: "That is the same thing I am thinking."
Mr. Hawks: "This is an older part of the City, to build an addition would just be adding
to the value of the home, it is better to try to increase the homes value in this area."
Mayor Milbert: "You would come out of the house on the side."
Mr. Hawks: "You plan on putting a basement under the addtion too?"
Mr. Sorenson: "Yes, I plan on putting a basement under the addition and we will continue
to use the same side of the house, in fact there will be no new outside �ntrances from the
addition."
Mayor Milbert: "The only way I see it is that you would be improv_ng your property."
Mr. Blomquist: "We would have to have a hearing."
Ma.yor Milbert: "Can you get it in this week yet?" "Fern can get it if you give it to

Mrs. Bren: "I will call the paper, they put one in for us last week, but we have to
notify the adjoining prc�perty owners because we would be short one day."
Mr. Sorenson: "I have a letter with me from my only neighbor." (Shows the letter to
Mayor Milbert) .
Mayor Milbert : "Let's get it published and have a short Zoning and Planning meeting before
the next Council meeting and then Mr. Sorenson can get started right away."
Mr. Else moved and Mr. Sundby seconded the motion that the Building Inspector order the
hearing. The motion carried.
